Without a doubt, you do make a lot pf sense but I think the govt should also be made to prove that she knows that the money is a proceed of a crime. If she's clueless as to the source of the money, then she should not be punished for a crime that she knows nothing about.

Has the govt ever prosecuted anyone who received money from those that stole public funds and dash them out to girlfriends and family members?

Being in posession of stolen goods places the onus of proof on the receiver not the government. The burden of proof always rests on the person asserting a fact. She is the one saying she has just met the man and does not know anything about the stolen goods- she needs to prove it. The government need not prove anything. It is a fact that the money in her account belongs to someone else. She is the one that needs to prove points 1-3 because someone else's money is in her posession and there is an electronic audit trail to prove it.

The problem with the bolded is that the law doesnt care about those who have not been caught. What it cares about is the person who has been caught. The morality or otherwise of this is a matter for the legislature not the police or judiciary.

It's a an everyday format. He didn't choose the girl at random. He chose someone who has been asking him for money or someone he knew he could impress to meet him with d money most likely a student.
He could also have chosen an old friend who knows him well.
But I will go with a student. They are highly impressionable with money and easily believe online things.
For the guy, he was half smart. He will claim yahoo boy and pay extra 300k as bail and be free. But if they take that police report to the bank, that girl is finished. She will go through a worst ordeal than the thief himself

He is an ATM card thief. He needs to spend his time in jail. By the time he completes his jail term, he will realize crime does not pay.

The suspect got quite unlucky after he stole an ATM card from an unsuspecting elderly citizen from whose account he withdrew over N500k while posing as a policeman.

He was nabbed after he made a transfer with the ATM card in a hotel he lodged in near his victim's house.

Narrating how the suspect withdrew over N500K from her mother's account, Vivian Emesaraonye Dimgba wrote;

My mum was duped of 500k last night. She went to the Atm, tried to put her pin, it wasnt working. She saw a young man standing behind her, and turned to him to complain or vent basically. Feigning concern, he asked to assist her try again. Being so trusting herself, she gave him the card. He put it, and told her the Atm card was stuck, and that she needed to go inside the bank and tell them. She went to the security man, since the bank was already closed and did just that. By the time she came out, the man already left. Oh, he told her he was a policeman.

Fast forward to 12 midnight, she got her first transfer alert 300k. Then 100k..until there was only 30k left in the account. She got dressed, then drove to town with my dad, and made a police report. But they couldn't do much, since they were not sure the Atm terminal he made the transfer from.

At about 1am, he made another transfer. But this time through a POS machine. Eastgate Hotel. Less than 15 minutes walk from my house. He paid for the room, and ordered food as well. We called back the police men, told them of our findings and they met us at the hotel in less than 30 minutes.

They got into the hotel, checked the person who lodged in at the time the POS sent the alert. The print-out they had corresponded with my mum's Atm card number. That was how we apprehended him with the girl he made the transfer of the first 300k to. She allegedly was meeting him for the first time yesterday, but they've been friends on Facebook for a while. We also recovered some Atm cards, which included my mum's card , and the printout he used for the transactions.

Anyway, they are both cooling their heels in the holding cell and will be prosecuted to the full extent of the law.

I must commend the squad for their timely intervention. After today, my perception of the Nigerian police is a bit different..

Times are strange. Be aware!

Upon being asked to release the lady who the suspect made a transfer of N300k to, Vivian wrote in a rejoinder post;



The Atm cards. I blurred the cards as not to further expose the owners . The diamond access card is my mum's. You can see the receipt he used for the last transaction. I still don't know why he didn't pay with cash, because he obviously had some of the money he withdrew from the Atm.

I guess it was greed. 7k was what gave him out. I feel no sympathy for him. My mum is a high blood pressure sufferer. Close your eyes for a minute and imagine her state now. The money isn't hers either. It was transfered from dad's business contact for a surveying work he was suposed to carry out for his client. I would've refunded 500k, for no just cause.

Those of you who feel like the girl is innocent, did you see where I used the word "allegedly?" until proven otherwise.. She's a thief. She's complicit. And how is she supposed to prove that she's innocent. ?

Finally, stop Inboxing me to release the girl. Do I look like the police ? Who takes 300k from a random stranger? If my mum had slumped last night, all I would've gotten is rest in peace. I'll block anyone who mildly suggests the girl is innocent. Not unless you're privy to the complete details of the case, your opinion is not needed.

But I'ld say she's gullible and not stupid. Most young people are. They most live close-by in the same area. She's not just a facebook friend. He knows her somehow.
However I say she's gullible because he wouldn't tell her he's sending that amount. He will just say I want to send u 3k or 30k, then he will claim he mistakenly sent 300k and ask her to bring it to him and maybe keep extra 5k for her troubles.
Most ladies will fall for this scam.
Just check in ur nearby police station and see the number of such cases ongoing

She’s a valid suspect in the crime...even the guy is still a suspect... everyone will have to prove they are not guilty...

I agree that she's a suspect. Hope she gets justice. I just feel like she's guilty on being naive/greedy but not of being an ATM thief.

Not necessarily, The guys intention could be to launder the money, he might promise the girl 3k or 30k, then send 300k and claim it was done in error. He will then ask the girl to go withdraw cash and keep maybe the 3k or 30k for herself. it has happened several times. Alot of persons have found themselves in such problem.

There was a time, folks will beg to transfer money to your account on ATM queue (especially when the queue is hellish and long) so that you will withdraw your money once and give them their own. it is still happening till date.

Nowhere in this story is it quoted that the lady knew he stole the money.

Again, if a friend of mine decides to send me 500k today, the prerogative lies with me to either accept or refuse the money.
Either way, receiving money on its own is never a crime. In the girl's defence, she is oblivious to the actual source of the fund and all she has to do is cooperate and return the money if compelled to.

Again, nobody goes to just "lodge" with a thief, especially when they have no idea that they are lodging with a thief.

It's like all these sorry tales of innocent people being accused of being fraudsters because they happen to be in the same company - usually by accident - with fraudsters.

If that man had gone to buy a brand new phone with that same stolen money, does the police go and toture the shop owner? Is the shop owner supposed to interrogate the source of the fund before accepting it?

In this case, Why should the girl be harrassed too?
I'm forming my facts from the story, which does not state that the girl was privy to him being a thief or involved in the whole scam.

All I see is an opportunistic thief that happened to pry on the ignorance of a poor old woman.

As you can see, there is a logical thinking to my argument.

If you are going to be sentimental, or unnecessarily petty in your reply then don't bother.

She is an accomplice!

Someone called you on the phone or contacted through other means and say, I want to transfer money to you.....and when the money landed in your account, the details of the transfer clearly indicate that it came from a third party you do not know.

Bros don’t tell me you will keep that money?

Even if her explanation was that, the guy played down the suspicious nature of the transfer coming from a third party, she should have known better.

Infact, is that not how Yahoo boys operates? They will meet an innocent mumu and tell them to ‘borrow’ then their account number for a transaction....when caught the borrower will be charged as an accomplice no matter their denial. And I believe that is exactly want happened here, I doubt if the guy gave the lady the whole $300, he just laundered the money through her account.

Always call the relevant bank officials to help you out if you have issue with ATM or any bank transaction and don't reveal you password.

Look, if a middleman feigns ignorance and can convince the authorities that they knew nothing of the money and didn't know it was a product of money laundering, they often let them off the hook.

There is nothing overly suspicious of a "supposedly" rich guy sending 300k to a girl.

It happens all the time. Guys with legit money have done far worse for women they haven't seen.

The girl neither obtained the money by deciet or trickery, so she cannot be seen as guilty in the eyes of the law.

This is all based on the report, wether there is more to the story remains to be seen.

Again, there's a difference, middle men or 'picker' as you call them, as they are often very much aware of what they are doing. They know it's a product of fraud and they get a cut for transferring the money.

Also, how you can even equate an established money laundering scheme to a lady 'harmlessly' being transferred 300k from a supposed "sweetheart" is even more perplexing than your stance in this argument.
