The Supreme Court on Friday finally laid to rest the trial of a Senate President, Dr. Bukola Saraki, on assets declaration and sundry charges instituted against him before the Code of Conduct Tribunal.

A five-man panel of the apex court led by Justice Dattijo Muhammad unanimously upheld Saraki’s appeal, by dismissing the remnant three counts, declaring the evidence led by the prosecution as hearsay.

The Danladi Umar-led CCT had, in June last year, terminated the trial upon an application by Saraki, by dismissing the entire 18 counts preferred against the Senate President.

The CCT’s decision was based on the grounds that the prosecution, with its four witnesses and 49 exhibits tendered, only led hearsay evidence which could not be the basis to link Saraki to the 18 counts preferred against him.

However, the Court of Appeal in Abuja ruling on December 12, 2017, in an appeal filed by the Federal Government against the decision of the CCT, restored three out of the dismissed 18 counts and ordered Saraki to return to the CCT to defend the three charges.

While Saraki had appealed to the Supreme Court against the part of the Court of Appeal’s decision restoring three of the 18 counts, the Federal Government had cross-appealed against the part of the decision affirming the tribunal’s dismissal of the rest of the 15 counts.

However, in its lead judgment on Friday, Justice Centus Nweze upheld Saraki’s appeal and dismissed the Federal Government’s appeal.
Justice Nweze agreed with the CCT that the evidence led by the prosecution at the tribunal was entirely hearsay.

He held that the Court of Appeal was wrong to have restored three out the 18 counts earlier dismissed by the CCT when it agreed that the evidence led by the prosecution was hearsay but went ahead to isolate three of the counts as having been proved.

Justice Nweze quoted a part of the Court of Appeal’s judgment where it held that “the prosecution failed to call those who have direct knowledge of the facts sought to be proved, to testify”.

Faulting the Court of Appeal’s turn around to restore three of the counts based on the evidence it had declared as hearsay, Justice Nweze said was “equivalent to judicial equivalent of a forensic somersault”.

You guys should keep applauding evil, the same judiciary that set him free would pass a grave judgement on a commoner. Yes, there are some politicians I like but I would never vouch for them or protest whenever they're being called upon by the state to answer questions.
I pity for this country and I pity more for the masses.

A Federal High Court has given National Assembly notice to proceed with Buhari impeachment. This is the right time to strike even if it fails, just keep that cow herders on his toe.

Agreed! I believe the office of the AGF don't gather enough incriminating evidence before instituting a lawsuit against these criminals, that's where the problem is coming from.

as much as i'm not a fan of saraki, i'd love to congratulate him on his victory. do i believe saraki is corrupt? yes,i think so. reasons being the fact that 99.9% of nigerian politicians are corrupt. that being said,this just proves that the total anti-corruption war of the federal govt,is complete nonsense. how can federal govt be prosecuting someone of saraki's calibre based on hear say? the current attorney general of the federation is a complete slowpoke. my late lawyer once told me that court cases are won in the chambers and not in the court room and when i asked how,he told me how well you prepare for a case,gather facts and evidences,determines what goes on in the court room. it's a shame that the federal govt is wasting our money to pay lawyers who can't do proper jobs,and then telling us they are fighting corruption. everything about this govt is complete child's play. and to think that the vice president is even a lawyer,makes it more annoying. we just have a set of brain dead morons collecting money and claiming they are working but in reality,they are doing nothing.

Nigeria judiciary is the most corrupt entity and apologist of corruption. The same modus operandi the juduciary has been using to free corrupt VIPs yet never bat an eyelid at long incarceration without trials of commoners in awaiting trial. They freed Ibori and other top crooks until a British court helped us to convict him. Nigerians celebrated his return same way many are celebrating Saraki's acquittal not out of love but to oil their engine of hatred for the President. i gat no love for any politicians because none affect me in anyway with their loots....

No matter what , the downtrodden and the commoners would always be at the receiving end. Either Saraki is convicted or discharged of all the allegations leveled against him , the kwarans know the truth, who and what he (Saraki) is . The country would only move forward when its people are ready to make it work, even against all odds by all institutions that are expected to serve the interest of the masses.

Pls tell us the difference between Kwarans and Lagosians under Bukola Saraki and Bola Tinubu.

Sometimes am agape seeing some condemning Bukola and at the same time praising Tinubu.

Less crying in Lagos cos of her status as market hub of Africa,remove it and you see Tinubu's unclothedness.

No differences between Tinubu and Bukola when it comes to politics.

The two are very mean politicians with one motive subjecting people to their political caves and if not why do we have Tinubu's wife as senator.
