Spouse visa will not be affected. Her SET M (ILR) might be affected due to the number of absences

I need the help or suggestions of the house. My wife has the spouse visa which is to expire towards the last quarter of this year. She works in Nigeria, and because of her work, she has refused to join me in the UK. This has been our issue. She's been visiting the UK and the longest she's stayed in the UK is 4months other times are three weeks, a month, sometimes two weeks. we had our child delivered in the UK, and one on the way. I believe the fear of uncertainty and not been able to get her kinda of job in the UK may be her fears of not wanting to relocate to the UK. Also she seem not to know what she wants as she still wants to renew her spouse visa despite not wanting to live in the UK. As in wanting to eat her cake and have it. Now that we are expecting an addition, I have told her that she may likely have to give birth in Nigeria. She said she wants to deliver in UK. which I may object. From my calculation she may be due to deliver nearer her visa expiration date.
I would like to know if her absence in the UK will affect her visa extension? I am aware that one has to live in the UK for a minimum of 181 days in a year. I don't know if the is application to the spouse visa extension or during the ILR. I do not want to waste my time efforts and money if her absence will affect her visa extension. I know what I went through during the initial stage while she did nothing hence she is not appreciating what she's got. Any advise will be appreciated.

Hello, I will advice you book an appointment with an immigration lawyer because she hasn’t stayed in UK for her to get an extension In that category.or you go to citizen beareau for advice.

for the next stage (FLR) ive got 2 questions please:

1.
how much is health surcharge at the moment? i filled in the form and it came up with £1,000. i still dey laugh...


2.
i have all the documents ready. for Proof of Co-habitation, i have joint letters:


*i will add either phone, council tax or electric bill dated 2017
*Electric bill dated 2017
*Water bill dated 2017
*Council tax dated 2018
*Bank letter dated 2018
*Water bill dated 2018


in all, i plan to get three sources dated 2017 and three sources dated 2018 as advised earlier.

would these be sufficient?

i will throw in a couple random letters here and there in addition though.

ye its looks good. I would suggest you add more proof if you can... like register on the voters register.
letter from your employer stating your annual pay would also be an advantage...
Mine is due sometime in June so would be waiting for your testimony ....... Goodluck

And you can get same day decision, it’s about 600 pounds and you need to book your appointment at least 45 days to the date you intend to submit your documents because they gets filled up quickly. Same day application doesn't exist anymore. It's been replaced by what's called 24 hours service using Sopra Steria including standard. For more info visit https://www.ukvcas.co.uk/home-internal

Yes, you need to take another English test in the UK. It must be the Level A2 test. Here is a list of the tests offered by Trinity College London:
https://www.trinitycollege.com/site/?id=3218. Alternatively, you can Naric if you have acquired a Bachelor's degree or Master's degree taught in English.

I recently did the same exam and it was very easy. Just a chat with one white woman and she showed some random pictures taken in the UK and asked me to describe what they were.

I am not quite sure what the answer is, I used NARIC the second time round because I didn't write the test in my initial application but a comment from benuromi on page 6 of this thread states that he knows someone who used the test from Nigeria, as I am not familiar with the tests, I cannot advice on this, sorry.

Hi, maybe that’s a new thing they do. I did mine in November and my biometric was taken, I also got my original documents days after my biometric permit was sent to me.

Your querry is not clear. Do you mean biometrics not in database? Your biometrics must be done before decision is made.

My question is; I applied to renew my resident. I just received letter after 3weeks together with my original documents and my passport is not include but my worry now is that I never receive letter requesting my biometric

I will be making my application for FLR(M) some time in June this year. I was told by my solicitor to take some English test (B2) which got me confused...

I got my Engineering degree and Masters in the UK and did not do any other English test when I made my initial 2.5yrs spouse visa application....
why do I now have to do an English test just to renew my spouse Visa?

I just need a second opinion as I believe the solicitor is wrong about this, but am not sure...

How did you apply? Didn't you use the new system where you upload docs and passport(s), book appointment and do biometrics on the spot?

You need to run from a solicitor who isn't aware that a degree in UK already meets your English requirements.

You have initially made a spouse visa and nothing has changed requirement wise (unless you've not done your research. UKVI guidelines scatter all over google) so not sure why u doubting.
