Supreme Court has condemned President Muhammadu Buhari for using public funds to defend himself in personal litigations.

The apex court criticised Buhari for using lawyers paid by government during his election tribunal hearings.

The Peoples Democratic Party and its presidential candidate during the 2019 election, Atiku Abubakar, are challenging Buhari’s victory at the election tribunal.

Also, Kalu Kalu, Labaran Ismail and Hassy El-Kuris, are challenging the candidacy of President Buhari as the flagbearer of the All Progressives Congress during that exercise.

The appellants claimed that President Buhari lied on oath in the form CF001 he submitted to the Independent National Electoral Commission.

Abdullahi Abubakar, a senior lawyer at the Ministry of Justice, has been appearing for Buhari at the tribunal.

Justice Mary Odili, while reading the unanimous ruling of the five-man panel of the Supreme Court, questioned Abubakar’s appearance for Buhari, who was sued as a private citizen and not in his capacity as President.

The judge said when Bill Clinton, a former President of the United States, was sued, HE USED his PERSONAL funds to defend himself in court.

Odili described the situation as a CONTRAVENTION of the provisions of the Code of Conduct for public officers.

The court said, “The representation of Mr Buhari by the Senior State Counsel of the Ministry of Justice in his personal capacity and not as Nigerian President, is inappropriate.”

Going through the comments I am really not surprised at the thought processes of most posters. Rather than focus on the fatty that a government staff who should be at work for the public he is employed to serve is appearing for the president in his capacity as private individual, some have turned it to a partisan issue while others are predicting that the EFCC will suddenly start investigating her husband afresh.

Thanks latter is not out of place though because all public institutions have now become the private property of Buhari just because he is president! We have a long way to go...

The Supreme Court however frowned at the appearance of a Principal State Counsel from Federal Ministry of Justice, Abdullahi Abubakar for president Buhari in a personal litigation.
The Supreme Court held that the action of the lawyer contravenes the Provisions of the code if conduct for public officers.
The panel cited the case of former American President Bill Clinton, who theoughout his tenure never engage in using public funds to run personal litigation, adding that same must be applicable to Nigeria since the country is copying the American system of government.
Abubakar had announced his appearance for the first respondent (General Muhammadu Buhari (Rtd) in the suit.
They warned him to desist from such act of using public office to defend a private litigation.
“Clinton in his numerous private litigation, he never used government organs but rather personally sponsored all his private cases,”.
Odili in her judgmen held: ” The court notes the inappropriate appearance of Mr Abdullahi Abubakar state counsel from the Federal Ministry of Justice, representing the first respondent Gen. Muhammad Buhari Rtd in his personal capacity.
“This practice must be discouraged, appeal haven been withdrawn is hereby dismissed,”” Odili said.

The President of Court Appeal, Justice Zainab Bulkachuwa has recused herself as the Chairman of 2019 Presidential Election Petition Tribunal hearing the petition against the election of President Muhammadu Buhari.( May 2019)

Bulkachuwa voluntarily withdrew from participating in the hearing of the case. You will remember that there were complaints and threats of petitions against her participation because her husband Adamu Bulkachuwa is a sitting APC Senator in the Parliament right now.

But we all know that Peter Odili and his wife Mary were accused of looting of billions of Naira funds of the Rivers State Government during Odili’s 8 year tenure as PDP governor of Rivers State. We also know that with the Influence of Mary Odili within the Judiciary and support of the then PDP Government Peter Odili was given a perpetual injunction not to be investigated for his alleged mega corruption while in government- a most bizarre and ridiculous judgement.

So what is Justice Mary Odili doing on this panel. We shall call for her resignation and request for lifting the unfair and unjust injunction on the Odili’s corruption accusation.
