We need to understand the motion brought to appeal court that was strike before comment, there is already an ongoing case against Danladi Umar who fail to honour appeal court, also there is also a case against Tanko Muhammed for allowing himself to be use and someone who was not called to bar ...

Please we should be more enlighten, this is just an headlines news and is not a complete news ..... Both Danladi and Tanko are currently facing prosecution lets no the one they strikeout before we comment ..

all i know is that Tanko is a Sharia judge which many of us do not know and he was never called to bar ...so please why would Buhari in the first place appoint him without consulting the NJC ? could the appointment has something to do with islamization ? how could Buhari appoint a sharia judge in the first place ? does Tanko merit the position ? i believe lot are are happening and we need to keep our finger across because the fight is for us not them ...one man can never be the Jagaban of all the 36 states, one man can never be more than Nigeria Constitution a man who swore an Oath to protect the constitution is now turning the constitution upside down...

For many of you who were misleed as regard the formal CJN (Salami) that it was Jonathan who suspended him , Let assume Jonathan did but the NJC recommend the sack for Jonathan to act on and it was backed by the 2-3rd majority of the house ...this is what we called due process

Buhari need to be re-educated about democracy and he can never be bigger than the nation because no one is above the law, Buhari has already committed the highest offence being no 1 who should know more about the constitution than you and i, now there is a fictitious news spreading around that the CCT order was forged, now who is fooling who, if it were to be in an advance country by now the president would have been in panic mode or know his fate by impeachment ...if we continue celebrating what is not, one day they will demand for our parent head and nothing will happen, those who are not from that region will say the man deserve such ....Please lets join hand condemn impunity and tyranny ...

Why was it stayed?


The supreme court ruled in the case of SARAKI V FRN that stay could be granted when CCt is involved because the CCT is a court of quasi criminal jurisdiction.

So they granted saraki stay. But refused Olisah metuh.
because onnoghen was d cjn den,so he was seriously bribed in favour of saraki but now d case is different

THE FACTS

1. Justice Tanko attended Government Secondary School, Azare where he obtained the West Africa School Certificate in 1973 before he later proceeded to Ahmadu Bello University where he received a bachelor's degree in Law in 1980. The new CJN was called to bar in 1981 after graduating from the Nigerian Law School. He later obtained a Master and Doctorate (Ph. D) degree from the same university in 1984 and 1998 respectively


2. He was appointed Chief Magistrate in the FCT High Court in 1989 where he served for 2 years (not Sharia court, but they won't mention this).

3. He was sent to the Sharia Court of Appeal (Bauchi) in 1991 where he served for ONLY TWO (2) YEARS before he was appointed as a Justice of the Court of Appeal (again, not Sharia court) where he served for THIRTEEN (13) YEARS on the bench...before being sworn in as a Justice of the Supreme Court in 2007(again, not Sharia Court) where he has served the country for the last TWELVE (12) YEARS.

THE VERDICT: The new CJN is more than qualified to hold that office regardless of whatever some disgruntled semi-literate ignorant folks say...and he will remain in that office until Onnoghen is able to clear his soiled name if he ever does.

It is also important to note that Justice Tanko Mohammed is the natural successor to Onnoghen as he is the 2nd most senior Justice of the Supreme Court & Vice Chairman of the National Judicial Council (NJC).

You see if buhari had just waited for the appeal court,now would have been the best time to seek the ex parte order n neatly achieve his objective whether clean or selfish but now for jumping the gun n engaging in illegality of procuring a questionable ex parte order to suspend onoghen without recourse to the NJC/NASS both onoghen,tanko Danladi should all go.

I don’t agree with the NJC and NASS part

Onoghen deliberately suspended the NJC indefinitely- there was no guarantee that the other members would call his bluff , and form a quorum which would have been needed to recall the NJC

Now to the NASS - that is another matter. Because saraki would have deliberately refused to reconvene the senate, then the CJ would have had a free hand to do what he wants

I support buhari on this. Corruption is ingrained in our society and there is no easy way out.

How can the CJN confess to hiding huge sums of money in his bank accounts without no iota of shame.

We need to stop all this tribalistic statement and love and treat each other as ONE NIGERIA. God bless Nigeria.

306. An application for stay of proceedings in respect of a criminal matter before the court shall not be entertained.



Looters and corrupt people as a matter of urgency learn and be aware per this constitutional provision before running from court to court and pillar to pillar, bribing corrupt court judges to issue injunctions and stop court trials. Don't waste your loot, it won't happen.


The crooked, corrupt and suspended CJ's 1000 hired SANs failed to inform the lawless and corrupt CJ per this critical, section 306 of the administration of criminal justice act Nigeria

For those enemies of the state asking for Osinbajo's opinion on the lawful suspension of the admittedly corrupt CJN, they should rather be showering Osinbajo with accolades for his efforts to advance the anti-corruption agenda of the Buhari regime.

But in a unanimous decision in a ruling delivered Wednesday, the 3-man panel of the Court of Appeal, led by Justice Abdul Aboki, held that the prayers of Onnoghen that his trial be put on hold runs contrary to the provisions of section 306 of the Administration of Criminal Justice Act (ACJA) 2015.

Justice Aboki, who read the lead ruling cited the case of Bukola Saraki, in which Justice Onnoghen himself at the Supreme Court declined to stay Saraki’s trial on the same grounds that section 306 of the new law did not permit a stay of criminal trials.

According to him, there were no special circumstances in which Onnoghen’s prayer would be granted in the appeal argued by Chief Wole Olanipekun SAN.

I didn't go to Nigerian law school and l am not familiar with the technicalities of Nigerian law.

My understanding is that thier is a breach of conduct as to the declaration if assets. That is a civil breach and not criminal.

So how can the appeal court refuse to hear the matter on grounds that the matter is CRIMINAL.

I wonder how the appeal court arrived at the conclusion that the case is criminal in nature! When has failure to declare assets and admitting to the infraction become a crime? Has Onnoghen been convicted of any crime under the Criminal Code yet in this matter? I'm afraid justice is being perverted and it can be anybody's turn tomorrow! Until NJC asks Onnoghen to step aside as CJN to face trial at CCT for breach of CCB Act and in the regular court for any crime related to having so much money and properties, the embattled CJN remains innocent! Let us fear God o!
