My Employer Does Not Want Me To Leave - Please Advice Me by FolsTonyby: 10:14am On Mar 24, 2018
I have been working in this company since late 2014. Initially we were three in the department, later the head of department was sacked, remaining two of us and the company didn't bring any replacement for the head.

Early last year my other colleague got another job and left too leaving only me as the sole staff in the department (IT department). Since then I've been the only person running the department, mind you the company is opening more branches and expanding.

Around December last year when the workload was too much I requested for another hands and the company promised to get me ASAP and even posted the job advert on the dailies but they didn't do any recruitment (upon the fact that many people applied).

Now I got a better job in a multinational and I dropped my resignation letter giving them a month notice but the company refused to accept my letter saying I cannot leave as there is nobody to take over from me. They have recruited people now but the people gave them a month before they can resume and I cannot wait because if I do I will lose my new place, all the information of the company IT wise is in my palm as the company run solely on IT for daily transactions.

Please I need professional advice on this because I am supposed to resume at my new place this coming April.

Any form of advice will do. Help a brother!

Hahahahahaha. Kai, people sef. Did u agree to a life contract with ur employer? Did he place an arrest warrant on u? Did he tie you to his company's building? Are ur legs and hands tied that u can't leave? undecided oga, u can leave if u want to, don't start calling for unnecessary attention pls. #peace

Your current workplace can only threaten you with remuneration. If you're ready to forgo it fine move on. If you're not then stay.

What does your employment letter and HR Manual say about termination of appointment?

If it says 30 days notice, you have done well by notifying the employer in writing about your plan to terminate the appointment. If they decide not to pay any accruable benefits at the end of the notice period, simply walk away and resume at your new place of work.

I'm actually afraid that they may not pay me for the month which I think is total cheating in my own opinion. And I badly need the Money. Is there anything I can do to let them pay me

What's your company's policies on disengagement? Go through the policies first and get back to us.

Please do, as most companies these days use their staffs as Slaves and then, they replace when they feel you are not being productive enough after squeezing the Juices off you ... Yoruba's call it alo-rack

First of all, you're a valuable employee to this company but it seems they're reluctant to admit how much value and importance you hold in their operations.

A business, just like an individual, has needs. Your company refusing to let you go is a way of communicating just how much you are needed. This should be a leverage.

If you have documentary proof of the requests you made for more hands to join you, then have no fear. The law states that you have to give some notice of your intention to leave, but I don't think the labour laws say that your employer has to accept your notice to quit. Insofar you have given them notice of your intention to leave after a certain period, you can always walk away at the end of it all. Just ensure you have copies of the notice you gave them when you were overwhelmed and they didn't act on it.

You can't stay on in this company but if you do decide to stay -- ask them in very strong terms to

1 - hire more people that will join your team
2- an assurance in writing that you will not be sacked for period of time e.g one year, except in the event of serious misdemeanor or wrongdoing.
3- Ask for for more money - for you to agree to stay, they must match what the MNC is offering.

You need number one because obviously you can't handle all the work alone.

You need number two because employers can be very malicious.

You need number three because your value has just gone up and it will be foolhardy to remain at the same remunerative position.

If you can source for money elsewhere, just do so and leave that company. Nothing will happen if you leave cos you've given them a month notice

You deserve your wages, but if they don't pay you that still shouldn't stop you from resuming at the new place.
If you have to borrow from friends, do so.
Once you're settled in the new place, you can start correspondence with them about your salary not paid.
The doors working in a multinational can open for you is numerous and it isn't just about the better pay package. Don't miss the opportunity.

@OP, Payment for this last month should be least of your concern. Just complete the termination requirements as stated on your employment letter.

But more importantly, be smart and take advantage of this opportunity. What do I mean; since you control the core IT segment of their operations, it is high time, you register a cooperate entity and request you be their consultant.

You could do their job remotely or on your weekends. Think smart bro

Did you use ur current employer as a reference? Will your new employer contact your current employer for reference? If the answer to these two questions is NO, then leave the job now.
I would suggest you have a documentary evidence to show they don't want to let you go as well, that would help u in future.
Finally,it's important u treat this issue with extreme caution because it might affect ur future positively or negatively.

Check your contract of employment and find out what the disengagement policy is, how many days' notice etc. You do not have to do a thing beyond what is stipulated there, since finding a replacement cannot possibly be your responsibility, so don't let them intimidate you. As long as you have given them the required notice, you are free to go. Usually, employment contracts give you the option of forgoing your required notice period's pay if you are unable to do the time, so there should be no reason for you to miss your new job appointment.
It is good to try to maintain good relations with the old company, but don't waste any opportunities on pampering their clingy incompetence. If they are still unable to get a replacement at the time you leave, offer to work with them on private contract basis during your free time. Make sure you charge them accordingly.

There cannot keep your salary if you give them the required notice. The required notice is a function of the contract of employment
think about it, did your boss get the opportunity to delay his sack

If they sack you at will, ie immediately, you can also leave today by paying them the salary for the equivalent period

The only reason people don't leave on bitter terms is because you may meet your bosses in the future or even need something from the company in the future

But you can't just leave though the condos y was stupid...exactly happened to me but in my case I consulted for them....tell them that you are leaving and leave but that you would consult for them....they have to pay for that

BRO...NOTHING WILL HAPPEN IF YOU LEAVE. SO LONG YOU HAVE INFORMED HIM... PEOPLE EVEN LEAVE WITHOUT INFORMING THE COMPANY AND NOTHING HAPPENS. YOUR EMPLOYER IS JUST PAINED.

ALL HE NEEDS IS JUST A MONTH NOTICE!


IF HE DOESN'T WANT TO ACCEPT THE LETTER PHYSICALLY, SEND IT TO HIM IN AN EMAIL. YOU CAN ALSO STATE THAT YOU HAVE TO RESUME IN THE NEW PLACE ON THE PARTICULAR DAY.

U will be paid. Don't be afraid of living without payments. As long as uve played ur part well by giving out a month notice to them notice. ALL d same check them resignation policy if it says A month good for u, u will be payed. Same Goes to d former company where I work despite not allowing me to resign I just have to resigned with all asundry, and every penny was given me. Gudluck!
