I was on my way home, on Feb 12,close to my area in ogijo ogun State.I was on a bike and the bikeman lost balance then we all fell down. I fell on the road , then a coming Tipper ran over my leg crushing my foot. I have been at igbobi since then where my foot was partially amputated. I have spent over 900k so far.

A week after, the nearest police station located me and told me the man was arrested. I told the officers to charge us to court..but my Lawyer advice otherwise, said I shd ask the man to foot my hospital bills. We told the Man in presence of DPO...The man insisted he can pay just 150k out of the bills. Lest I forget to mention, that the accident deprive me of writing my Masters exams after I have fully paid.

My questions is: Do I have a case if I charge him to court? Is there possibility of getting compensation?

Hospital bills is choking me...can I ask the man increase his offer and let him go...

Please advise a Brother.

I am not a lawyer but I know that tipper driver most likely is a mere driver and can't afford the bills. His company however, you could sue, ie, the people who own the tipper . Ask your lawyer about this.

The man no go even get money reach that level self, if u are rich then I wil advice u to deal with the man by locking him in a police station for like 6 months, then collect the 150k from him, he might learn his lesson then pay ur bills by your self, but if you choose, u can sue the company of which they might deny the driver or tell u to deal with him ur self cos no company can pay u that money jus like that



But if u are not rich enough and the situation is affecting u badly, my brother sue them all and get all ur money back

Your lawyer should be able to give you ample advice regarding the case. It is well...may the good Lord replenish all your losses.

On what basis should the tipper driver or d company be sue? Did u read the part where he stated they felled from bike after which the tipper ran over his leg? Was it the tipper that caused them to fall down from the bike?
The tipper driver was on its own when trouble came looking for him.
I just can't comprehend why u are advocating for the tipper driver to be severely dealt with and lock up for not being the original cause of the accident.
To the OP, u must understand that this was not an avoidable accident on the part of the tipper driver. Try negotiate with him and see if he can increase the money and avoid court case. Going to court would only increase ur expenses. There are people who had this kind of accident and never live to tell the story...I thank God for ur life being spared...cheers

Only a honest lawyer, op should look for an activitist, most of these lawyer are not trustworthy, the owner of the truck might bribe him, so instead of wasting your money, kindly look for a good activist or forget the case. Thank God you are still alive. God will send many good helpers to you.

Sorry about the accident OP, but I don’t see why the tipper driver should be charged to court.

Did he hit your bike? NO
Did he intentionally crush your feet? NO

Accidents happen in nanoseconds. Your bike fell and he obviously couldn’t get the truck to a stop before crushing your feet.

Even if you died, this wouldn’t be a murder case.

You can get some money out of him and that is about it. The tipper driver isn’t liable for this accident.

Maybe the company he works for might have an insurance package that covers such accidents. Which I doubt. They’re just going to abandon the unfortunate man.

It's the careless bike man's fault.
