PoliticsNGR has gotten more details on the rejection of a motion filed by the suspended Chief Justice of Nigeria, Walter Onnoghen by the court of Appeal.

It was gathered that the Court of Appeal in Abuja rejected the request of Onnoghen to stay proceedings in the charge pending against him before the Code of Conduct Tribunal (CCT).

A three-man panel, led by Justice Abdul Aboki, in a ruling, dismissed the application Onnoghen filed to that effect.

The court said, in view of the provision of Section 306 of the Administration of Criminal Justice Act (ACJA), it lacked the power to stay proceedings in criminal cases.

For Onnoghen case to have been referred to as a criminal case by the Court of Appeal confirms my stand on this issue and it reflects the personality of those people and the political clout supporting him.

Onnoghen is just embarrassing himself the more. He should have resigned quietly.

Was Saraki's case at CCT a civil case?

Why was it stayed?


The supreme court ruled in the case of SARAKI V FRN that stay could be granted when CCt is involved because the CCT is a court of quasi criminal jurisdiction.

So they granted saraki stay. But refused Olisah metuh.

Note

Metus's case was at federal high court.
Not cct.
