However. The truth must be told. It is shameful that the supreme court will affirm elections that both the national and international communities have condemned for the mindless rigging that the marred the election.

Two case studies are the Rivers and akwa ibom state governorship elections that were marred with electoral malpractices. both the tribunal and the court of appeal validated the fact thar bothe elections were rigged without an iota of conscience. yet the supreme court shamelessly validated those rigged elections to the surprise of Nigerians and the world at last.

The supreme court judgement of late has become a national and international embarrassment. And our highest court in the land is beginning to lose their reputation.

The best way out is to develop e- voting system that is solid enough to counter use of manual rigging or else people will continue to rig and you won't be able to prove it at supreme court .

It is not any embarrassment if at all it goes to show our judiciary not to be partisan and incorruptible.

If any election should be termed as embarrassment it was the presidential election that showed the world where underaged were voting. Yet in order not to truncate our nascent democracy GEJ overlooked it and let it be. Something that even Bihari will not agree to or any of our past leaders.

that is not how jurisprudence works.

You can't punish a Trial Judge because you do not agree with his opinion.

If proof of bribery is substantiated, so be it. But to say because he felt party A was right, and you at the supreme court feel part B was right, so the juniour judge must be punished...what impetus.

The only reason the Supreme court is arm twisted into making this sort of decision is because of the mistake it made in the Rivers case.

In the Rivers case, they held that the use of Card reader was not a constitutional provision and so cannot be tendered as evidence as to whether or not an election truly held or didn't.

That opinion was enough to make all riggers win their case.

This opinion is against what the Tribunals and appeal Courts held, and although one may argue that truly the card reader was not mentioned in the electoral act or constitution, it is understandable that the act grants INEC the right to organise it's affairs. Hence, any method it deems fit for Identifying a registered voter should become Law and Binding.

Hmmmmm anytime I hear about the Supreme Court just one saying flashes my mind first and which is that made by justice Oputa the Supreme Court Justice.

"we are final not because we are infallible but we are infallible because we are final"

This is always bound to occur where someone or an institution becomes the highest authority without a checkmate from another body.

Though I'm not vast in legal matters to determine whether or not the cases they affirmed was right or wrong but I think the only way to avert any form of suspicion is to ensure that the body in charge of appointing supreme Court judges have credible individuals as members so as to appoint people of high credibility and avoid all these confusion arising from judgements been passed by the highest court in the land

In my opinion also, I think when and where judgments are upturned by higher courts or same courts, the former presiding judge/s should be tried so as to serve as deterrent to others who might want to tow the path of boycotting justice for whatever gain they might get

Long live the federal Republic of Nigeria
Long live Ogun State at 40

But the judgment as delivered yesterday over the two states governorship elections were presided by the Chief Jutice of Nigeria himself and only with his six other colleagues. Unless you want to tell me the chief justice himself is of questionable character as well.

Who told Op that our court of law is subject to societal sentiment and opinion of international communities. If not because our citizens lack patriotism why must opinion of any society take precedece over our Supreme Court. Op Court of Law is not Court of opinion and court of law works with evidence

OP, please lets wait for the reasons of the Supreme Court Justices before dissecting the judgement. However, look properly at the case of Akwa Ibom. The APC first claimed there were no elections due to violence. How come the Appeal Court awarded them votes. One of the tenets of the rule of law is that you don't build something on nothing. You cannot approach the courts to cancel the election and order a rerun because you claimed there were widespread violence and therefore elections couldn't hold and then again, you have votes that have been validly and legally credited to you and wish to build on those votes. Any good lawyer will tell you that the Akwa Ibom Case will not sail. I believe the Tribunal and Appeal Courts Justices may have been manipulated.

However, before finally taking a position, I advise we wait for the full judgement of the Supreme Court to be released.

Now that the cases of these governors have been settled, let full governance begin. The electorate is better for it.

No explanation was given for this
contradiction.
That “No voting” was used by the tribunal

Lol, what a flawed analysis .

The mistake was made when PDP's case against the APC in Lagos State was strucked out and the PDP lost which gave rise to the questions about card reader accreditation and manual accreditation and if Wike's election was cancelled based on that judgement then we would have seen about 26 APC Governors in the court and a rerun would have taken place and of course you can never tell how it will pan out considering the current state of the economy with the APC states having the worst part of the cash crunch.

The APC knew that if Wike's case had gone for a rerun the entire 2015 election would have looked like a joke and the joke would have been on the current Government and finally the judgement was free and fair because if we should slide into a one party system with the dubious politicians we have in this country , then what happened during PDP's 16 yrs rule of no visible opposition would have reared its ugly head once more but this time with a man that his total disregard for democratic institution is well documented being in charge and this is not good for the growth of our democracy and FYI Mary Odili being among the judges couldn't have made any difference at all.
This is the Supreme Court and not the appellate court where you have lawyers that are ready to twist the constitution to give a lopsided judgement .

If our judicial system were credible, the Supreme Court at least should have upheld some decisions of the Appeal Court. This will show that the judges are honorable and people of integrity which they should be. The Supreme Court setting aside ALL the decisions of the Appeal Court speaks volume about our judiciary and its composition. It shows the Judiciary is grossly incompetent, biased or partisan. For me, winning a court case at the Appeal Court or the Supreme Court depends on the interest of the judges. Maybe the Appeal Court judges are pro- APC and those at the Supreme Court are pro-PDP.

Very very incisive, cogent, apt, informed and aposite analysis. The Supreme Court of Nigeria says the need to do substantial justice and not technical considerations should guide Judges in delivering judgments yet it went ahead to deliver a manifestly unjust decision. The common man who witnessed first hand the happenings during the Governorship elections in Rivers and Akwa Ibom States know so and must have scant, if any regard, for The Supreme Court. Justice must not only be done but be seen to have been done! INEC is now in a quandary as to what to do with the card readers that had done so much to sanitise and validate our electoral process. Isn't Buhari correct, in retrospect, that The Judiciary is a cog in the wheel of the fight against corruption in Nigeria? undecided
