The supreme court says the Independent National Electoral Commission (INEC) “failed woefully” to tender documents it claimed were genuine in the Imo governorship election case.

The court said this in its ruling on the petitions on the 2019 Imo governorship poll.

TheCable has obtained full text of the verdict which has not been made public since January 14 when the apex court ordered the sack of Emeka Ihedioha.

The All Progressives Congress (APC) and Hope Uzodinma, its governorship candidate, had challenged the declaration of Ihedioha, Peoples Democratic Party (PDP) candidate, as the winner of the March election.

Uzodinma and his party had argued that the election results from 388 polling units where he got majority votes were excluded when INEC announced the final tally.

The APC and its candidate sought the inclusion of those votes and after losing at the tribunal and appeal court, their prayer was granted by the supreme court.

In the aftermath of the court’s verdict, the legal team of Ihedioha said the judgement was based on false grounds.

His lawyers also said INEC tendered documents to show that the evidence by Uzodinma and his party were false.

However, the court, did not agree with Ihedioha and his party on the claim.

“As regards the 3rd respondent, it failed woefully to tender the results it termed ‘genuine’, which would have rebutted the presumption of regularity in favour of the documents tendered by the appellants,” the panel held.

The apex court also said the appellants – Uzodinma and APC – discharged the burden on them of proving that 388 polling units which were excluded at the collation favoured them.

“This court does not lightly set aside concurrent findings of the two lower courts. It will however, disturb those findings where it is satisfied that there is an apparent error on the face of the record of proceedings,” it held.

False! INEC decleared those results were not acceptable otherwise the lower courts wouldn't have certified them so.This is same as the Akpabio case.

The supreme court was just on a mission to do a hatchet job otherwise how can it explain the final incongruent figures it produced that defies all known human logic?

Recall the stooge Sharia craving CJN recuse himself from all other supreme court disputed governorship election sessions after passing the controversial Imo judgement.

Rubbish, Tanko the Sharia judge has proven that the only reason he was made the CJN was to enthrone chaos.

There where a lot of inconsistences discrepancies on the side of INEC, HOPE UZODINMA, EMEKA IHEDIOHA ETC, what any sensible panel would have done is to order a re run, so that there will be a result consistent with the lay down rules and guidelines, but the incompetent Sharia judge manufactured figures and awarded to Hope UZODINMA, having more figures than the accredited voters, who the hell does that.
This is the reason why they removed Onnoghen b cause no sound Justice that knows his onus will be involved in this mess and ridicle of the bench.

I don't understand, the Supreme Court has not mentioned if the documents tendered by the APC and Hope Uzodinma corresponds with any provided by INEC or if INEC tendered any at all. This case is more complex than it is explained.

INEC did a very Terrible job here. If I were Ihedioha, I'd ask for my money back. How can you declare me governor without any documents to back it up?

Oga go and read the complete judgement on the case. The supreme court has done what any reasonable court would have done. If you don't have the judgement document, ask people who have it but before then, be mindful of what you say so that you don't look stupid later. Hope Uzodinma provided evidence of record of the votes that were excluded, police provide duplicate copy that was kept with them as demand by law yet Ihedioha and Inec said they were fake, OK provide the original one, ihedioha and inec couldn't provide something to prove that what hope uzodimma provided was fake. While hope produce 54 witnesses to back his claim, ihedioha only produce 4 while inec produce one yet they stupidly expect hope to produce agent from each of the 288 polling units. is that one normal talk?

Don't mind inec, I think those that were sent to owerri connived with ihedioha to exclude the result where hope had larger share of votes. Neither ihedioha nor inec could present original result to counter what hope produce and the couldn't prove that there was no election in those area but they kept saying what hope present is not correct, OK let see the correct one, no way

Your problem is.comprehension. If you have read my submission, you would have seen were I made mention about inconsist ncies from all the parties involved.
How do you possibly explain total number of votes cast being more than accredited voters. What a terrible precedence to set by the supreme Court.

You don't even understand the disaster Tanko has created in the judiciary. Tomorrow any judge will award votes to anyone he likes citing this disaster as a precedence.

The best thing to have done would have been to order for a rerun so that he won't possibly be on any side of the mess created by INEC, IHEDIOHA AND HOPE UZODINMA.

Stop thinking like Tanko,and look at the bigger picture.

You don't sound like you read the judgement either except you did indeed read it but the APC partisanship virus will not let you sound objective. In that same judgement, you will see that Hope claimed he has records of 388 units that were excluded, police submitted their own copies for 368 units while during cross examination of witness, the DCP who tendered the documents mentioned 358 units hence the reason the lower courts thrashed this witness as being unreliable. It was the same double speaking unreliable witness that sharia Tanko's panel saw nothing wrong in the multiple speakings and conveniently choose to accept Hope's version of 388 units. Like the guy u mentioned rightly said, in the face of glaring irregularities and unreliable witnesses, the best a learned judge out to give justice would have done is to order a rerun and not prove to the whole world that indeed you had F9 in English and Maths in your O'level exam results for which you gained admission into the university to study law.

Useless judgment. They should have ordered for a rerun.

This one they did has produced a fraudulent result which generations to come will see and spit at the supreme court.

Such a monumental fraud of a judgment. Quite a shame.

While i do not hold brief for either of them, INEC the umpire claimed the elections in those areas were marred with irregularities hence they cancelled them. How then will u expect them to tender results from places they claimed elections did not hold up to acceptable standards?

Some crazy elections and court results has come and go and none generate much tension like dis Imo results because all dos judgements are numerically possible even the zamfara state case where all APC were sacked for PDP make sense because it was proved APC didnt conduct primaries which is a valid reason. However, this Imo decision does not make sense numerically, how den do u expect people to accept it. The sad part is dat the supreme court are setting a precedent in which oda future cases will follow. This results need to be rejected completely otherwise this is d beginning of an era where numbers dont even need to add up. I know APC think this is dere time but no power is stagnant, other parties will come and go but precedents stays. All this results need to be rejected by all, or very soon INEC officials will be held at gun point and be forced to write stupid numbers. Since numbers will no longer matters nor does it need to align.
And if the supreme court even tink uzodimma av a valid case, i blive supreme court after tallying up d total and seeing d results pass accredited voters, dey should av declare a rerun election rather dan dere judgement

ihedioha should hold his lawyers for deliberate sabotage ,his legal team and inec's legal teams are the biggest criminals in this case.

Cos they were forking complicit.
They all knew where this case was heading from the tribunal.

Hope Uzodinna was smart

Ihedioha's and inec's legal teams are either dumb or corrupt but my instincts said the later is the right option here.

All uzodinma needed do to win was to buy off ihedioha's lawyers and the INEC legal team.

Theres no point blaming the supreme court.
The court and the judges did nothing but their job.
The supreme court was factual they played by the book
