I have been working in this company since late 2014. Initially we were three in the department, later the head of department was sacked, remaining two of us and the company didn't bring any replacement for the head.

Early last year my other colleague got another job and left too leaving only me as the sole staff in the department (IT department). Since then I've been the only person running the department, mind you the company is opening more branches and expanding.

Around December last year when the workload was too much I requested for another hands and the company promised to get me ASAP and even posted the job advert on the dailies but they didn't do any recruitment (upon the fact that many people applied).

Now I got a better job in a multinational and I dropped my resignation letter giving them a month notice but the company refused to accept my letter saying I cannot leave as there is nobody to take over from me. They have recruited people now but the people gave them a month before they can resume and I cannot wait because if I do I will lose my new place, all the information of the company IT wise is in my palm as the company run solely on IT for daily transactions.

Please I need professional advice on this because I am supposed to resume at my new place this coming April.

Any form of advice will do. Help a brother!
Its simple. If they want u to stay. Ask them to match the offer u got from your new employers. If they won't, leave. if they do, stay. Except u want to leave on other grounds like changing career or something. But if the company is going to match the offer then u shud stay( as long as u see growth and prospects in the company long term business).

It's important you leave your current employment on a good note because your new company will request your reference from them.

However, since you have given a month's notice which I believe is the agreed term on your employment letter, ensure you keep a dated copy of your resignation letter/email.

Lastly, in case your current company refuses to acknowledge your resignation or conduct an exit interview for you; you may have to inform your new employer when you have resumed with them. This is important incase the company you are leaving decides to give an unsatisfactory reference.

You have a right to move on so long you don't breach your term of employment.

First of all, you're a valuable employee to this company but it seems they're reluctant to admit how much value and importance you hold in their operations.

A business, just like an individual, has needs. Your company refusing to let you go is a way of communicating just how much you are needed. This should be a leverage.

If you have documentary proof of the requests you made for more hands to join you, then have no fear. The law states that you have to give some notice of your intention to leave, but I don't think the labour laws say that your employer has to accept your notice to quit. Insofar you have given them notice of your intention to leave after a certain period, you can always walk away at the end of it all. Just ensure you have copies of the notice you gave them when you were overwhelmed and they didn't act on it.

You can't stay on in this company but if you do decide to stay -- ask them in very strong terms to

1 - hire more people that will join your team
2- an assurance in writing that you will not be sacked for period of time e.g one year, except in the event of serious misdemeanor or wrongdoing.
3- Ask for for more money - for you to agree to stay, they must match what the MNC is offering.

You need number one because obviously you can't handle all the work alone.

You need number two because employers can be very malicious.

You need number three because your value has just gone up and it will be foolhardy to remain at the same remunerative position.

Strike a side deal with the management to come maybe 2 days a week or weekends to train and handover properly to new employees. You have the bargaining power if they are cool you take it with your agreed payment conditions

Listen bro let me advise you as a true professional. Approach your boss again and this time record your conversation with him. They might say you stole something and use that to tie you down. But you will be vindicated courtsey of your recording. Okay.

Check your contract of employment and find out what the disengagement policy is, how many days' notice etc. You do not have to do a thing beyond what is stipulated there, since finding a replacement cannot possibly be your responsibility, so don't let them intimidate you. As long as you have given them the required notice, you are free to go. Usually, employment contracts give you the option of forgoing your required notice period's pay if you are unable to do the time, so there should be no reason for you to miss your new job appointment.
It is good to try to maintain good relations with the old company, but don't waste any opportunities on pampering their clingy incompetence. If they are still unable to get a replacement at the time you leave, offer to work with them on private contract basis during your free time. Make sure you charge them accordingly.

Up there is the best advise. In addition prepare a detailed handover note and handover to whoever the MD nominates to take over from you and leave.

Do not under any circumstances stay back in this company. It is purely run as a capitalistic company focus strictly on profit without regards for employees welfare or progress.

The company was expanding and did not consider expanding your pay but only expanded your workload and refused to hire more hands until you gave them quit notice!

My friend, stop behaving like this, you are an IT professional na.

Why won't they pay you? There are laws guiding these things. They are only entitled to hold on to your final month pay if you didn't give a month notice.

This isn't even an issue at all.

My former employer put a 6 months resignation notice period on my appointment letter. When it was time for me to go, I tendered my letter which stated I was leaving effective immediately due to personal reasons..... sue me undecided

Don't mind him. Except the company does not have a policy. All NORMAL companies must have work policy. The OP should go and read his disengagement policy and see that the highest notice you give to your employer is 1 month notice before you resign. If you have given the one month notice, they cannot stop you from going whether the accept or not. The best they can do is to plead with you and probably pay you for any extra days spent after the one month notice.

Nor be everything una go dey carry come nairaland. OP be I.T person, i wonder why he cannot use google to check up nigeria labour law and see things for himself. Nor go let one crazy employer spoil better opportunity for you oo. Use your UPPER!

A resignation letter is not a request that needs to be accepted, move on. Congratulations! When they are serious, they will hire someone ASAP

If the conditions of the new place is better push for your exit. If i may ask where is the company located?

You may decide to leave the company, just make sure there is proper documentation, the company should appreciate its employees and Human Resource should tackle the issue of unemployed candidates with the required skills and qualification when there is a vacancy or recruitment

You can pay them one month salary now and leave immediately. I think they may accept that. Pls note that it is good to keep a good relationship with your former employer,because you may need them for reference in future.

Loyalty should always be to yourself in this regard.
if and when the company you wanted to leave is tired of you, they won't even give you one day notice before they will disengage you.
Mr brother, as far as you have given them one month notice; as stated in your employment letter, there is nothing they can do to you.
You owe nobody any apology. if they decide not to pay you, then you can ask your lawyer to write them.

I understand him.
It has happened to me, so I feel his words.
Its not like he doesn't want to leave. But a lot in his hands and he doesnt want to ruin certain or vital stuffs cos of his leaving.

And my brother requesting for advice. The only advice from me t0 you
- ensure you leave
- be smart about it
- but leave in peace and without problem (maintain a positive relationship)
- all these is because your new place will need a reference from your present place before they do your confirmation in your 7 month after probation (6 months)
