Taking him to court now may close your chances of getting your money back cuz with a good lawyer he can deny ever being in any agreement with you in the first place or may get a bail option and your money gone.

The best thing here is to trick him into signing an agreement with you to pay in a due time ,police can help you do that if they really want to get justice for you then if he doesn't pay u can take him to court with the agreement he had with you in written form ,that's the best way to get your money .

Mind you court deals with evidence and not facts !

Op look for any of his properties dat worth d money, then sell and recover ur money period. Even if it Means getting hold of his other clients car dat he used ur money in bailing.

Hello Nairalanders,

I need serious advice on how to recover my money ASAP.

I was defrauded about 1.5 million by a clearing agent and I reported the case to the police, the police collected all together about 100K from me to trace and track down the criminal who was proving smart and trying to be elusive. Eventually he was caught.

He was asked what he did with the money and to provide the money and he started giving stupid excuses that he has used my money to clear someone else's car and sort out some other problems he had. Can you imagine?

He has been in police detention for 2 days and no family member has come except his brother. No one is talking about how to refund my money, all they are doing is begging.

I have been lamenting to the police to handle the case more seriously so that the criminal would provide the money, but they have been so lenient and very lackadaisical in handling this case.

I am confused right now.

Christmas is coming and my family would need that money to survive.

The criminal must have kept the money somewhere, why not provide it

Get a lawyer to advice you and take proactive actions.... the police are going to collect bribe from him also. Collecting 100k was a bribe to the police, and I wish you have a secret recording (video and audio) of you saying that the police asked you for money so that you can also report them to the Police PCRRU.

One thing is certain, if you are NOT proactive, he would go free with your N1.6 million... police are only interested in bribe.

The case bothers on fraud and advanced fee fraud (419) so make sure you get a lawyer to sit on the case for you.

Menh,..before going to court remember that court deals on evidence,..if there was no witness to the transaction you made with him then be ready to hear the magistrate ask you to provide a fine of #500k for impersonification,..forced arrest bla bla bla,...am not a counsel anyway to say the least
......so going to court means you have evidence to nail him,..don't count on what he told police,..he can say he said those by force
.....the best thing to do is to kneel down before your creator,...prayyyyyy oooooooh fast oooooh,...21 days fasting with hard prayers....because the enemy fighting you is not the man but the demon sent to torment you by your village people.....come and thank me later when God surprises you Bro.....goodluck

In as much as it is a civil case and not a criminal offence, it will be very difficult to recoup you fund back. Because the government will only tell him to pay you at his own pace, which can be lengthy.

Secondly, if you do not have any official evidence of payment to him, Bros just follow the guy jejeje dey collect the money at his own pace.

Finally if you have evidence or witness or if he is not denying receiving the money then;

1. make him sign something a sort of IOU
2 The signed agreement should include date of repayment
3. finally the signed document should also include a penalty if payment not completed on the exact date
4. If possible allow him fix the date of payment himself so as to exempt himself from any excuses.

Do u know any top police officer or soldier let them step in and takeover the case they will either lock the guy till he pays every cent or after he pays half he will be released to look for how to pay the remaining. Also they shud check all his accounts with d banks and if he has such money there he has to pay up.

The problem is if he actually doesn't hv any money at all now then sadly theres nothing u can do than wait for him to hv it or sm1 pays it for him. If he has properties valued at the Amount owed u can also sieze them till he pays.

How long was did it take from wen u paid him till he was caught?

that is a bad idea too, I've seen similar case where a debtor was held for 21days at SARS because of 2million naira, he was released immediately his family got a lawyer, and even sue them because the victim as been tortured in custody,so to me, going to sars is too much wat if d debtor dies in sars custody due to the way they will handle him in sars? Think well

You need to get a post dated Cheque from him so that when he defaults on the Agreed repayment date, then you will be talking about jail term for him or maybe he will now be the one at your mercy. Go to efcc they can do a better job than the police

I dont think the money is gone. For you to have given him 1.2m, it means tou think he can do the job. Definitely he would have assets or cash in bank to offest the loan. Although when all those assets of his are sold to transformed to cash, it might not cover you 1.2m naira but at all at all na him bad.

I would advise to make proper findings on his assets eg cars, land, machines, cash in bank etc. At least try to get 75% of your money if all is impossible to get.

bro lemme quickly advise you...Be ready or rest assured that you won't get the actual amount back...Sorry...But to get something at all...U need asap as a matter of urgency try to get a higher authority or seek military intervention though you will drop a motivation popularly called egunje..

Because Nigerian police follows highest bidder they careless about how poor or hungry or u are in need of ur money...Just follow my advice and may God help you...A couple duped me of the same amount since 5yrs now...The luck they have now is i don't have their time yet...The unfortunate thing for them is,they are better of dead..Because they will surely pay it one way or the other.

By the way did i mention u shud be prayerful? Because 75%of our population in as much as they die proving how religious they are..We are the most diabolic dependent race on the face of the earth...

The guys who duped me even started doing shit diabolic things...I'm sure this ur debtor now has started making calls and sending people on errands with ur names to suppress you.

Personally am very paitent when it come to wicked pple like this let him go but leave d case open in d next 6 to 7months go back to his shop with police and some guys pack any and everything u see with him/on him and even in his house.

If you are clean take the case to court
If you are not then make him sign an agreement on how to pay with a surety.
Or better still Use the military if you know any officer.

He defrauded u 1.5m and claiming he doesn't hv money anymore is a fat lie. He needs to sleep in the cell very well trust me he will get his senses back and get the money or call sm1 to repay for him. Better don't be soft unless u wat to forget about the money. Discuss the case with a senior police officer(even if its from anoda district or state)not just those hungry junior ones cos he may even be using ur money to try and settle them so they 4get the case and tell u he doesn't have money and dat u shud pity him bt if u involve their oga dey wont have any choice thAn to make sure its resolved.

Don't completely think he still has the money, that money may most likely have been completely spent.
But you now need to investigate if he has properties/assets that you can lay hands on and since this is a financial crime, you can involve the EFCC.
Through his BVN you can also know if he has money in any Nigerian Bank.
If you go to court and he gets bail, it will definitely be with a surety and other conditions which you can hold on to. the only challenge with the court process is TIME.

This case is not even police case. It should have been reported to EFCC. Because it is financial crime

Op contact me, I know a few guys who can get you back your money, they are sort of like repo men.

Am sorry to say but court cases are shit. The lawyers will just delay so that they will make money off you. The police don't care they see worse cases everyday. This isn't the Guy's first time on jail, he knows nothing will happen.

If you want your money back get a repo man.

For d accused to be detained in police custody for more than two days is an unlawful detention. Sue him to court Imidiatly & wait patiently in wat eva decision by d judge. U will get back ur money in due time & pray over it.
