A Lagos High Court sitting in the Ikeja area has ordered government hospitals in the State to stop demanding compulsory blood donations from women seeking antenatal and maternity services.

Justice Raliat Adebiyi gave the order in a judgment delivered on Monday and restrained the state government hospitals from demanding blood donations from spouses and other relations of pregnant women seeking antenatal and maternity services.

A non-governmental organisation, Socio-Economic Rights and Accountability Project (SERAP) had filed a fundamental rights suit to compel the respondents to stop the act.

SERAP, on its grounds for seeking reliefs, said it had received complaints from residents of Lagos about the compulsory blood donation policy of government hospitals.

The respondents to the suit are the Attorney-General of Lagos State, Lagos State Ministry of Health, and the Commissioner for Health, Lagos State.

In her judgment, Justice Adebiyi said, “The respondents’ contributions to child and maternal deaths stands to reason, although no data on the child and maternal mortalities recorded as a result of the policy was provided to the court.

“A policy that will deny citizens the right to medical care based on failure to donate blood is not only unconstitutional but unconscionable and adverse to the life and wellbeing of all citizens that access the respondents’ facilities.”

Justice Adebiyi declared that the action of the respondents in demanding compulsory blood donation from those seeking maternity services was “arbitrary, unfair and a violation of their human rights as enshrined in Section 38(1) of the 1999 Constitution.”

She held that the actions of the hospitals and facilities were violations of and a denial of the rights of the residents of Lagos to a system of health protection.

According to the judge, the health system is expected to provide equality of opportunity as guaranteed under Articles 2 (a), 3 and 12 (1) of the International Convention on Economic Social and Cultural Rights.

She also declared that the actions of the Lagos government hospitals and health facilities were a denial of the right to life as guaranteed under Section 33 of the 1999 Constitution.

“The respondents are hereby ordered to forthwith immediately stop and discontinue the policy of insisting on compulsory blood donations from patients or relatives of those seeking medical care and attention before accessing antenatal, maternal or any health services in the facilities of the respondents,” Justice Adebiyi ruled.

The problem is that there's shortage of blood in the blood bank. People in dire situations need to be given blood urgently but our society us not enlightened enough to understand that blood donation is healthy and a form of social responsibility/civic duty.

There must always be blood at hand for pregnant women who are due for delivery and surgical cases. Sometimes it's a life and death issue. I hope this will not lead to maternal deaths.

What do you say of a situation where someone's husband donates blood and still paid ₦7000. At the end of the day, the woman was delivered of her baby and never needed blood transfusion. Money was not refunded, and donated blood would have been used on someone else. This happened in Island Maternity. What's your take?

I donated blood for my sister during delivery.fortunately for us, she put to bed safely and they ended up not using the blood for her.My pain then was that I gave it as a free will donation but it's so painful that the hospital will end up selling the blood & if care isn't taken, it might be sold to someone that has to go borrowing to pay.Pls what is donated free should be give ad free to people in need of it.

This is a good one. That thing is baseless. If they will give the blood freely to those who need, many Nigerians will gladly donate blood often because it is an opportunity to run free check up on the donor. But selling the blood donated even when not used for its intended purpose makes it discouraging and criminal. So the judgement is in order. But I know government establishments and their disregard for court orders. Many ppl will be victimized if they fail to "play ball" during antenatal.

If the hospitals were paying the donors in case of non use of the blood, then I would support them. However in a situation where the hospitals take profit of the unused blood and sell it to other patients, then it is very wrong. The court is therefore on the right here.

Nice one, I was a victim of this.
They should rather sensitize the public on the benefits of blood donation instead of 'blackmailing' harpless young parents into donating blood when their minds and bodies are under stress.

Are you working with other Lagosians to have better controls over blood donations in the government hospitals?
If you are not working on these bothersome community issues, like SERAP is doing, who do you expect to do the work?

The 7,000 you paid is for blood screening and cross matching.

Nobody sold your blood. your blood was simply used for another person that was in need of blood and the person will also replace the blood before leaving the hospital.

Hello, if we donate freely, is it going to be given free or with little charge? I only ask d question I know it is still d same whether you buy or donate. That is d only reason people are care free. You collect freely and you sold it at #10 000!

The judge is a very foolish person.

I hope he will manufacture blood needed for transfusion when any of his family members is in dire need of blood transfusion.
I believe the Lagos state government appeals the judgement.

The judge is viewing the whole issue from a neutral point of view hence the reason for his decision..

There are some things u won't judge right unless you are in such environment. The whole idea will seem wrong and illogical to you. no matter the level of argument you will hold on to your views which you believe to be the best..

Firstly normal labour is a diagnosis in retrospect that is, u can't be 100% Confident that a labour will go smoothtly until the end of the labour and sometimes after 24hrs. Vaginal delivery is unpredictable let alone cesarean section.

Secondly, the blood bank needs to be rich. Nigerians don't have the habit of donating without being compelled. If u wait for every case to go bad before rallying round for blood, you might not get enough blood needed and the required compatible blood.
I have screened 3 patients relatives who visited the hospital for donation while we were in deer need of blood.
2 of them had hepatitis B and the third was HIV positive. They had to go look for other donors.

There are many preventable deaths owing to lack of blood. The doctor gets helpless and watch the patient die. If blood is stored in the bank, anybody can have access to it when needed and compelled to replace.

What I think should be done is that, after donating and paying for screening, if the patient ends up not using the blood, the screening fee should be refunded and paid by whoever ends up using the blood

It is a great development, to make the hospital not withold treatment.
However, we need a better system to encourage blood donation. People don't donate more because of the mindset that it will be donated for free, and later SOLD to patients who need them.
.
I know that the hospitals incure cost in running operations, but we all don't have to pay cash for healthcare.
We need to subscribe more for health insurance, not wait till we are in dire need of medical attention. If you had a proper health insurance in place, you will not be asking about how much you incured as medical bills...most of the time.

Paying through their nose is not even the issue,the issue is availability of blood.

What is they have the money and need 6 pints if blood urgently and the blood is nowhere to be found?

Any body that applauds this judgment does not know how many women and children died due to non availabilty of fresh blood.

Most of the blood in the blood bank are from relatives of those that registered for antenatal.
This has been a lifesaver for many people, that need urgent transfusion.

If implemented, it could lead to a acute shortage, needless referral, and ultimately a pint of blood may go as high as 30k except other measures are out in place.

Like what are the alternatives that is cost effective. This would make government hospitals to sell blood to people and make health care more expensive.

Maybe they should have contested the cost of N7000 but I don't think they are obligated to give you back the blood. It is better used for someone else
