Who is to be blamed and held responsible if after two days that you got a supposed tokunbo vehicle from a car dealer and the transmission parked while you were traveling on the highway? The buyer or the seller(car dealer who is calculusx)? In the other news, Gazzuzz Gazzuzzautos real attitude and identity busted as it can be seen in the images below; N.B: He initially confirmed on the next page of this thread that the transmission of the Lexus car was repaired in Nigeria but he started behaving otherwise and radically all in the name of trying to support calculusx when he discovered that he is the one that sold the lemon car as tokunbo. legalwealth: Modified with updated topic 3 Likes 1 Share

CarGuideNG: Yes! Comprehensive history report was gotten and even a comprehensive scan was done which only gave two faults regarding AFS and AC. The transmission didn't show sign prior driving it within city except when it was put on higher speed on the highway. When it broke down on the highway, it was towed to somewhere not far where a transmission oil of N16,000 was used to top it up. It was detected to be leaking profusely and didn't pick up. It was towed back to the city where it was detected that the gear was previously worked on say in oversea when dismantled. The buyer although still spent N225,000 to fix the gear but still had to take it to the dealer for some say minor faults detected and reported earlier to be fixed. But the said dealer is making it look like the buyer is just trying to put the whole blame on him although the deal of the car was based on TRUST between both party. |

computerglobal: Thanks for that although the buyer knows some critical things about car shopping because this is second car after using one for over two and half years peacefully. As said up there, he knew some things about the car but TRUST he has and still has for the dealer and some CIRCUMSTANCES made him to proceed with the deal which also required TRUST from the dealer. The pain there is that dealer is making it look like the buyer is not grateful and that he is just coming up with complaints for whatever reasons which is not so. If not for the TRUST and CIRCUMSTANCES, I'm very sure that the buyer will never proceed with buying the said vehicle had it been he knew the car will cause him more money, stress and disappointment he didn't bargain for. |

If all was done correctly as you said op, then I don't see how one could blame the buyer, he did all he could. the dealer may not also be aware about the issue with the car though most likely he should know. no point blaming anybody but the dealer has to pay for some of the repairs for a car that got damaged within 2 days of buying it. mynd44 lalasticlala your opinions 1 Like |

Dealer has no blame. All car purchases are assumed to be on an "as is" basis, unless stated otherwise. Did dealer give a warranty? I expect not. It's in your hand to do due dilligence before purchase. Of course, sometimes shite happens, like in your case. Nigeria has no lemon laws, and even in the US, lemon laws aren't exactly the most clearly defined. Talk to the dealer, try to get an ideal resolution, but understand that the dealer is in under no obligation to help you with your repair. For one, he may not have even known. 9 Likes |

thebigkendo: Might be because the car has been in Nigeria as toks since June last year and possible driving around here and there by the dealer and the likes might have put it to the said risk. Besides, it was detected when it was dismantled that they have worked on the transmission possibly from overseas. The ATF was leaking from the pump area! !! |

I I were the seller I won't even have anything to do concerning repairs on the said car a whole lot can happen in two days since it was on a journey I'm sure car was taken for routine service how does the seller knows what kazeem did on the car? a whole two days?wey u inspect come buy as toks? don even pour oyel for the thing which has voided the imaginary waranty u r trying to claim buyer is on his own like my oga in ilupeju bypass will say......vin report won't tell u everything.....physical inspection is also very important say u don dey drive for two years no mean say u sabi some ancestral car drivers don't even know anything driving isn't "mecho-logy" buyer,go and fix ur car 2 Likes |

legalwealth: I think OP wanted to change his 2 years and a half engine oil shorting EOD & fell for the sweet tongue of the his dealer/middleman friend, who give him a lemon Op did not bother to involve a mechanic for inspection, since we are working on TRUST and if gbege dey e no go pay balance . Lesson learnt -Never trust a Nigerian car dealer.. As in NEVER!! Even if its your blood brother -Always engage a trusted auto-technician for physical inspections -VIN report does not tell everything.. Especially Salvaged cars. To maximize profit, naija dealers will cut corners while fixing.. As long as the car will start & move out of the carlot NB Bros please don't use mobil Xhp for 5k miles on the new ride 2 Likes |

thebigkendo: LOL! !! My EOD is and was not shorting oil; it was just a mistake then based on the position of the car when I gauged it. I'm in Lagos. You can come and run all the checks you have learnt so far on it. I'm still using XHP on max of 3k miles that I've been using since over two and half years and the engine is still superb. 5W 30 mobil 1 synthetic is being recommended and used for this talked about. |

thebigkendo: It is obvious that a mechanic wasn't used during physical inspection. Also a Red-Flag should be raised since according to the OP, the car dealer has been driving the car in Nigeria for a while before the buyer was FORTUNATE enough to buy it from the seller. VIN Check can never substitute for Expert Opinion. Also who did the Comprehensive Scan, did the dealer also recommend the person that scan the car. Mistake has been made, lessons learnt. Next time before you make a major financial decisions, NEVER EVER CUT CORNERS. A mechanic inspection check would cost you 200k, but now you have a mess on your hand. |

TheCar: Ours were used and those of the dealer were not used even to the point of sorting out the transmission's issue. Mechanic was also used to check and no physical issue was detected at the time until 2 days later when the car was travelled with going on high speed. Most transmission issues cannot be easily detected until it is stressed which is not that possible to achieve within Lagos with traffic jam here and there. |

thebigkendo: The issue is the engine oil number written on EOD is not readily available in Nigeria plus looking at the value of the car. Many people using such car won't see it economical using such expensive oil for servicing it when XHP will do pretty fine; not that they don't know that the oil that most of you people are compelling on car owners for selfish reasons is not good. Using the 5 litres of 5W 30 synthetic costing 18,500N for a car worth nothing less than 3M at least still sounds economical. You people should also stop telling people that they can be using synthetic oil for a year without changing it because you want to sell your so-called imported oil. That is not true because lots of factors need to considered which they must also be lectured on. 1 Like |

legalwealth: I am not a mechanic but I seriously doubt a conpetent mechanic was used. If a through physical inspection was done, you shouldn't have gear problem 2 days after. I might be wrong, but I still doubt your mechanic verdict. |

legalwealth: Follow engine manufacturer recommendation not your kazeem. I use 0w 20 engine because that's what the engine manufacturer said I should use and my car is also less than 3 million. Cutting cost on car have serious implications like the one we are all discussing here. I don't sell engine oil or anything relating to car but I do use a car and I follow manufacturer recommendation. TheCar: 5W 30 was not recommended for EOD oga but 5w 20 . Mobil XHP works fine and has been working fine for my EOD for more than two and half years though because I've been making sure that other factors are looked into. For example, some people will be driving their car with bad catalytic converter and 02 sensors which do trigger check engine light (usually ignored by them) and yet they want to get good result out of whatever oil they are using. |
