Hmmm.... my landlord na lawyer and just dey bully other tenants. Now na my turn and when he called me, na vex he take drop phone cos our discussion HOT. I paid towards the end of November last year. Light renovation was to take place in my apartment meaning I'll park in in about 2 weeks. Agent kon kukuma move my rent to Jan 1st. Landlord has been sending me messages to renew my rent and the messages usually come as threats. I just discarded them till he called me last month demanding renewal of my rent. I told him my rent was due by Jan 1st. He argued, threatened to throw me out buh I no send am. Na so he use vex cut. Called his agent and that one told him what was written in my receipt. Now Dec don reash and the man don start work again. He sends me bout 5 threat messages everyday (check the attached pictures) reminding me of my rent. I can afford to pay the rent but I don't plan to renew cos I wanna relocate due to work. Buh na by January ending my money go reash due to the kind of apartment I intend getting and yearly allowances being paid.

Question: How do I tackle this landlord come Jan

Nairalanders, make una epp me biko.

Good morning house, am having similar issues. last year September I paid for a year rent to my landlord and he promise to renovate the apartment but he didn't, due to urgent need I move in like that around October I was able to repair some of the bad roof with my money..now my rent is due this October and he is asking me to renew the rent , he need money to pay her landlady and am not ready to renew any rent cause by january ending I want to move out. So Pls advice me on what to do. Should I tell him am not renewing the rent again or what. Av seen like 20miss calls from him. Pls it ugent.
I will advice every tenant to work out his/her expiration towards second quarter (of the year). But for your own case, I must tell you reach out to your Landlord, and explain to him why you may wish not to renew, No Landlord/Property Manager would be happy if you do not pre-inform them of your plans to relocate. However, it is pertinent to note that some Landlords will frustrate your efforts to relocate (including diabolically) if you pre-inform them.. That is why you must be ready to part with some money when the time comes (dts if u wish to keep it to yourself). For cities like Ph, one needs to be very careful as d Property Laws are skewed in favour of the Landlords.

First of all, dz text messages are not threats but just reminders that you should renew your rent failure of which, he would take necessary steps to evict you (through the magistrate court of course). Second, if your rent started counting in January, it therefore means ur rent will expire on 31st December 2017 coz Dtz exactly 1 year. u should try to move out of the apartment b4 the expiration of your rent in order to avoid embarrassment when the court eventually comes to throw ur belongings out. (that is of course after he must have served you with the requisite notices and summons) #Peace.

This advice, along with the other advice to negotiate with the landlord for a pro-rated rent of one month for the period of January, are the best responses to the OP I've seen so far. Because they're guided within the law.

Wisdom is profitable to direct, and he who has ears, let him hear.

The landlord as I see it, is simply playing within the provisions of the law by serving formal reminder notices ahead of time because by the expected expiration date, tenant isn't expected to have any extra day in his property for free and can't claim that he hasn't been adequately reminded. Being a lawyer doesn't mean that he'll bully his tenants anyhow because they can easily find a counsel to represent their interests. Even if the tenant could not afford legal services, they could be lucky to have their case handled as pro-bono. And if the landlord were to be in violation of any laws, his position as a landlord and his practice as a lawyer would be disgraced.

@OP, ask a lawyer friend of yours to draft him a letter and tell him that he is in violation of the Lagos tenancy act which gives you the right to enjoy your tenancy without disturbance. That he is directed to stop all harassment forthwith and should use lawful means to recover his premises if he decides that he doesn't want you as a tenant.

When January reaches, you become a tenant at will and have 14 days to move out (once he serves you notice). Then move out. Chikena.

Obviously an expert. Best advice so far.

(Except the lawyer friend part. Why "friend"wink

Be listening to ur fellow wicked brothers. Why can't u just tell him ur moving out January ending and then pay him for 1 month? That's the normal thing to do, so he can plan for renovation and advertise the flat.
Your tenament period is clearly stated on ur rent agreement (I'm sure d lawyer gave you one). So stop acting like its ambiguous. Its very wicked to NOT tell him ur leaving.

U people always look for a way to cheat people. I've seen too many Igbo pple do this rent avoidance thing. Even my colleagues at work, and they'll be feigning fake anger like you (cos d landlord refused to be cheated on top his own property) & then laugh abt it like an achievement.
Normal pple don't do this. Tufiakwa!

If you had informed the landlord that you will do the repairs with your own money, then you need to furnish him with the receipts of every expenses including the labor (be honest in the receipts and avoid bloated amounts, landlords still know the costs of materials and labor and can verify).
Then ask him to allow you stay for the pro-rated period of time that the amount you spent on the expenses covers. Since you have intentions to move out. You can also get help from a lawyer if you have any Grey areas

Your case is not similar. As of October, your rent has expired. If your landlord is mean, he can move against you this December and have you thrown out by January. As of now, he only need 7 days notice from the court before commencing proceedings.
Moreover did you tell him that you will be using your own money to repair? Cos if you don't, and he didn't ask you to, you shouldn't be expecting a thank you.
if someone rent is expiring by dec 31st , wat can d landlord do to evict d tenant if he is unable to pay d rent n also bearing in mind dat there was no signed agreement for him to move out within a month if he is unable to pay rent

If there is no signed agreement, the landlord will give a 6 month notice to quit if it is a Yearly tenant, Three months notice to quit for a half yearly tenant and a month notice to quit for monthly tenant.
But if by 31st December your rent elapse, and you continue staying without paying, then you become a tenant at will. And that means officially you cease being the lawful tenant of the landlord. And he can proceed to court and serve you 7 days notice of intent to recover property. After the seven days, he will then serve you papers in court and the court will take it up from there.
But you can go to him and reason things out before that 31st December

Seek advice from a competent property lawyer, you have a good case. Your best bet is to treat him legally, since he his a lawyer.
He is going to lose the case!It started counting from the day he made the payment
He shouldn’t have make the payment until the renovation is completed
There are lot of silly tenants out there, they would pay the landlord but won’t move in until they have money to buy furnitures,Later they would come back to tell you the money started the day they packed in
It’s a curse if you have money but refuse to pay your landlord he built the house with his sweat

Some landlord are funny and wicked some times but many tenants are stupid.
That money they pay to landlord seem to pain them to their bone marrow as if they want to live freely in another man's investment.

What stops you from being diplomatic and talk to the landlord with respect knowing that he is your host for the moment other than this arrogance of yours.

He is human and if approached with the proper language and in proper way he must yield.

We all dream to have ours someday or you may have yours somewhere but you don't move with house like tortoise.

Remember whatever you do to someone, same shall be done unto you. That is Karma for you.

Meanwhile,I'm a tenant somewhere too so don't misunderstand me.
Exactly my brother....some people just like to be foolishly arrogant. Even the holy book says wisdom is profitable to direct.....i have stayed in a compound where the landlord was adjudged to be wicked by other tenants, but I discovered that he was actually one of the most understanding and kind person I have ever met. Even after I parked from the house and relocated (due to wrk) he still sent me 50k during my wedding...Anytime I come to that town I am free to sleep in his house and eat free food. Life is about give and take and sometimes what you need to give is just simple respect or courtesy and what you get in return is very huge....

The message is not a threat but a notice. You should have replied him telling him you are aware of when the rent is expiring and you want to pay for a month if he can't spare you till the end of January. Be a gentleman.

Read Lagos state landlord and tenancy act..where it stipulated rentage and validatn..the law does nt favour any landlord when it comes to duration.Mind you l'm once a tenant, that once had and issues of payment with a lawyer landlord who took me to court..we spent a whole year on adjourment b4 hearing and 5 month on trial,l was ask to choosed when to leave..l gave them 4 month..and packed to my present home ..l treat my tenant like my self..l hv gone through it.do nt implore unnecessary fear.

To my mind, you should meet him and discuss with him and be very polite as much as possible. He'll definitely allow reason to guide him. On the issue of renovation, next time if you want to carry out any form of renovation whatsoever on someone's property, ensure there is a written and duly signed agreement. #Selah

This case is different, why did the landlord collect rent on an apartment first before completing works inside it.Some house owners are fund of that too.Its simple,he should honour the agreement recorded in the receipt issued to the guy and wait till January

As a young landlord who never for a second gave my landlord/landlady any problem while I was a tenant iwwill advise you don't give the man headache in his house.

Don't ignore him like some suggested. Be an adult. Call him and explain things to him that you'll be moving by month end
