Thank you for your help in answering questions. I'd to inquire about my case.

I am a US citizen, I filed I-130 for my mother and it is already approved and on its way to NVC. The question I have is regarding to my mother as a beneficiary, because she previously was denied a K3 and/or CR1 visa.

So 12 years ago, she was married to a US citizen. They filed I-130 and then K3/K4 (for my brother). She went to the interview at the Consulate. The first time, she was denied under 212(a)(4)(A) public charge, which they submitted additional documents to overcome. At the second interview, she was denied under "9 FAM 42.43 N2.2 (3): In the presence case, no evidence of communication prior to marriage was submitted. Subsequence evidence consists of a few cards and short emails. These facts as ascertained by consular officer would convince a reasonable person that the claimed relationship is a sham entered into solely for immigration purposes and to evade immigration laws. The consular officer will return the petition to USCIS with a recommendation for revocation. If USCIS revokes the petition, the beneficiary will be ineligible for a visa under 212(A)(9)(C)(i)".

After that, her husband came to the Consulate to inquire, to no avail. They decided to abandon the case. Sometimes later, they decided their marriage wouldn't work because of the long distance and she can't go to the US, so they divorced.

I assume at some point, USCIS revoked the case, because the husband probably just didn't follow up if he received an inquiry or notice.

So, fast forward to today. I am worried if my mom will have any trouble when interviewing for the IR5. Will she be found inadmissible under 212(A)(9)(C)(i) in these circumstances? But it doesn't make any sense, because basically they found her did not provide sufficient evidence for the prior marriage, but that doesn't amount to misrepresentation under 212(A)(9)(C)(i), does it?

Hello sir, I'm relieved to be here, I have been confused for the past 2months on what to do, while I was roaming the streets of Lagos looking for the lawyer who filed my divorce and collected a huge amount of money from me, giving me a certificate thats not it. Found out because I was told to get my certificate verified by the embassy. Please right now I want to write to the embassy to let them know what I am passing through. Please VO I need the right email channel. I have reported the case to the police its a serious matter. I'm so confused frustrated. Thank you sir.

I added my husband's name and moved to F3, In 2015, we had marital issue and his people pushed me out, i tried to bring us back but his mother refused since no child from me but he has a son whom I took as mine, he left the house with the child and I was devastated, then i asked him for divorce he ignored me, then i never knew how to go about it before i met this man he was a lawyer collected my details told me not to worry. I later applied for a tourist visa and was given because my mum wanted to see me so I can cry on her shoulder, and celebrate Thanksgiving with them. The lawyer said its over and sent me the divorce certificate, I called nvc and told them I'm not married anymore, and sent them my divorce and other documents I was moved from married to single, I returned back to work and my normal life before I got an interview for immigrant visa. I was happy because I felt so sad after my broken marriage. Went for interview summited documents. And the consular asked for medical report and the verification. Went to seek the lawyer but I don't really understand what that means, that when my nightmare started.. Please VO this a big problem for me, I know the consequence but I stand for the truth whatever it will cost my integrity is more important to me. I will write. I have also gone to see how I can refile for divorce because I have the divorce in order to remarry not necessarily for visa. Thank you so much. Hello VO. I got invitation to travel for an event on short notice. I should be in the US on March 31. As a first time traveler I paid visa fee and filled ds160 two days ago but I can’t get a suitable appointment date. What can I do?

Good day VO,

My dad who is a US citizen filled for me under the F2 when I wasn't married, but when I was called for my interview, I was married with a son and I told the consuler I want to go with my family, my case was adjusted to f3 and was told it wasn't current yet. My priority date is June 2017 and up till now we haven't been called, not even to do their filing make any payment.
Please I would like clearity on d process flow.

Visa Fee Increment

I am trying to confirm if truly there will be an increment in the B1/B2 Visa fee in the nearest week. Kindly confirm this

Dear VO,

My wife and I were given B1/B2 Visa back in 2015 and during the visa interview we stated that the purpose of visit was to give birth (but we did not choose medical tourism (B2) on the DS-160 form but rather chose B1/B2.

We traveled and paid our bills and spent less than 3 months in the US, then in 2015.

My wife wants now to apply for a visa via dropbox for delivery this time around.

Do we choose the B2 category (Medical Tourism) on the DS-160 form or we stick to the B1/B2? We are worried that if we choose the B2 category we may not qualify for visa renewal.

Please your advice will help us a great deal. Thanks

I need more clarification on how to file I130 petition.

1. How can a US Citizen living and working in Nigeria file a spousal immigration petition for a spouse who is also living in Nigeria? Can it be filed at the Lagos Consular Service?

2. Is there a requirement to relocate or travel to the US within a specific period if the Immigrant Visa is issued? Even if the couple are working here and do not plan to move or travel immediately (this is because I see the requirement to have a medical report that will be valid for interview and date of intended travel).

Any other person can share knowledge on the above even if not the VO/CO.

Hello VO please I want you to digest this message for us.we have been on administrative processing for 5months after our cr1 was approved in December 12 2017 and passport was returned to me,they sent me email on what to verify my divorce decree in high court which i did and submit,then in February they requested for billofladding stated that I told them during my non immigrant visa applications that was refused many times that I deal on cars and I sent the whole billofladings both non negotiable and telex about 54 pcs.....on march we start to inquire since it has been over 60 days and we received this email which we don't really understand.......
The immigrant visa application of bukaldrinio is still undergoing administrative processing, in order to verify his qualifications for this visa. We are still awaiting the response from Washington. There is no update at this time. Please be assured that we will notify him by email or phone as soon as the processing is complete.

Questions
I thought ap is handled my embassy and what is the reason for consulting with Washington DC....... This is really hard on us.plz advice us on what to do to fasten the process thanks

Hello dear VO,we received notification from the USCIS that my husband's waiver was approved on April 10. How should we contact the Lagos Consulate with the information? My Dad who is a US citizen filed for my siblings and I (6 of us). we had our interview Oct 14 2017.DNA was requested. January 2018 we submitted our DNA samples...we have been waiting for a response from the consular since then...we sent an email and we were told "the cases are still under review".....please what does this mean?... what happens during case review?...is it the same thing as administrative review?.. is it a negative signal Cos we have waited for over 3month Now...

Hello VO,

I am a DV2018 applicant using the foreign chargeabilty option. I submitted my DS260 form last year, and I have been awaiting notification for an interview. i just checked online yesterday with my confirmation number and saw that I was already scheduled for interview for a past date April 4th, 2018, I missed the date already.

Contacted the Lagos office, and was told to apply for rescheduling online, I would like to know if my case will be rescheduled for another interview since I am a DV applicant.

I will also like to know the necessary documents to go with for proofs of foreign chargeabilty (non Nigerian parent), if my case is rescheduled for interview.

What are the repercussions of not including proof of history of communication, engagement pictures, flight itinerary of vacations spent together in the package sent to NVC? I am scheduled for interview on the 7th of June. Although, i plan to carry these pictures and emails with me to the interview but i do not know if it is a little too late.

Please I need help on this mail anytime I send mail to NVC on my case since 2013 this the reply I get from them but this year have not been getting any reply from the money mail I sent to them

"Due to the numerical limitations on immigrant visa issuance prescribed by law, this petition is not eligible for further processing at this time. The petition will be retained at the NVC until an immigrant visa becomes available. The petitioner, principal applicant, or attorney of record will be notified when this petition is eligible for further processing. "

My dad's Statement of Account is in his Company's name. The VO requested i drop off financial proof in his real name and not Company's name.

Please I need an urgent response. My wife has submitted her DS-260 form stating she is married but mistakingly ticked that I wasn’t accompanying her.

She is slated for interview in two week. How can I ensure I am part of the interview as my name wasn’t on the invitation letter so I can’t have my medicals done for now as a result of that. She is a nursing immigrant (permanent residency) who is petitioned by a us nursing agency.

What can we do as I plan to actually follow her to travel.

I have filled the k-1 visa application and I've been scheduled for interview.but part of the requirements is that I have to bring an evidence of call records between my fiancé and i .I don't know how possible this is in nigeria.though it is possible for him to send his own from the US.there is no how I can get the evidence.this is someone I've been communicating with over 3 years and the phone can only register logs for past few weeks.how can I go about it.
