No, that's quite different because it was an order from the Magistrate Court which unfortunately lacks jurisdiction in this case.

I thought you were referring to out of court settlement with the family at the Police Station before the case was instituted in the Court, that is while the case was still at the local Police Division, not at the SCID.

Next2Bezee:

She tried to settle them 100k...100k!!!

Even when the case was re-opened and her 100k was returned to her, she tried again to appeal the jail sentence and have it swapped with the original 100k fine....100k!!!

Nna i don't feel sorry for her, let's see how her 100k will help her in jail.

jailing her will do nothing for the dead, let by gones be by gones. it was an unfortunate accident, they shouldnt be harsh in jailing her. living with a conscience that she unintentionally killed someone and having the memory every single day is far worse than any jail sentence. let the woman be pardoned.

l agree with you the woman is now sober. She was very sober during Ben Bruce birthday which took place about 3 weeks ago, the memory of the doctor she mistakenly killed due to her reckless driving is still hurting her.

I don't know how people think, four years ago my hit a man while I was teaching her how to drive, people around beat the hell out of me and my woman, and the man did not die. That was the first time I have sence. I pay for the treatment and visit the man's house that I became family friend to the man. Today the man's last son got a job through me. Why am saying this is that your mum mess up big time. She feel that nothing is happening she should have made peace and be friends with the doctor family by all means hold a fund raising for the family and by so doing the family will kill the case. There were one million ways for her to show support to the family but she could not do so. If I rape your kid sister and u see me on TV showing off as if nothing has happen I bet u that u will come for me. You should have not go on social media, this will only make people mad at your whole family.now people are saying your mama drink a lot whenever she go on a function. How many times have u reach out to the dead man's family or even try to a friend to any of the child? O boy your mum was so luck not to have been killed on that very day.just pray she go to jail and come out with good health. So pls, just close your month before u make people/nigerians especially those that hate your push the case more just to see your mum cry. Use your head boy

What kind of prayer is this dude asking for? your mum drove under influence, caused the death of a man coming back from work, a man who has young children too.God is a God of justice PLS LET THE LAW TAKE ITS COURSE WITHOUT ANY SENTIMENTS.

Hopefully, after the supreme court upholds her sentence, the FRSC should also suspend her driver's license like its done in saner climes. Its not as if she's sober sef, hell she may get drunk again and kill another person

The Nigerian police should be empowered with blood-alcohol monitors and other tools do detect drunk drivers , its just that our policemen have chosen to be unfortunate

For those that still get drunk and drive, your case no be for here, if you have an accident and die, do you think you will go to heaven?

Dr Giwa's dependants should still sue the woman in a civil court for damages and possible financial compensation

For those pleading for mercy etc for her, what if Dr Giwa was your father/son/uncle would you still say the same thing? that Dangote trucks and other trucks get away with things like this doesn't make it right, in saner climes Dangote/his insurers would be paying thru his/their nose(s) with possible jail terms meted out to some of those errant drivers or owners. Good thing is, we can start enforcing these laws from somewhere.

E go better!

Am not trying to sound preemptive nor prejudicial but if the truth must be told, Ibinabo Fiberesima is as good as a prisoner. The supreme court will only confirm the appellate court judgment. Methinks the magistrate court judge that gave an option of fine, a ridiculously low sum of 100k should be tried as well for abuse of judicial process. Was he trying to exchange the death of a consultant surgeon, who practised overseas and was holidaying in his country before a drunk charlatan carelessly and avoidably cut short his precious and expensive life short with a hundred thousand naira? Obviously, there was an underhand dealing in the trial. The maximum sentence of 7 yrs imprisonment stipulated by law for such an offence should have been imposed. Perhaps, the prosecution wouldn't have appealed the magistrate court judgment if the fine wasn't that laughable but thank God it happened the way it did. I will only expect the supreme Court to add 2yrs to make the sentence maximum.
To her emotional son, the open letter is to me, nothing but balderdash, a worthless wrte-up from a self-centered son. Silence would have been golden and more appropriate. So, to the open letter, I say it is a closed case!

Or you mean living with more parties like the AMVCA party last week more like it.

Has anyone organised fund-raising dinner or something for Dr Giwa Suraj's family?

That would be one way to work towards making "by gone be by gone".

Not leaving the family much poorer off in every way.

It was unintentional, hence she is getting off almost scud free, with a meager five years sentence.

If it were intentional, she would been facing the hangman noose, or life imprisonment.

I think 100k was/is the maximum fine allowed. The money goes to the State, not the family (correct me if I'm wrong).
Yes, as for maximum of 7 years, the judge has discretion of I think 5 to 7 years.

The police may have done a subpar job initially, especially with a celeb involved. Proper alcohol breath, blood test & narcotics test could have shown for sure if under the influence.

But it seemed pretty sure to Sasore/LASG that she was very reckless and had a serious case to answer. LASG was outraged by the magistrate's decision then. That position seemed to have been confirmed by both the High Court & Appeal Court.

I doubt if Supreme Court would deem the magistrate court to have interpreted the law better than the higher courts.

This shows that lots of Nigerians don't get justice. If it was an impoverished family, they might have given up or be pacified with as little as N500k. LASG might never even have noticed the case as such.

The case needs to be reviewed by LASG to see how the initial lower court decision was arrived at. It is in public interest to avoid miscarriage of justice.

You are a good example of soneone who lacks experience.

No sane human will wish a fellow human one day behind bars except for criminals.

Take an excursion to a Nigerian prison facility and spend one night there. Then come back to repeat ur comment. Mostly, i dont know if you drive or know how accidents do happen.

Nigerians are lashing out at her owing to wrong perception of how she carries herself in public..

Let justice prevail. If she had settled d deceased family, it wouldn't ve generated 2 dis extent

I am suspecting that after the N100,000 fine judgement by the magistrate court, she went home to sleep.

If she had good advicers, she would have gone to placate the deceased's family on a daily basis much that even the family would ask Lagos state to tamper justice with mercy.

The way people carry themselves is very important.

Nigerians no get joy at all!! The same Nigerians way worship and butt-lick you when you be superstar, na still them go happy when you mess up. She deserves the sentence if she was driving drunk and I wish all drunk drivers experience such too, whenever they drive under the influence of alcohol. During one December period like that, a guy killed 6 people with his jeep because he was driving under the influence of alcohol and was speeding on the street with a very narrow drive path. What vexed me greatly was that the fool escaped the crime scene.

By the way, how did the judges/court ascertain that she was driving under influence?

I hope this judgement serves as a lesson to our young men out there. If you're going flexing, make sure you go with a friend who doesn't consume alcohol or one who can hold himself from getting drunk. In short don't even get drunk at all, all of you! Why am saying this is, the guy driving the car may not be drunk but your madness inside the car may lead the driver to accident. You may foolishly hit his head with a bottle while on the steering because you don't even know what you're doing..

Why are Nigerians this wicked & heartless especially those who comment on front page? I feel for the dead and his family but this is an accident and she has served some time. I personally wish it didn't happen and this Doctor is still alive to continue saving lives.

Many here who are chanting "crucify her" are far more reckless drivers than her only that they've been lucky so far. If she had done that deliberately, I would have wished she rotted in jail and if her going to jail will bring back the dead I would have approved it expressly. Many here who are wishing her jail are an envious lot who hate her for her celebrity status and her suffering gives them the pleasure they crave, not that they cared much for the dead. I pray those wishing her jail don't make the same mistake someday and meet what they wished her.

Honestly I don't understand why dey r dragging dis case.. It's really unfortunate that d doctor died, i can imagine d pain his death must av brought to his family but at d same time, it wasn't intentional, it was an accident I mean it was an accident for God's sake in which she was also involved, her Car was even a write off as we heard, she didn't set out dat day with d intention of killing.. But because she's a celebrity, dey kept on dragging & dragging d case ..
If I may ask how many people av dey jailed since wen dangote trailers have been killing Innocent Nigerians?? I believe dis case can settled out of court..

That's why she was given just a 5 year sentence, a light one that is for crimes like theft and so on. And 11 years ago sounds like delayed justice.
