You are right. But what a smart opponent will do is just to instigate a case against them that they have committed a criminal offence by not submitting themselves for National service as demanded by Nigerian laws.

Very wrong. Any Nigerian that graduates before the age of 30 is under legal compulsion to do NYSC except such a person had served in the military or police force before graduating. Skipping NYSC is a criminal offense punishable by law. Criminal case will be instituted against her immediately she lands in Nigeria by SERAP and even political opponents. Why did you think APC screened out Shitu?

I think this is the time for all of us to demand for the amendment of that silly NYSC act and not start looking for loopholes for people we love. The NYSC table that fell Kemi Adeosun still have so many people on it. It will be over sensationalized in Ngozi Okonjo Iweala's case if true.

No it is not. NYSC is not required in the electoral act. It is only required before you seek employment and getting employed without NYSC is the criminal act get your facts right

Being a graduate does not automatically make one a criminal simply because they don't have NYSC. I believe that is only necessary if you are vying for a position that requires your degree certificate (e.g. head of parastatals, public enterprises, civil service positions). If I dump my degree certificates and tender only my SSCE result as my highest qualification, I have no case to answer to anyone. This would be a very simple issue for the court to clarify if any so called political opponent decides to raise dust; this is very simple logic and the case would be thrown out sane day.

Kemi's case was different, she had a problem because she tendered a degree certificate and then submitted a fake NYSC document. She was simply bullied out of power. If she decided to fight it, she could have found a way out; just that the fake certificate made things a bit messy for her.

Go and read the NYSC act 13(2)
You cannot Dump your certificate. Once you graduate before the age of 30 you MUST serve.
It is not optional
Not only must you serve failure to serve is punishable by prison.

The Constitution is very clear, being educated up to secondary school level is enough, others are extraneous

Your submission is incorrect if you put it side by side with the provisions of the NYSC Act. Reference a snippet of the Act posted below please.

In simple terms, the nysc act is rubbish. You cannot criminalise a person for not serving a country. The best it can do is prevent them from securing job appointments which require degree qualifications because a degree qualification in Nigeria MUST be accompanied by an NYSC cert. However, if the person settles for a position not requiring a degree qualification, NYSC cert will be as useless as the 'P' in psychology.

Uncle, NYSC Act cannot override the provisions of the Constitution and NYSC Act has nothing to do with electoral matters, that's the business of the Constitution and E.A.

NOTE: Elective positions aren't "job employment" within the context of what that NYSC Act prescribes, not even ministerial and other political appointments.

The Electoral Act is not superior to the NYSC Act.

The Electoral Act as a law of the land does not invalidate other existing laws. Try and be informed.

If you commit a crime punishable by other laws, the existence of the Electoral Act does not preclude you from criminal prosecution.
