Read section C carefully. What is wrong in arresting a corrupt judge it's only in Nigeria that when a rich man is arrested or prosecuted for corruption, there will be coax in the air! When many innocent citizens are arrested and sent to jail for no reason because of this corrupt folks daily & nobody cares.. What is their difference with a common man Bribery is bribery, evidence is evidence (whether legally or illegally acquired). They should face the rot of the law & lets face the truth. Judiciary of corruption,Alarm has blown the cleansing has started in that segment of our democratic System..let the shakings continues..cases that are kept in waiting for years now due to corruption will receive speedy attention and justice. Nigeria must be sanitised at all cost & by all means..if this is what Buhari Achieves in his four years tenure the average Nigerians will appreciate him. Men,we can't continue to perpetrate corruption under the pretence of democracy . When those who ought to protect & defend our rights sell out their souls to corruption how can we have a orderly society. Let there be justice in the land & everybody will sit up. The DSS got it wrong because: 1) Search Warrants are executed between 6:00 AM and 6:00 PM except on weekends. 2) Search Warrants are valid only if issued by a court of competent jurisdiction. 3) Search Warrants obtained in one State of Nigeria cannot be executed in another State excepted it is endorsed by a Magistrate or Judge equal in rank to the one that issued the Warrant. 4) Search warrants are usually executed in the presence of witness(es). 5) Only two or three agencies in Nigeria are charged with the investigation of corruption cases namely the EFCC, the ICPC and the Nigeria Police. 6) Politically Exposed Persons (PEPs) and VIPs who do not constitute a flight risk are usually invited to appear before investigation Agencies. 7) The National Judicial Commission (NJC) is the only body empowered to sanction Judges and Justices found wanting in the discharge of their duties. The Judges in question have issued unfavourable judgements against the arresting Agency in the past; thus, casting aspersions on the motive for their arrest. ISSUES FOR DETERMINATION 1) Did the arresting Agency actually procure an Arrest Warrant from a Court of competent jurisdiction? 2) Did the arresting Agency adhere to the rules governing the procurement and execution of a Search Warrant? 3) Did the arresting Agency exhaust the option of extending an invitation to the suspects before procuring the Arrest Warrant? 4) Did the arrested suspects at any time pose the risk of taking to flight? 5) Does the arresting Agency not have people at all the land, sea and air borders to prevent an escape of the suspects? 6) Did the arresting Agency at any time write a letter to the National Judicial Commission (NJC) highlighting the offences committed by the suspects and demanding their release for an interview? Any person (even the government) can set up another person by planting money or gun at strategic location to achieve the intended aim. It is the above flaws that responsible members of the society wants to prevent. |

kingmoses1:No. 1 is false, i checked google and search wareant can be executed anytime of the day both on public holidays. I dont know much about law but i want to use my logic to guess if i have illigal 2million dollars in my house and i am invited by the police to ask if i have the money or not. Wont i go back home and quickly dispose of the money? Going by logic your number 6 is wrong No. 4 is also false, if the is evidence stating a kidnaped victim is being held in a house, wont it be stupid of the Police to wait for the suspect to come back home before seaeching his house? Besides i recently concluded 3 seasons of (How to get Away with murder) and on several occasions seaech warrants were executed without the suspect presence. The DSS as already released a statement that due process was followed in arresting the suspects, so i dont understand what all this noise is about I believe we should channel our energy into fighting for defenceless Nigerians languishing in prisons accross the country because the judiciary failed to give them justice. 2 Likes |
