naptu2: Naptu, Oga patapata, the boss of all bosses! I just listened to the whole conversation. Pantami is arguing the fact that there is separation between living (mater) and worshipping (spirit), and that Sharia is a code for living in uprightness, so that while having an occupation earning a living one is guided by the principles of do's and dont's of Sharia as a moral code for interpersonal interactions. That Sharia does not forbid work...and working is not at cross-purpose with belief in Sharia. Yusuf on the other hand is of the view that Pantami's view introduces an involuntary admission that the divine message is incomplete, thus man defines for God how life should be conducted...rather than submitting himself to the creeds given to him as his obligation. He opined that mater and spirit are inseparable. That working is a distraction away from divine service. Pantami was breaking down the intent behind why we address a court judge and say "My Lord". I need to spend time to focus deeply in their exchange. I wish I could post the interpretation of the debate here in English...but Ishilove has said I must go to sleep. Its almost daybreak nau!. At least you tried in your interpretation for people like us without knowledge of the language. Really sad that Boko Haram metamorphosed from Yusuf that looks like an ordinary man. How it escalated to this extent and how they amass that much power should be an academic exercise in our citadel of learning. What went wrong and how was he radicalized up to that extent in a country like Nigeria? Really sad for the Islamic faith and Nigeria as a whole. |

naptu2: naptu, I forgot to follow up on this. I had busy week. You know what I found? This discussion session between Isa and Yussuf is actually a learning series to expand knowledge on the different dimensions on Shariah in North and ways to standardize it. Well, I have translated their conversation on this video. This video is a continuation in the series, it started midway in a conversation and ends abruptly as Yussuf was answering a question from Isa. --------------------------------- <Video Begins> Isa: First, getting an education that can result in gainful employment. Second, proven excellence in academic accomplishments Third, he is a person with proven track record in furtherance of Shariah Jurisprudence. In addition, he is a distinguished scholar in the study and teachings of Islamic Law. There is also a law (he quotes the section of law) which stipulates that a State can have Sharia Court of Appeal if they want it. It goes further, but in summary it all points to the criteria that a Sharia Judge must be someone who studied and has vast knowledge on shariah and must also practice shariah outwardly. This is my own personal understanding and agrees with what is written. If there is anything else beyond this angle we should touch, like legislative career and so on. The shariah lawyers follow guidance in their work now. I don't know how that might change in future. Yusuff: You see what is going on is....according to what is written, I believe that before I go into it, to say I was once in the Shariah committee. Isa: Please hold a moment...that reminds me, yes we once were both in the committee about 5yrs ago. Yussuf: Yes! Ok, at that time the task that was given us was to investigate the Judges in Borno whether or not they met criteria to become Shariah Judges, and their rulings at the time. We went round and we witnessed their work and is why I say they deviate from Shariah principles, to the best of my knowledge. Isa: That they do not practice Shariah? Yusuff: At that time, yes! Isa: Ok, following a discussion... Yussuf: If you recall, there is a particular Judge we distanced ourselves from. Isa: Definitely, that's bound to happen, there are judges like that. Without doubt if a person's case was presented in Mallam Abubakar Sadiq's court, you can be assured of transparency and forthrightness. Nonetheless, we also found some who we witnessed are pursuing livelihood as Judges, nothing more. We are not going to point accusing fingers on anyone but we should focus on the ideals of the practice. Now, what can you say about someone who read law for instance? Yussuf: The one who read law is not in the way. Isa: Why do you say that? Yussuff: Because the one who studied law must apply certain conventions and utterances recognized as part of process in courts of law, which are quite blasphemous and contradict Sharia perspective. Isa: Give me example. Yusuff: Like when they say in court "my worship", "my lord". Isa: Regarding use of my worship, I can't comment because I have not investigated that phrase. Regarding use of my lord, I asked a lawyer who is versed also in Islam, he said the intent behind use of that word is not to rank a judge into divinities...but is simply an equivalent in the way one would say in presence of Shariah Judge "May Allah uphold Shariah". May Allah uphold Shariah, it translates like that! Yussuf: Ok, a lawyer translated it different for me. Isa: I got my translation from the lawyer here....(he points) Yussuf: The translation I received positioned it differently and a contradiction to the principles of Shariah. Isa: May Allah uphold Shariah, this is equivalent of its meaning. That lawyer sitting there gave me the translation. Anything you are going to do and you ask someone in whom you trust their words become acceptable. These are semantics in anyway. May God preserve us! Going back to the discussion, you will find Judges that truly love the work as a career and a profession, not there just for the fame and rewards of livelihood. It is important to recognize that a Judge must not just base rulings on his understanding of Islam alone but must also be open to consult above him and do research to further grow knowledge and carry out fairness in justice, otherwise he could risk passing wrong ruling based on limited knowledge and thus offend God. Yussuf: True! If a Judge introduces or rules on secular beliefs, he has become kafir! Isa: Ok. Alhamdullilahi. Yussuf: What I am saying is all those who invoke anything beside God have become Kafir (unbeliever or denier of truth). Isa: (Uses metaphors)...to explain hypocrisy. Someone who is physically engaged doing an act that is repulsive to their spirit. Yusuff: No, no...thats not what Im talking about. In the course of one's work, is it in harmony with Islam or not? If it's not inline with Islamic guidance, then it is astray. Isa: Ok. The reason I brought that up...I perceived that as contributary. I want to ask you a question. Than ask a stranger, I'd prefer to ask you...whatever your response is acceptable to me. Do you see value in the law profession? Yussuf: No I do not see any value in it. Like I told you, any work in which secularism is introduced, I do not value it. Isa: Ok. What is your reasoning Mallam? Yussfu: Like I was saying before, interpretation and opinion on law must not deviate from Shariah. Isa: Interpretations can vary. For this reason we adopt a standard. What I read and understand I will apply to a person charged to court. Based on his understanding another Judge will rule on the same case with a different outcome. We want to prevent against miscarriage of justice. Yussuf: You, you are learned, you don't have any qualification, you are getting by, then they bring an accuse for you to defend. Consider that. Isa: That is possible. There are people who have undergone studies, they are learned in the field even though they are not certified. But there are certificate courses available. There are those who are learned and when things happen in court they are the ones who can give it interpretation of law and a break down. They argue the technicalities. There are also those who stuy the law but do not practice it. Yussuf: That one is not a practitioner. Isa: But he can give interpretation. Yussuf: It is not legitimate. Isa: Why is that? <Video ends> |
