Election has come and gone. Atiku is in court disputing the outcome. The PDP candidate is currently banking on some alleged INEC Server entries as claim to become President.

Here are some of the top 5 problems with this Atiku's cliffhanging.

1. With the failure of the PDP in getting President Buhari to sign the proposed electoral bill into law, Nigeria's current Laws regarding Elections does not cover electronic transmission of results. So the only valid results acceptable by law are those collated and announced by authorized INEC returning officers.

2. The INEC's card reader can only transmit accredited numbers and NOT number of votes and parties voted for. Even at that, there are still manual verification of voters where the card readers fails or malfunction.

3. Neither PDP, Atiku or his agents are authorized to access the figures they are parading. It is illegal and inadmissible in court. Hacking, espionage and unauthorized access to classified information is still a crime all over the world. Atiku and his hacker can still be prosecuted to the full extent of the law if the Federal Government wish to do so.

4. Atiku's figures can only be accepted in court if he divulge his source, who will also testify to its validity. And the government will also arrest and trial such an individual for espionage and treason against an institution of the Federal Government of Nigeria.

5. The Constitution and the Electoral Laws of the Federal Government of Nigeria does not in any way recognize the figures being paraded by Atiku and his Team order than the figures officially announced by INEC - who by law are the Independent Electoral Umpire in Nigeria, no one else (not even the President can announce a winner, except INEC). Inviting programmers from Heaven can't even help Atiku in any way.

Your arguments are flawed. The law didn’t specify how INEC should transmit its results, INEC’s electoral process is fully recognized by law, so if INEC decided to electronically transmit the results, it becomes evidence as long as INEC cannot prove that the server was tampered with.

The fact that using card readers as a requirement was not signed into law doesn’t mean that INEC was forbidden from using it, it only means that they were NOT REQUIRED BY LAW to use it. It will be admissible in court if they used it, and they did!

Festus Keyamo is a smart lawyer, he knows this, that’s why he was accusing PDP of manipulating the evidence rather than focusing on disputing the admissibility of the evidence.

The electoral ACT empowers INEC to formulate and issue electoral guidelines. It's under that power that INEC approved mandatory use of card readers. It's now for INEC to show the use of card readers in Borno, Yobe, Kano as well as the other 34 states and the FCT.

INEC has done that and the results are already known to everyone. The problem now is that Atiku wants to smuggle in figures that are alien to the electoral process.

The worst here is that Atiku is not disputing the outcome within lawful legal framework. He is introducing figures from outer space. How is Microsoft and IBM's testimony on Server Technology going to disprove results from Polling Units collated and announced by INEC?

The whistle-blower's figures cannot be tendered in court without the Court knowing his identity - if not anyone can falsify figures and claim he got it from a whistle-blower.

Also if the Whistle-blower was not originally an authorized INEC personnel cleared to have access to such information, then he is liable to prosecution and his figures to the court on behalf of Atiku will not also stand as he is not in a position to provide reliable details on the matter.

And don't miss the main point, information on any INEC's computer does not supersede the results announced by INEC. Atiku may have stand a realistic chance if he tendering evidence on results from the Polling Units and Collation Centres. But the guy is forming a Hacker and Server Engineer. Who that one help?

Before you start masturbating on this issue, what if the Whistle blower is an INEC IT staff that is ready to testify? Though it will be difficult for Atiku to upturn the result of 2019 presidential election, the fact is that PMB and his legal team may be having sleepless nights on the possible array of evidences of infractions that Atiku legal team may bring before the judicial panel.
The fact that the Supreme Court judges may swing their majority judgement either ways based on evidences presented to them is unsettling to INEC and APC.

Atiku has been scammed.

Only Atiku and his gang sat in Dubai and concluded an Electronic Elections. The rest of us in Nigeria went to the polling units, got accredited, we voted, votes counted, INEC officials on ground wrote the results on Paper, party agents signed, at the collation centres results announced.

Atiku is so heartbroken for his loss, he is now deaf to logic.

You obviously don't know the context of the whistleblower policy. It's not a cut and paste policy. In court, evidence tendered needs to be beyond legal reproach. The witness will have to be cross examined and the court will determine if he broke the law when getting his evidence and by virtue of that, if it hasn't beentampered with since he didn't get it through official channels and INEC obviously contests it. Anything murky gets it thrown out of court before Atiku can suck his big belle in.

Buhari's lawyers have nothing at stake. Their own is to make money off Buhari.

It is the chairman that is in big trouble followed by other people that were involve in the electoral malpractice.

You are wrong. INEC chairman is not going to any jail. INEC is empowered by the constitution to conduct the election, which they have done.

INEC was expected to publish guidelines for the conduct of the election, which they did. Guess what, Server results and electronic transmission of results were not part of it.

The big blunder of the Atiku team is they are not scrutinising the results announced by INEC, rather Atiku has a totally different set of results he got from God knows where.
