Starboytwo: Good day all,
We have a tenant who has refused to pay rent since 2018, he only promised to pay and always defaults everytime...
What are the steps I need to take to get the rents or preferably reclaim the room he occupies?
There is a seemingly Big void as nobody takes any action since my Father passed (landlord) i.e, tenants civil enough do pay their rent to my eldest brother who lives far away but some like the tenants in question take advantage and do not like to pay...
Can I write a "Notice to Quit" and deliver it to him in person, or must I entrust a lawyer?
If I notify him about quitting the room, is he qualified for the 6 month the law prescribe...
I need tips on how to handle this situation...

Leezah: @starboytwo Get a lawyer.. Please don't take laws into your hands, because the law tilts more in favour of tenants. get a lawyer to Give him quit notice if his a yearly tenant If the tenant is on yearly payment, it is 6 months notice that u'll give him and it will start counting frm d day you served him d notice irrespective of how many months he has not paid.
Once the quit notice has been filed validly for 6 months, any day over that 6 months notice means the tenant is holding over that property illegally and he no longer becomes a tenant but a tenant at sufferance and from there onward you dont need to issue him a quit notice again but an OWNERS INTENTION TO RECOVER PREMISES in 7 DAYS And from there onwards the tenant practically has no defence legally when the matter will be filed at the rent tribunal nearest to you.
Tops with all the adjournment within 3 to 5 months the court balliffs will personally come to serve them to eject them of the premises compulsorily.

If you don't want to contact a lawyer. Let me give you a summary of what you should do .Serve him the statutory notices ie 7 days and one month,then file a suit for recovery of premises at the nearest magistrate court.
Once the case comes up tell the court you are handling the case yourself,enter witness box and tell the court what the man did and the order you are seeking from them.The bailiff will then enter the box and tell the court that he served the man but he didn't come .The court will then grant you the order you are seeking.You will take the judgement copy and go to the bailiff and pay them for policemen.
The policemen and the bailiffs will go to the man's house one early morning, break his house and pack all his properties to the court premises. I hope you learnt something today from this. Goodluck

Consult lawyer for proper guide and brief him. Notice is technical not everyone can issue a valid notice in order not to waste ur time and money because of invalid and incurably bad notice. Thanks. |

Guy no disturb yourself with any lawyer or whatever the law says....simply go to to any market where traditional stuffs like herbs,ancient stones etc are been sold....buy one ancient stone that is been used to scrub the underneath of our leg while bathing...find one reddish material and black material and tie them on the stone...take the stone and find a way of dropping it in his apartment or his frontage....I swear I give you one month....be doing it constantly....the tenant go without saying goodbye.... Please note the stone no be juju oo...na to scare the tenant off....if you do it right,you will get the right result...have done the same to a stubborn tenant myself...take care... 1 Like |

If a tenant proves stubborn and takes you to court, you'll be in serious trouble, much worse than the present situation. Simply get a lawyer to issue a quit notice. If the tenant proves stubborn, the court will request he also pays all outstanding. Ensure he faces the full wrath of the law. Stop threatening him on phone or in person. Don't even talk to him except when serving him the papers. He will pay every dime he is owing or rot in jail |

AssoJnr: Where is your location? Its important because people from certain location are really difficult and dangerous to handle. Back to the matter, I had the same issues with a tenant in 2017, I went to the Court and issued him 7 days notice which was served by the Court. He came and pleaded to make a deal with me, I agreed and gave him some time to pay off, but before the time he packed out without my notice and left. The court had to issue him another notice to payoff his debt or risk loosing his properties like his car and other valuables. He got scared and started paying small small. Never mind, I made it clear by my action to the court guys that they have their cut in the money, that was how they were the ones mounting pressure on him until my money was recovered. They seriously wanted seizing his belongings which I had to stop them. So just try the court and see, if he's not a dubious person, hell get scared on seeing court papers since he had packed, where did u now find him to serve him another notice |

Get a lawyer ASAP and instruct the lawyer to serve him a Notice To Quit through the courts. It's a long process, but the earlier you start the better. Also have it in mind that it may drag on in court for a long time. like how long can it take |

Seeing ur personality, you must be d nice guy type. Well, do this, annoy the hell out of him politely, anything & anywhere you see him, just ask about ur money, visit him constantly.
Where am based, I handle this sort of things for some people, I get to keep 10% of the rent, All the tenants pay on time, d grace period is only one week max!!, unless d owner of building pity you & increase. As for me, I just carry police to any idiot who tries to outsmart me, if you run & leave ur wife. Well, you will bail her for station after you pay me

STREETS I don't encourage this any longer but its inevitable where a tenant things you must suffer after the initial suffer to build a house. Go to court, pay the clerk and officials and get a notice, paste on his door in his absent and snap then take notice off. Make some other person appear in court in his stead as a proxy tenant he transferred tenant ship to without your consent and get a verdict and evict him immediately as the unpreparedness will rock his life for ever. He can continue the fight from outside your house. The person that appeared is the person you have been seeing around the house and you don't know him. Simply put, he alone can provide that person.
