Fayose did nothing wrong, but only stated fact, if she said he is lying let her travel to US and come back or sue fayose for defamation. After all it was what fayose saw that he said. His husband is currently being charged to court for forgery, which he prefer to higher SAN than to just #showushiscertificate, now they have forged another National I.D using a poor woman in the village who can not even afford N200,000. Who is that cow called Aisha Buhari to call an elected and sitting governor a mad dog. Aisha Buhari is a useless banza bakawai. A who.re in asso rock. It takes a rabid dog like Aisha Buhari to know a mad dog. Patience Ebele Jonathan took so much insults from Amechi and others for many years but she never called any one a dog or any other name like that. How long has that who.re called Aisha been in asso rock that she's already behaving like a rabid dog and has started barking up and down. Aisha Buhari the who.re was not brought up from a responsible home and is a colossal disgrace to the Nation as wife of President. 2 Likes |

Gbawe: Sorry Gbawe, if you think l come across as "arrogant". I AM NOT. I am simply stating my own opinion on the matter. Once again, apologies for your interpretation of my personality. No need for all those "name-calling" on your.own part! I never claimed to be "Nairaland Lawyer" and l dont know how you came about that conclusion?..... l never insulted you in anyway in my post... or did l? I am sure if l had answered you directly on my professional leanings, you will next ask me to paste a copy of my Graduateship & Law School Certs here! This is Nairaland, It can go on and on, if your intention is to "discredit someone' opinion" by attacking their credibility. Having explained that part, let us focus on the substance of your post and the authority you quoted Nigeria: Immunity, Defamation And Press Freedom On reading through, l noticed that this quote is also an OPINION of a legal body/individual. I am sure we can both distinguish between an "OPINION"..... and a "FACT OF LAW" (something stated expressly or back-up expressly by the wordings of the Constitution .... or by PRECEDENCE JUDGEMENT). I am also sure we both notice the "repeated use" of phrases like "Must be", "Yet to Evolve" in the expressed "opinion".... which are all FUTURE TENSES that shows these are what the legal entity making this submission ..... "hopes will be in place (in the constitution) , in the FUTURE" . Until the such amendments he/she is expecting to be made to the constitution is made, .... the Constitution still remains what it is. Grey Areas: The above Opinion of a legal expert DID NOT also state the "grey areas" you mentioned.... except if you mean that by disagreeing with or having a contrary opinion to "the position/wordings of the Constitution" on a matter, constitutes a "grey area". No, it doesn't Sir. In my own understanding, "grey areas" should mean where "The CONSTITUTION states "A" in one place... and then states the OPPOSITE "B" in another place such that "there seems to appear a CONFLICT in the wordings of the Constitution". Then, it is "grey" and needs further "legal interpretation" by the Supreme Court, being the highest court of the land The OPINION even went further to highlight what l said in one of my previous post that "the current Assembly will rather give themselves immunity as well, rather than amend/clarify the immunity clause in such a way it can create a pathway for erring "office holders" conferred with immunity, to still face legal consequences in their own personal right, while still enjoying the "official immunity". This is currently NOT the case. Now, to the issue of the Presidential office/ VP: The VP is a respected legal luminary no doubt and l dont want you to view my post as impugning on his credibility. Not in anyway. Permit me to use an "analogy" to explain what l am about to say, as it is more of a common sense explanation... (as against a legal one ) Now, a SAN Lawyer is someone who is also versed in the Law, both experience and qualification-wise. You and l will expect that someone with a SAN knows the Law in-and-out and can differentiate when something is lawful or not. With the above in mind, ......In case of litigation, how do you explain a situation where both "opposing sides of the argument" are represented by a few SAN's, both claiming to be RIGHT and CORRECT at the same time? 1.) It is either one of the SAN's (one side of the argument) dont know what they are saying (the true position of the law on the matter) but that would be preposterous, for us to even think, knowing who/what a SAN is ... or 2.) One of the side's SAN's is just "arguing and hoping" they can pull a wool over the eyes of the law while just trying to "serve their side of the argument". Basically, what l am inferring from this example, is that "the much respected V.P, a Prof of Law, knows the truth but is just "serving his side of the argument". Lawyers do this all the time! Until they now go forward to institute a legal case (based on their position).... AND WIN SUCH CASE IN COURT, ..... ....until then, they are simply "feeding the public" with their personal opinion. I dont expect the VP to come out in support of Fayose and affirm publicly that the Constitution actually gave him a "Carte Blanche" to be criminally rascally! Sit back and think about it for a moment. In doing so, bear it in mind that Lawyers "prove (argue) and win" a case in court not by expressing their "opinion" but by citing/quoting the relevant section of the Law which backs their argument. For now, Section 308 of the CONSTITUTION backs my argument that Fayose cannot be successfully prosecuted (civilly or criminally) while occupying the office of a State Governor. BTW: I agree that Immunity SHOULD NOT shield any Public office holder from verbal recklessness, the type Fayose has engaged-in, over and over again. Have a good day. Lastpage! 1 Like 1 Share |

iamdstar: I read the article and some paragrapgh, which l quote below, is worth "examining" for CLUES! As indicated by the New York Times story, “she (Aisha Buhari) told him that her father was the former military ruler of Nigeria, Gen. Muhammadu Buhari, and that her American friends included politicians like Mr. Jefferson of Louisiana.” From the above, it is clear that much of the evidence linking Buhari name to the crime, is provided by the former Akwa Ibom Governor. He is what we call a Principal Witness. Now, only scrutinising his deposition, one would notice that: *He knows the accused very well, in person *He has repeatedly referred to the accused person as DAUGHTER of Buhari *He has repeatedly alluded to the relationship between the accused and our current President as that of FATHER and DAUGHTER. It is my own conviction that, based on the provided witness depositions (FACTS, which evidence the Court has found reliable and relied upon), the relationship between the current President and the accused lady "Aisha" Buhari, is that of "Father and Daughter". The lady that Fayose is currently accusing of being the "accused person" in the scandal, has a relationship of "HUSBAND and WIFE" with President Buhari... going over 30yrs and predating the scandal (which was between 2001 AND 2005) Based on these FACTS (as against opinions), the President's wife cannot be the accused person, who was his daughter (adopted or biological) as shown in the witness depositions. FAYOSE missed this one, except he can provide incontrovertible proof, that both are one and the same person. As of this moment, he has not done that. "the LAW is about EVIDENCE".....put before the Court". Gbawe, what is your take? Lastpage! 1 Like |

Well for me I just want this country rid of our corrupt leaders and it should be done soonest. Meanwhile can you please tell me your take on this issue of the legislatures asking for immunity for their leaders just like the executive arm of the govt are enjoying? |
Re: Aisha Buhari Calls Fayose A Mad Dog; Nigerians On Twitter React by lastpage: 7:50pm On Jun 22, 2016 |
iamdstar: Sir, I share the bolded sentiments with you, in its entirety. Based on the principle of Separation of Powers, each arm of Government should be independent and able to discharge it duties without fear or favor from another arm of Govt. Such fear would arise from issues of threat to "starve them of fund" (Executive => Judiciary and legislature), prosecute them (Executive => Legislature), with-hold the passing of financial legislation to run the Govt (legislature => Executive), Unfounded threat of impeachment (legislature => Executive) e.t.c Immunity is a PROTECTION from Prosecution, while occupying a designated office. But as has been identified above, such Immunity has to be assumed with a sound character, responsible personality and not abused to commit and act with impunity! fayose is a good example of the latter parts! On the Legislature, we should ask ourselves: Why do they need Immunity? What level of "protection" do they currently have? and finally? What is their antecedents, that makes them a candidate for such immunity? On a general note, everyone who occupies a Public office cannot enjoy immunity from prosecution because it is a very powerful constitutional protection! 1.) the legislature already enjoys "financial immunity" such that whether salary are not paid or Nigeria earns only ten Naira in a financial year, their own ALLOCATION from the Nation's purse is guaranteed! Yes, they would get their MONEY if me and you cannot be paid for work done to the public service, whether Hospitals cant buy Oxygen to attend to surgery patients, whether teachers cant get salary, e.t.c This is explained a few months back when the Senate President, Bukola Saraki bought close to 50 Vehicles (cant remember the exact number now) at #36Million Naira each, as GIFT for his fellow Senators who followed him to the CCT tribunal ..... in a country that was so broke that majority of States were going abroad to borrow money to pay backlog of salaries to public servants! He claimed that money was the money left from the previous years Budget..... but one might ask if unspent Budget are not supposed to be returned to the nations treasury and used judiciously? The Executive Arm of Govt could have seized the money but then, the NASS money is under IMMUNITY! Again, we know that a lot of our former Governors simply "transformed to Senators" by brazen rigging and using state funds to buy elections! Question is why would someone who has governed a State for 8years, seek to become a Senator (Not even a Minister?) The answer lies in the "partial protection" they enjoy (a sort of mini-immunity) as Senators! Our own Senators want to use the Senate to "protect their criminality"..... as opposed to use it to make laws that better the citizens and protect the weak! Thieves and treasury looters clamour to become Senators just so they can be shielded from their past crimes! If the Govt agency tries to prosecute a former Governor (now Senator) who has looted his state's treasury (like most ex-Governors).. he will simply brandish the "they want to muzzle Legislative Arm of Govt Card"... so his mates can rally around him! You know their is "protection/honor between thieves"! Many Governors who are now Senators have killed people or organised assassinations of their political opponent! Remember Bola Ige was the nations Attorney General when he was murdered in his bedroom? Now, imagine if such people are given constitutional immunity from ALL PROSECUTIONS, like the Governors! It would be MAYHEM on earth! Finally, the 'reason detre' behind giving Federal and state Executives "immunity' was to prevent them from being subjected to frivolous, legal distractions which would prevent them from adequately discharging their responsibility to the Public (everyone will sue the President or Governor, if they can!) It was not construed to be used as an instrument of oppression or abuse of office or to commit and cover-up crimes!... which is what it is mostly being used for, by some of those enjoying it now, despite their number being limited. I have predicted before now that the first thing Fayose will do just before his immunity expires, is to become a Senator! he wants to shield himself form answering for whatever crime he has been accused of! So, if you give Senators immunity, Senators who by their antecedents have shown that they dont err on the side of the Citizens? Senators who blatantly increase their own Salaries and Allowances when the same Govt is asking the citizens to "tighten and already tight belt"? Senators who are known to collect Bribes and pervert the course of Justice? Senators who collect salaries for doing virtually NOTHING, some dont even attend sessions and only do so when there is money to be shared? Senators who cannot purge the criminals amongst themselves? My point is you dont accrue such "absolute power" to irresponsible and very selfish people! Everyone accused of a crime should be willing to go to the court to prove their innocence and defend their integrity. Even sue for Libel/Defamation/Character assassination. No one should be able to say "I dont want to be charged o court", in the absolute sense..... Not even the President (though he gets "impeachment" on his neck, to checkmate him, something Senators dont get)! I would rather Judges have immunity (and they also do to a little extent, in their own Court..... and the Judicial Council is also a disciplinary body for them..... whereas there is nothing like that to discipline Senators!) As of now, only the Legislative arm of Govt (out of the three Arms) does not have a "check and balance" body to discipline them! They cant even be recalled by their constituency or removed when they "jump ship" after being elected on the platform of a political party. Its this bad already! Do you also remember the Senator Farouk Lawan-Gate scandal? was he prosecuted or disciplined in anyway? NO! Now, imagine adding immunity to the protection of such criminals! Infact, if you ask me, l would suggest that the Senate be abolished "as it is" now, turned to a "part-time" body (where they are paid only a stipend as sitting allowance and can do their daily jobs elsewhere) while making laws for the country. There is too much "money and power" attached to these political offices, that is why it has become a do-or-die affair and Criminals are attracted to it ......more than intelligent, patriotic people! The IMMUNITY thing should even be restricted to the President alone and the V.P should only have it when they are acting in capacity as President Forget giving it to Senators. That should NEVER happen! The above is my opinion. Thank you. Lastpage! PS: I was writng this while watching 2016 Euro Championships at the same time, so the idea might be disjointed a bit. forgive me. |
