Since when did celebrating a fictitious character become a crime? Even Santaclus, another fictitious character, is well celebrated without any ado and the Flying Spaghetti Monster is well celebrated, yet it is fictitious. I'm not an atheist though, but there's no crime in celebrating fictitious entities, since it makes you happy, but what makes the difference is knowing that what you are celebrating is fictitious and not real.
