Supreme Court has condemned President Muhammadu Buhari for using public funds to defend himself in personal litigations.

The apex court criticised Buhari for using lawyers paid by government during his election tribunal hearings.

The Peoples Democratic Party and its presidential candidate during the 2019 election, Atiku Abubakar, are challenging Buhari’s victory at the election tribunal.

Also, Kalu Kalu, Labaran Ismail and Hassy El-Kuris, are challenging the candidacy of President Buhari as the flagbearer of the All Progressives Congress during that exercise.

The appellants claimed that President Buhari lied on oath in the form CF001 he submitted to the Independent National Electoral Commission.

Abdullahi Abubakar, a senior lawyer at the Ministry of Justice, has been appearing for Buhari at the tribunal.

Justice Mary Odili, while reading the unanimous ruling of the five-man panel of the Supreme Court, questioned Abubakar’s appearance for Buhari, who was sued as a private citizen and not in his capacity as President.

The judge said when Bill Clinton, a former President of the United States, was sued, HE USED his PERSONAL funds to defend himself in court.

Odili described the situation as a CONTRAVENTION of the provisions of the Code of Conduct for public officers.

The court said, “The representation of Mr Buhari by the Senior State Counsel of the Ministry of Justice in his personal capacity and not as Nigerian President, is inappropriate.”

It was not for this very case that Bulkachuwa was asked to recuse herself. That was for the presidential election tribunal matter which the tribunal has not even given a judgment for! This issue is a pre-election matter on whether Buhari is qualified to stand for election. It is a personal matter for which a government employee ought not to have represented him. Are you not aware that civil servants ought to be non-partisan? His legal representation should have been a private one paid for from his personal funds and not public funds, this matter is not against the state but against Buhari in his personal capacity as a citizen and not as president. Besides, if anyone wanted Justice Mary disqualified, such person ought to make a petition to that effect just as PDP did against Bulkachuwa!

How can someone get a perpetual injection from investigation and prosecution? Is he above the law? Obviously there is some corruption in that judgement and it needs to be revisited and the judge should be probed. Odili should face the music. This is era of justice, not pdp years. May God never take us back to pdp years.
And on Buhari, i think this is an oversight on his part and he should correct it immediately. Justice Odili and the rest corrupt judges must know the war on corruption is total. She should watch her back.

To be honest, she veered off her brief in that judgement because nobody brought a case of impropriety against Buhari using government lawyers in this case before her. And if she is going to make general statements, she has to have condemned all past presidents and governors, all politicians to be exact, who used or are using, or will be using goverment property or funds to prosecute personal legal cases. I am sure her husband is also culpable in that. And by association she would also have benefitted from that.
