Thank God we still have sensible criminal lawyers in Nigeria like Ozhekome and myself.

Why freeze his account when you can't prosecute him because of his immunity as a Governor?

Buhari's Government is setting a lot of very bad precedent and hardly follow the Rule of Law.

When will EFCC freeze Amaechi,Fashola and Fayemi's accounts or even investigate them?
Are there not numerous petitions against those ppl?
We're slowly sliding into a dictatorship where all opposition are viciously silenced.
point the fraudulent lodgement made into their account to efcc and their account will be frozen.

It amazes me how how people despite knowing next to nothing of the law still come here to type opposing and derogatory comments abt the action of a law abiding and rejuvenated agency like EFCC even after SANs are opined to such move. They shout witch hunt as if they got a dime of the loot been investigated

Hahaha, forget ozekhome. The guy himself knows he is turning the law upside down. He has to anyway, to place himself in a position to grab the brief from Fayose. The brief would probably fetch him nothing less than 100 million naira. Btw, get it clear: the supreme court has settled the issue - a governor may be investigated over a criminal allegation but cannot be prosecuted while in office. The freezing of fayose'a account is part of a criminal investigation to gather the evidence to prosecute him when he leaves office. The evidence being used against Saraki now at cct was partly gathered when the crook was in office as governor looting with reckless. abandon.

Those of us who think with our heads and not with our hearts still recognise witch-hunting when we see it.

Investigation ko vendetta ni.

Oklander:

Lol @ bolded!

So because he has immunity, he is free to carry out any shady deals?! You call yourself a sensible lawyer?!!! smh

It's an investigation, if found wanting, they can simply wait till his immunity expire and kick his ass to jail!

Baby lawyer, an account can be frozen for as long as necessary. No law specifies how long a suspected account may be frozen for.

If not frozen, how can it later be used as evidence after like five years?

We know Ozekhome to be a wailer and a PDP apologist anyway.

First they came for the Socialists, and I did not speak out—
Because I was not a Socialist.

Then they came for the Trade Unionists, and I did not speak out—
Because I was not a Trade Unionist.

Then they came for the Jews, and I did not speak out—
Because I was not a Jew.

Then they came for me—and there was no one left to speak for me.

~ Martin Niemöller

This saying is so true for the present stage of dictatorship we find ourselves now.

1) They rubbished Madueke without facts, we were silent.

2). They arrested Dasuki, we shrugged, na dem dem.

3). They shot at unarmed protesters we said it serves them right(why did they burn mosque)

4). They sent a bill to gag freedom of speech and we kept quiet.

5). They held Nnamdi Kanu against court orders, we kept quiet at least he's not my relative.

6). Now fayose

When they come for you, just remember your silence.

"In the End, we will remember not the words of our enemies but the silence of our friends"

kahal29:
Nigeria's anti-graft body the Economic and Financial Crimes Commission has opened up why the account of Buhari's fiery critic was frozen.

Although section 308 of the 1999 constitution gives immunity to serving governors, the EFCC spokesperson Mr. Wilson Uwujaren says such immunity does not stop a sitting governor from being investigated.

The EFCC says it decided to freeze Gov. Fayose account because it has sufficient evidence that some suspicious lodgments were traced to the account
His words: “It is true that we have frozen Governor Fayose’s account in connection with an ongoing investigation. We will soon release the details of our findings to the public.

“We froze the account because Fayose has no immunity against investigations.

“Let me clarify that the 1999 Constitution does not grant immunity to governors or public officers against investigation.

“The governors and others enjoying the immunity clause in Section 308 cannot be prosecuted. Therefore, Fayose cannot stop EFCC from doing its job.”

Asked if the amount in the Post No Bill ( PNB ) account was up to N1.3billion as being speculated, Uwujaren said: “Certainly, some amount was frozen in Fayose’s account but I cannot say the exact amount till tomorrow (today).”

A top official, who spoke in confidence, said: “It became necessary to freeze the account following clues on alleged suspicious lodgments.

“We will release the facts soon to Nigerians to appreciate the extent of our investigation.”

Governor Fayose has been having a running battle with the Federal Government over his anti-Buhari stance.

Recently, the governor was placed under security watch by the Federal Government and told point blank that he could not travel out of the country unless he seeks a clearance from the Department of State Security.

Many see this latest incident - freezing a sitting governor's account as one of the moves to muzzle the dissenting voices - a said pointer to the fact that Buhari is running a dictatorial government.
