Thanks Lexusgs430. hmmm there's a group on FB ...I love my foreign spouse, that said someone got a refusal for a case similar to mine. Is it possible we annul the previous marriage and do another one again? I no get 2050 dollars to dash this people again o! Pls kindly advise. TIA.

You right on the group I saw it too. The turkish lady was denied visa because they got married before the divorce was completed even after the divorce papers she was denied .
She had to do another marriage its best you just do another one to be save cos wasting that money and time (emotionally draining) can be painful.
Unless you wanna try ur luck you might be lucky if you want to.

His previous marriage is legally dissolved. You would not have a choice, than to apply with what you have got.
You are safe to apply for a spousal visa. The date on decree nisi, precedes the marriage.
Just ensure all your application documents checks out and are in date...... Remember the '28 day rule'......

Hello Everyone! I have been reading for sometime now and I have learned a lot. I and my husband made a spouse visa application about 15 months ago which was rejected and we appealed. We only just won our appeal about a week ago after it got to the tribunal. The judge allowed the appeal on the grounds of human rights seeing as we have a 2 year old daughter who is British and has never been to the uk.

My question now is how long does it take from when your appeal is allowed till when u get your visa? Would I have to send my passport to Sheffield? What is the procedure?

Please Justwise and all the gurus in the house, would really appreciate any help given at this time.

Thank you

Got the email to submit my passport today after paying for IHS. My husband and I are beyond excited. Hoping the wait from here on is not too long.

Thanks for the response Lexusgs430. However I had previously applied with that same marriage certificate as we did not know that the it was the decree absolute that was the valid divorce certificate. Now I'm scared that they may have some of my info on their data base and if i just present another marriage certificate, it may seem fraudulent. That is why I wanted to see if annulling the first marriage and doing another one will be more in line and acceptable. What do you think about the that?TIA. quote author=Lexusgs430 post=61300388]

The main reason that marriage might be deemed Illegal, is simply because when the marriage was conducted, also was the act of bigamy....

Bigamy is not recognised under British law, hence an illegal act....

Madam abeg, just conduct another registry marriage.....
@MrsElendu please I will be grateful to know the reason for your spousal visa application refusal. I submitted my application September 27th.
@joygirl2017 @lexusgs430 please I need to know if there are any chances of refusal if a dependent applicant is handicapped. I applied with my 4 years old daughter and I stated that she is unable to walk and on therapy since 2014 due to a medical condition. Please your insights in this issue is needed. Thank you

Now the veil is slightly coming off. If you had used the marriage certificate before, that record would still be on the database....

What was the outcome of that application?

Best to annul that marriage and add a note in the special section (failure to declare would also deem fraudulent).....

The outcome of that application was a refusal based on the marriage thing and they asked for 12 months pay slips? I could post a copy of the refusal. Thanks for the advise.

Meanwhile what is the 28 days rule?

Your financial documentations must be valid, up to 28 days prior to submission.....

If you submit your financial details in October 2017, the last pay slip & bank statement must be from September 2017......

Thanks for your response. I'm entitled to spousal visa because my Hubby is a British citizen and one of my 2 kids is a British citizen too. The one I applied with is not and she has health condition that i explained in the application we submitted. Is there any issues about health that might work against us getting a positive response from HO?

The HO would not expect you to migrate to the UK, leaving your child behind......
You have done the best thing, been upfront and honest about the child's medical needs...
Once you arrive the UK, simply register child at your local GP and start seeking all medical needs the child deserves (you already made an NHS payment).....

Submitted online application for myself and 3 kids and did biometrics in August. Documents received in Sheffield September 8th.(2days sallah delayed)
Hubby refused us paying for priority cos the cost was over 1M and the guarantee of exactly 1 month decision is not there.
Hubby and last baby are citizens and with my savings and hubbys salary, we exceeded the financial requirement.

Every other docs required was submitted, na God hands e dey now and I know He won't fail. We 've been apart for too long.
