Ownership of land in Nigeria is vested in the government. That is why when you buy a land you apply for the C of O which gives you tenancy.

According to the 1978 land use act, all land has been bestowed on the government to hold in trust for, and to be administered for the benefit of all Nigerian people. The governor of the state allocates land in all urban areas for residential, commercial, agricultural, recreational or other purposes. An individual can have free-hold or lease-hold ownership of property; and free-hold ownership (which is supposed to give access in perpetuity) only gives you access for a period of 99yrs, after which your certificate of occupancy would have to be renewed. It is not an automatic process, therefore, revocation is also possible.

A state governor can revoke an individual's right of occupancy even within a valid tenure, if there are benefits to be derived from the property that are in greater public interest. in such cases, compensations are made.

When una go dey do runs to pass SSCE how god no go own land? Go read your books or ask a serious secondary school student undecided

The Land Tenure System in Nigeria is such that the State Government owns the land and you are leasing it for a period of 99years. Also anything below the land (like Minerals and Crude oil etc) belongs to the federal government with the exception of natural resources that can be found on the surface (e.g Limestone). This happened a while back. I think I was in Primary five at the time. My dad told me of how we used to own the property behind our house; demarcated by a fence. I remember wondering how exactly a person can own something and then not own it anymore. I asked if he had sold it to someone else. This was the only logical reason I could come up with. He said he hadn’t but that the property was just taken from us. This got me thinking about how exactly property is owned in Nigeria. Precisely, what do you have to do to fully own property (land as it is popularly known) in Nigeria? In fact, can you fully own property in Nigeria? When there are issues pertaining to ownership of property in Nigeria, how are they resolved? What steps do you take?

Oga Op, according to the Land Use Act of 1978...all land belongs to the FG...inclusive of those family land people lay claim to. Families are just custodian of the land.

My pops bought his land for 512,000 naira in 2001 now it's worth 40m

There was another one he had the opportunity to buy about 1500 dollars in the 80s which he didn't buy, now it's worth over 100m

The government in a working economy.

If only Nigeria's government could make it known through laws that every land bare or built on is government property. It can only be leased with a maximum of 15 years, and based on size, it can go up to ten fold in taxes after that 10years maximum of lower annual land tax.

We need to start taking bold steps now suchas land reform, and we need to build high from now on, things like if you built

Have your record copy of the survey plan and apply for your certificate of occupancy. Those will back you up at the Law court if there is any issue.

I guess it's either your ancestors were broke hence they couldn't buy land from those communities at that time or they were lazy hence they couldn't go into virgin areas to take land for themselves and future generations. grin grin

According to the land use act of 1978, all lands belong to the Federal Government but the power to act over it is vested in the State government.

So all claims of onwership come from the State government. In Lagos, I don't know if this is applicable elsewhere, lands for development are first gazzeted meaning they are published in Government records for public use. Although most lands already belong to certain families before the enactment of the act, they require a governor consent to claim legal ownership. There after you obtain a certificate of occupancy I think.

But I've read some where that you don't actually buy land, it's just rented out to you for 99 years.
