Acting CJN, Tanko Muhammad, Justice Rhodes-Vivour, Justice Kekere-Ekun, Justice Sanusi and Justice Abaaji consented to the majority judgment dismissing PDP's appeals on Osun election. Justices Akaahs and Galinje dissented.

The Supreme court judgement is 5 ..2.and in favour of APC as I said yesterday with constitutional evidences.I have been vindicated by this judgement. as I predicted I appreciate everybody that has been following me on Osun matter ..I appreciate those who criticised me with blindness and described my analysis as epistles.My epistles have now become political history in Osun and Nigerian at large. May God deliver them from their ignorance and baseless argument. I cant remember the particular part but its between section 70 and 90 bordering on powers of the judiciary.i think ejimatic can help with that.again,there are 7 previous cases where the supreme court nullified rulings where a judge was absent,ejimatic also has it.i hope it posts it.

As far as I'm concerned, johnnyessence voice will never cease in the next 4 years of oyetola government. Supreme Court has decided and we all abide by it.

Supreme Court dismissed the appeal due to absence of Justice obiora in the tribunal. we have accept the supreme court verdict and we have moved on. As far as I'm concerned, johnnyessence will be much alive on nairaland in the next 4 years of oyetola government. my voice will never cease in the name of the Lord Jesus Christ. when there is life there is hope. we in the pdp has moved on.

I'm not arguing with you that the technicality was not based on the provision of the law, but it's not a constitutional provision. It's mostly a case law of a previously decided case. The constitution only said that Election tribunal shall comprise of 3 members including chairman, no where it was stated that it must be conducted by 3 members in every seating. We are talking tribunal here, you are talking of normal court. Is a normal court presided by 3 judges? You know the answer yourself.

And stop arguing with me, I'm an election petition lawyer currently and have carry out proceedings before two tribunal members where one was absent. The Crux of the matter is that the other member in the Osun election tribunal was absent when the main trial commenced ( calling of witnesses) which was very fundamental.
