It appears to be a very strong ground for appeal. It's like the tribunal declared the rerun illegal and deducted the results gotten from the 17 polling units where the rerun held from the both parties.if the supreme court can just acknowledge the powers of INEC to order a rerun then,there will be serious trouble for Adeleke. I want him to be favoured, because he actually won that election.
The power to cancel, declare inconclusive and order a rerun has been affirmed by SC in various rulings, one of such is Kogi state.
The major premise on which this ruling is found is that rerun was illegal, if subsequently affirmed by CA or SC to be legal, the judgement will retain Oyetola.
I think the PDP should start working on how the rerun was rigged because I don't think the ruling today will stand further judicial test, else, we have so many election overturned except presidential and very few gubernatorial election. We might have to start preparing for election every quarter in one state or the other, as so many shall be overturned.

There were concurrent Tribunal and Court of Appeal judgements in Wike's own, yet Supreme Court upturned them. Several issues come to play in Supreme Court's decisions.

im not in court but from the reports read above,im telling it categorically that the verdict will be in favour of APC.
you just dont dump documents and evidence on the court,you must specifically tied the evidence to a particular fact sought to be proved.some lawyers make this mistake everytime,you tender a statement of account and you expect the court to make sense out of the multiple entries in the statment without reffering the judge to the particular entries in favour of your case.who is the pdp's lawyer pls

Lolz..... even if the rerun election was declared legal by SC and you add the votes gotten by Oyetola and Adeleke after the deductions from this judgement, Adeleke will still win by a total no of votes counted

But I can tell you for free, with the work by the tribunal today; the thoroughness was very good,if not excellent....if Oyetola tries to appeal..he will be spending his money on nothing.....he is gone....

INEC has its own rules.. Which they flagrantly disobeyed.. They just don't act

Only PUs Presiding officers have the power to cancel PU result the tribunal have affirmed not returning officer

INEC in their haste didn't tie loose ends on the doctored forms

Appeal court will upture the judgement. Supreme Court has consistently support rerun election where the different between leading contestants is not up register of cancelled votes.

I am not a lawyer but with the benefit of commonsense I think Oyetola cannot win at the supreme court. The election tribunal held that the re run was illegal but the supreme court hold a different view. APC will be hoping to hold on to that supreme court rule as maintained immediately after the election by Lai Mohammed.

But among the prayers of the PDP was the issue of over voting and rigging. Tribunal ruled that the REC did not have the power he exercised there. That was the REC who got a call in the middle of announcing the result and stopped.

Votes were deducted from those of the two parties and PDP won.

I think even if the supreme court rules the re run issue in favour of APC what will happen to the deducted votes that secured the PDP victory? Surely it cannor be swept under the carpet.

The premise for declaring the rerun illegal was that the State Returning Officer had no power to cancel results from polling units,and that PDP proved that it was the RO that cancelled results of those 7 units where the rerun held.
You can't build something on nothing.If he has no power to cancel those 7 units,then the rerun was built on an illegality,hence its cancellation.
That's a sound judgment any appellate court would uphold

They proved that ONLY presiding officers are empowered to cancel a polling unit result NOT returning officer which was the case in osun state

Interestingly this is the position of the tribunal chairman who incidentally disagreed with the majority decision of his two colleagues. By invalidating the votes in question, they (tribunal) have turned themselves into another umpire, powers which they don't possess. The best they can do is ask for a rerun.

But for what it's worth, the position of PDP is compelling as well, to wit: there was NO NEED for cancellation in the first place since the presiding officer of d unit(s) didn't recommend such.

Are the precedents to these scenarios? Lawyers in the house.

Let me tackle you small.who told you that state returning officers dont have the power to cancel polling unit results? Have you worked with inec before? Even in the manual guidelines,presiding officers do not have the powers to cancel elections.even if they do,they need clearance from top officers.

Provide a source where presiding officers are empowered to cancel polling units.even during inec adhoc training,we were never told that presiding officers cancel polling unit elections.if there is any violence or anything hindrrimg the conduct of polls,presiding officers are advised to call the supervisory presiding officers who will in turn call superior officials and report to them.in case of ballot box snatching,presiding officers are advised to write a report stating what happened but they cant take final decisions on cancellations.
