Giving it back is not the issue, giving it back at a loss is the issue.

Any serious sales entity should be able to give a full refund less fees for paperwork within 5 days /500 miles. But has to be something serious like what OP described. Steering swap is a biggie.

I feel bad for the OP and I’m using this as a learning tool from a customer service perspective.

Yes, our leaders are scientifically corrupt but I fear the average citizen more. Most are spectacularly gifted in defrauding fellow citizens.

I totally agree with u, and this type of loss is terrifying. its too much to bear! @ that price I wouldn't have returned the vehicle

If it were me and I was prepared to walk away then I would have given it to someone like Gazzuzz. Have him sort it out, offer it for sale with full disclosure that he always does. I bet you’ll probably get more than the thieves asked for.

I write from the perspective that the knife has already cut. Not second guessing you at all.

well different strokes for different folks.... I'd have done the exact same thing u did, if I were u!

but I'm me tho, and I've got a very high threshold for such matters, most times the easiest solution to a mistake is another mistake and I've mastered this anomaly, when I make mistakes that do not require urgent interventions I take my time out and fashion the OSPF (open shortest path first) and most times its the exact opposite of what I'd have done if I reacted immediately.

some other folks will go ahead and sue, spending another round on litigation but me....... this type of mistake.... nah..., I went there with open eyes and bought lolz

The reason we wanted a more recent model is that drivers get better rating and (ithink) charge more for e-taxi
2- saleablity

This is not true as the drivers you asked wanted a status symbol rather than a good car for business.

A 2003 - 2007 corolla would have been perfect for the business. These models equally get excellent ratings provided the driver is neat & keeps the car clean. Actually, it's the service that gives u the rating rather than the car. However, irrespective of the car & how effecient the service was, some riders will still rate low.

Fully agree with Ipfreely
Ipfreely:

Cement costs 1900 on average for a bag of portland in Nigeria. This vehicle cost upwards of one and a half million naira. Those two items have very different levels of due diligence involved .

You don't need to know everything about everything. Simply find someone who you can rely on and who's familiar with the merchandise.

And you didn't sue them.
EgunMogaji:

Maybe not yet.

My sympathy flies to the unlucky op.
If you have kept the car as evidence and obtained a police report with photographs and documents detailing the anomaly "2008 car sold to you as a 2011 car. You would have a case.

Unfortunately the principal evidence has been returned to the fraudulent sellers!

The fact that the car was sold 'as is' is ineffective defence if the car was misrepresented to you.
You rightly believed you were buying a different car!

A magistrate would have voided the contract and most likely slammed them with the option of either replacing the car or refunding your money, may also compel them to pay you interests, damages and cost of litigation.
The case could be decided in as little as 6months.

But as it is, you don't have the car and I guess it might be a lil bit difficult for a lawyer to further your case.
(I am not a lawyer, I might be wrong).

MisrepresentationEdit
Main article: Misrepresentation

Misrepresentation means a false statement of fact made by one party to another party and has the effect of inducing that party into the contract. For example, under certain circumstances, false statements or promises made by a seller of goods regarding the quality or nature of the product that the seller has may constitute misrepresentation. A finding of misrepresentation allows for a remedy of rescission and sometimes damages depending on the type of misrepresentation.

There are two types of misrepresentation: fraud in the factum and fraud in inducement. Fraud in the factum focuses on whether the party alleging misrepresentation knew they were creating a contract. If the party did not know that they were entering into a contract, there is no meeting of the minds, and the contract is void. Fraud in inducement focuses on misrepresentation attempting to get the party to enter into the contract. Misrepresentation of a material fact (if the party knew the truth, that party would not have entered into the contract) makes a contract voidable.

According to Gordon v Selico [1986] it is possible to misrepresent either by words or conduct. Generally, statements of opinion or intention are not statements of fact in the context of misrepresentation.[78] If one party claims specialist knowledge on the topic discussed, then it is more likely for the courts to hold a statement of opinion by that party as a statement of fact.[79]

It is a fallacy that an opinion cannot be a statement of fact. If a statement is the honest expression of an opinion honestly entertained, it cannot be said that it involves any fraudulent misrepresentations of fact.[80]

Remedies for misrepresentation. Rescission is the principal remedy and damages are also available if a tort is established. In order to obtain relief, there must be a positive misrepresentation of law and also, the representee must have been misled by and relied on this misrepresentation:Public Trustee v Taylor.[81]

And this is what I was trying to tell people. Test drive or not, big seller or small fish, a fraud sales is a fraud sales. A misrepresented sales is a misrepresented sales.

Everything about the deal was wrong from the beginning.

Next time, go with a trusted mechanic. No test drive, no purchase.

Used car purchase is a pain in the a_s, I can imagine Nigerian used car.

Don't forget that used car salespeople are one of the hated "professionals(?)".

Overall, it is a scam. Passing off 2008 car as 2011 car alone should do it.

Seek legal help.

no dear I would not totally condemn used cars ....I have bought some locally used as well as sold some locally used products ...the difference is hiding the defects of the products which I would never do ....I will tell you what issues need to be attended to .I believe it's left to you to make a decision.as you said u wanted to use the car for business so getting a good Nigerian used would have been ideal instead of spending more on foreign used..as I adviced earlier if you don't have an idea of the product go with an experienced and TRUSTED( pls note the trusted part) hand ...also very cheap products should ring an alarm bell...it's also goes for foreign used products too because many dealers package lemons in form of tokunbo as well.....in the end Shine ur eye and Shine it very well..

Well @ Op a bitter lesson has been learnt, I commented on a post sometime ago when op placed an ad stating that over 400 cars are available for cheap sales I gave tips what to do so you don't go wrong. However car 45 are making a very big mistake why? Allowing registered dealers to hang around your premises manipulating vehicle report by conniving with some member of staff to defraud end buyers selling dead cars as good cars in the name of report exposes your organization to Lawsuits that may be very difficult to win. My piece of advice let all registered dealer bid and pay outrightly for vehicles they bid for and ensure they take it out of your premises, let them go and sell outside in their own car stand in so doing nothing soils your name.
Just my little piece of advice for car45 so they don't go bankrupt as a result of serial litigation that may start pouring in.

This matter is a let down to our mechanics that nigerian used cars are scraps. It shows clearly that their efforts are not being felt in the general wellbeing of vehicles in the country. An over used car from switzerland will be in good condition than a brand new car used for 2 years in Nigeria. That said, the car overheated on the second day of uber business and not immediately after it was driven out of the yard? What if in the course of buying and fitting new battery, they mistakenly disconnected the fan? What if with the euphoria of getting a new car, they never bothered to check the water level? I have been at their Agindigbi office looking for a venza and I saw a Range Rover sport for 2.5m and I ran past the car and the venza report was so extensive that the clients dedeclin to buy the car. They sell as is and if you guys call those as is craps, then it is a shame on the gurus in the house that the results of their expertise is being questioned. I also went to Cotonou to buy a Range Rover Sport and you can start the car and drive a little around the park but you can never test the gear if it selects above 3 and we paid and taking it out we discovered that the gear was defective. The seller was indifferent and the buyer was shouting himself sick, threatening fire and brimestone and I was not an expert in Range matter , so I managed the car to the border and called for a gear specialist. Gazzuzz himself runs an inspection service and the Op that wants to buy a car did not take advantage of the service to protect her investment. Cars45 are a new idea and they are on the right path. How many used car dealers present a car history details to a client before selling the car.? Even to buy a car at berger, people go with their mechanics and when it comes to used cars with experienced kazeems laying their hands on such cars, you go there and buy without taking a mechanic along. Clap for yourselves

Had a friend who had a car(toyota corolla 2008)
Engine was so he wanted to sell. Car45 was an available option. Went to their office. Car was valued at 250,000. I swear down, we shout. My guy spent i think 150,000 to ring the engine and bought half block in ladipo. Sold it for 750,000. Car45. Try act like you wan sell your car. The value you see on the sight would definitely be more than what is offered.

Lawyers do faint nowadays. They forced him with a gun on his head to buy the car at 1.6m and used ak48 to force him to sell at 650k after two weeks. If the car faults were not documented and he stiĺl bought the car, it is a gamble that he took and as I learnt, bkind men don't gamble.
