Our Tenant Hasn't Paid Rent Since 2018, What Can I Do? by Starboytwo(m): 8:43am On Mar 17, 2020
Good day all,

We have a tenant who has refused to pay rent since 2018, he only promised to pay and always defaults everytime...

What are the steps I need to take to get the rents or preferably reclaim the room he occupies?

There is a seemingly Big void as nobody takes any action since my Father passed (landlord) i.e, tenants civil enough do pay their rent to my eldest brother who lives far away but some like the tenants in question take advantage and do not like to pay...

Can I write a "Notice to Quit" and deliver it to him in person, or must I entrust a lawyer?

If I notify him about quitting the room, is he qualified for the 6 month the law prescribe...

I need tips on how to handle this situation...

What has your eldest brother who collects the rent said about this particular tenant?

Has he given you the authority to see to those not complying with their rent?

Have you confronted the tenant one on one to know the reason?

You can issue a quit notice via your eldest brother, and 6 months should be given

eldest bro is based in another state, in two years he's came once but always issue threats on the phone(phone threats epp nobody)

And he has mandated me to make sure everything was upto date, whenever he calls and I give him updates he told me to take necessary measures already...

I have spoken with the tenants in question a couple of time, I also try to make a deal with him about clearing his 2018 rent, we not even talking 2019, but 18...

For the past 2 weeks he is evasive and yesterday he broke the camel's back by referring me to talk to his wife blah blah, I just felt he thought I could do nothing and eldest bro will just issue non- binding threats as usual....

I have scourge online and I have written a "quit notice" letter, however I do not know the steps to take, do I serve him in person? Or through a lawyer(I don't have one) or I can't even serve him at all, but I want something done today or nothing will be done at all... He is not the only tenants owing 2018, and I feel I will send a clear messages to other tenants owing with my actions or steps taken....

I need some useful help, the care of the house is entrusted to me, not by choice tho, but cuz I currently reside here...

forgive my naivety, I have never engaged a lawyer before? So I don't even know where to begin. Do I look for a property lawyer or any lawyer at all?

Also, if I walk into the office of one? Do I pay for the service, i.e would the lawyer demand money(I mean I'm I suppose to pay etc)

I've never conversed with a lawyer before, nor do I know how they operate...

You will definitely pay for the services of a lawyer. It's not free.

I'm not a lawyer, but you can go to any property lawyer's office and make your findings.

If you're based in Lagos, I can give you my former landlord's lawyer(female). She's good at it

Let your brother write the quit notice. Sign it then forward to you. You can then serve the man. Its likely your brother has power of attorney.

Make sure the tenant signs a duplicate copy

There is going to be hell on Earth.

What matters most is your soul. Guard it.

Hold on to Jesus (in Righteousness).

Do you know the severity of QUARANTINE for low income earners is devastating?

@starboytwo
LAWYER
Get a lawyer.. Please don't take laws into your hands, because the law tilts more in favour of tenants. get a lawyer to Give him quit notice if his a yearly tenant If the tenant is on yearly payment, it is 6 months notice that u'll give him and it will start counting frm d day you served him d notice irrespective of how many months he has not paid.

Once the quit notice has been filed validly for 6 months, any day over that 6 months notice means the tenant is holding over that property illegally and he no longer becomes a tenant but a tenant at sufferance and from there onward you dont need to issue him a quit notice again but an OWNERS INTENTION TO RECOVER PREMISES in 7 DAYS And from there onwards the tenant practically has no defence legally when the matter will be filed at the rent tribunal nearest to you.

Tops with all the adjournment within 3 to 5 months the court balliffs will personally come to serve them to eject them of the premises compulsorily.

or

DO IT YOURSELF (DIY)
If you don't want to contact a lawyer.
Let me give you a summary of what you should do .Serve him the statutory notices ie 7 days and one month, then file a suit for recovery of premises at the nearest magistrate court.

Once the case comes up tell the court you are handling the case yourself, enter witness box and tell the court what the man did and the order you are seeking from them. The bailiff will then enter the box and tell the court that he served the man but he didn't come .The court will then grant you the order you are seeking. You will take the judgement copy and go to the bailiff and pay them for policemen.

The policemen and the bailiffs will go to the man's house one early morning, break his house and pack all his properties to the court premises. I hope you learnt something today from this. Goodluck

or

GOVERNMENT
If you based in Lagos If its Lagos, go through the human right activist section or Mediation center of the State Government. They have many outlets in each local government in the state. They'll charge a fee of #8,000 and would handled the cases

or

STREETS
I don't encourage this any longer but its inevitable where a tenant things you must suffer after the initial suffer to build a house. Go to court, pay the clerk and officials and get a notice, paste on his door in his absent and snap then take notice off. Make some other person appear in court in his stead as a proxy tenant he transferred tenant ship to without your consent and get a verdict and evict him immediately as the unpreparedness will rock his life for ever. He can continue the fight from outside your house. The person that appeared is the person you have been seeing around the house and you don't know him. Simply put, he alone can provide that person.

NB: I cannot respond to DM so do well to mention me with your email. Thank you

Why not your elder brother handle it, they have never paid rent to you and you have no right to evict them unless you can prove with documents that you are the owner of the property

For me, I would work with my senior to evict every pre-2018 tenants cos having been dealing with the father, they might not respect the children. Then I bring in new tenants who will be given new rules

Get a padlock and lock the room. Then call a carpenter to use 3 planks to seal the door.

Then go to the police and make a report that a miscreant is owing you and you padlocked and sealed the door.

Or Call some boys/soldiers to oust him out. You dey dull

This is Nigeria, serve everyone quit notice. (Go to court, I can't say all that is possible in public forum)

Serve them two weeks quick notice on fact that you want to renovate the house.

Can bring a tractor there if you can afford everyone will vacate, the. Hand the house over to a lawyer to ensure every new tenant pays on Time.

Forgot those saying six months bla bla bla.

This is Nigeria!!!

Serve the tenant a quit notice first and you then follow up if he default the order given in the notice..some people just like giving people problems over their property...they need to review the agreements between landlords and tenants because of the way things are happening..everyday na so so tenants and landlords wahala shooo undecided ...patronize us today, we deliver with quality and quick delivery.Aluminium windows(Casement & casement burglary embedded), Sliding, Projected)doors(frameless doors), partitioning with Perfect Touch.whatsapp 081-536-656-59✴️ there is a lot of tenants and landlords wahala in Nigeria grin ...is the economy situation adding to this abi
