If you are freezing fayose's account and tell us that the amount of fund found in it is questionable and linked to other investigative activities by the EFCC... POooh... What happens to amaechi...and co.

You keep wallowing like a bittered dunce. Even if you are being dealt a huge blow by the harshness of this nation, which is making your brain fume at level below insanity, you should have control over it and stop acting like it's completely damaged and out of control. I'm still patiently waiting for where I said Fayose has a constructive critics.

1. The Act which established EFCC clearly states that they need to secure and present a valid court order which will empower them to freeze any bank account under investigation.

2. The Constitution of the land, which is much more greater than the Act establishing EFCC, clearly states that you cannot initiate any court process against a sitting governor.

3. Now this: You need an order of the court to freeze someone's account and a court proceeding cannot be initiated against a sitting governor who has immunity.

Are you in support of this obvious illegality and brazen impunity? Then you must be checked psychologically and medically.

Although section 308 of the 1999 constitution gives immunity to serving governors, the EFCC spokesperson Mr. Wilson Uwujaren says such immunity does not stop a sitting governor from being investigated.

The EFCC says it decided to freeze Gov. Fayose account because it has sufficient evidence that some suspicious lodgments were traced to the account
His words: “It is true that we have frozen Governor Fayose’s account in connection with an ongoing investigation. We will soon release the details of our findings to the public.

“We froze the account because Fayose has no immunity against investigations.

“Let me clarify that the 1999 Constitution does not grant immunity to governors or public officers against investigation.

“The governors and others enjoying the immunity clause in Section 308 cannot be prosecuted. Therefore, Fayose cannot stop EFCC from doing its job.”


Asked if the amount in the Post No Bill ( PNB ) account was up to N1.3billion as being speculated, Uwujaren said: “Certainly, some amount was frozen in Fayose’s account but I cannot say the exact amount till tomorrow (today).”

A top official, who spoke in confidence, said: “It became necessary to freeze the account following clues on alleged suspicious lodgments.

“We will release the facts soon to Nigerians to appreciate the extent of our investigation.”

Governor Fayose has been having a running battle with the Federal Government over his anti-Buhari stance.

Recently, the governor was placed under security watch by the Federal Government and told point blank that he could not travel out of the country unless he seeks a clearance from the Department of State Security.

Many see this latest incident - freezing a sitting governor's account as one of the moves to muzzle the dissenting voices - a said pointer to the fact that Buhari is running a dictatorial government.

Dear learned friend, I want to ask you a few questions hopefully that will make us both understand the situation better. Fayose's account was frozen but he was NOT arrested nor detained (ordinarily he should have been arrested by now but for his status as governor and the yeye immunity crap).
It is a clear principle in constitutional law that a sitting governor can be investigated but can't prosecuted until he leaves office. I believe the answer to your question has been answered in the bolded above. Freezing his account still falls under investigation and results of which will be used for his eventual prosecution after his tenure. Let's call the exercise building up facts for the main thing (trial and subsequent prosecution).
Please tell me how has the EFCC contravened the law?
Fayose is one lousy hell of a governor making so much noise and yet with lots of worms canned in his kitchen. The world will be shocked at revelations that will exposed in days to come. If he must act the opposition, his hands should at least be clean. What can Ekiti people point to as achievement since taking over mantle of leadership in the state? Except for been blessed with the most lousy governor, can he defend all the allocation given to the state so far?
Tinubu did a good job playing the watchdog during the OBJ administration. Baba tried to frustrate him but as "corrupt" as people said Tinubu was... Developmental projects were in Top Gear in Lagos State. Till today BAT commands respect even among the new opposition.
What has the bus conductor of a governor given his people apart from stomach infrastructure that stripped them of their mandate.
Time will fail me to hit the cord on the numerous blunders of the frog eyed tout in Ekiti. But like I said, in days to come Nigerians will be shocked with the facts that will be exposed of our dear lousy governor.
Fayose should in the mean time chill and try to correct things that are still correctable.

Clearly the EFCC can freeze Fayose's Account(s), but they must first obtain a valid court order. I'm willing to believe the EFCC obtained a court order, if not, this is a witch hunt & must be condemned.

Even my son in junior secondary knows the idea behind the immunity clause but tell me something what exactly is Fayose doing in Ekiti that you feel legal proceedings will hamper? We will wait for him to enjoy his immunity impunity and then come and serve his jail term. Where in the world will a governor sponsor a death wish on pages of national newspaper in the name of immunity. Mention just one place in the world a governor goes to embarrass his president when been hosted by another country as it happened in China. He's doing all that and still got the nerve to do dirty deals with Ekiti funds.
And a lawyer as claimed by you come here to defend him just because his account was frozen. Were you alive when Fayose asked banks to leave Ekiti if they can't pay some illegal fee he charged them as conditions to operate in the state. Who cried foul then? Were you alive during the Ekiti election scandal, did you or not listen to confessional statement and recordings of one of the soldiers. You people will see film in days to come.

The enabling Act that set up the EFCC does not supercede the constitution. It is always subject to the Constitution of the Federal Republic.

Section 308 Sub.1(a). No civil or criminal proceedings shall be instituted or continued against a person to whom this section applies during his period of office; Proceedings here includes; Investigation, Prosecution et al.

FG and EFCC are completely at odd to this decision, they should have a rethink.
