Most of those rubbishing him, i laff at your ignorance. Use google. look uo the law of the internet and see whether or not he has a right to sue and if at all , his course is actionable. He should also sue the bank's isp provider for contributory negligence. When u=you make an offer to the public that you advertising your professionalism, an another relies on it to make a decision, you are liable. Much more when you deliberately or compulsorily compel them physically and psychologically to do an act that will benefit you, should he suffer any loss due to a failure on your part, you are liable. Does he have action very well, yes. Has he fulfilled condition precedent before rushing to court? That i cant say. If he is a smart lawyer, he is sure to win. He should have added exemplary damages, so that charity organisations could benefit. Hope one day i will be the one filing such an action. Na common letter mine dey end. |

access bank did the same thing to my room mate when I was an undergraduate. she kept going to the bank to beg them to reverse her 10,000 (it was money for her feeding and other expenses then in school) until she got tired and left them with God. |

Until you have used your card three times you shouldn't be charged #65 but what did fcmb do for me yesterday I was debited twice yesterday for withdrawing just 17000 naira, they purposesly made sure their machine won't pay above 10000 naira so I have to withdraw twice then I only made use of the card twice and was debited twice. Isn't that a fraud? The same thing that has made politicaians to plunge us into this present serious situation. Sue them let them keep paying damages to serve as deterrent to others 5 Likes |

This is a step in the right direction. Not everyone will sit down in the comfort of there home and wait for miracle that will change the postures of our banks. I give kudos to this lawyer, either he's hungry or not, that is not the bone of contention. Look at CBN , doing nothing as banks went on rampage by fixing indiscriminate rate for online purchases. fxskye: They are joking and they know it. they wanna rely on the fact that parties are bound by the terms of their contract, and in the alternative, create a pool of funds like an insurance stuff be psychologically conditioning their customers to believe that they, the banks, are acting in their best interest. Another way to steal money, and also indemnify few a cases sure as the aforementioned that may not go in their favour. Just imagine, they decide to deduct N120 naira only from each of their customers account and lets assume of their about 8 million customers, they deduct 120 naira from about 6,000,000 customers ( **not actual figures), that will be about N 720,000,000 ( Seven hundred and twenty million naira) monthly. In a year that will be about N 8,640,000,000( 8.64 Billion naira annually). So who wins? the CUSTOMER OR THE BANK? They capitalize on the ignorance of the majority to have a filled day. More or less day light robbery for what is originally their EXCLUSIVE duty to provide. For any money in your bank account, is considered a loan to the bank. Meaning the bank is your debtor and your debtor can not allege that it was, or is your fault that the money you loaned him/her is missing when it is their duty to ensure the money is safe at all material time, till you officially request for it and the teller or records being kept by the bank of which you are entitled to a copy, is invariably akin to you signing a deed of release acknowledging that the bank has paid you either all or part of what they owe you. Sylva2147: I don't think you understand the process involves, when such hapen, first is to report to the security, to come and validate your claims, then you go too the bank to complain, and obtain a note from Dem as some case maybe as well as fill some forms, then you go to your bank who den contact access to varicy you position then refund you, the processes of external ATM withdrawal is like loan or credits, wich at the ends of bizness is remit into the external banks acct by the internal bank, I.E at the end of bis, diamond bank will credit access bank and debit his account, hence the note and contact from the two banks to refund his money hope you get me here 1 Like |

My money has been held back too and I have gone to the bank several times, they are yet to reverse it and here are you people thinking they should not be sued.
