PHAYOL81:I didn't say he was wrong though, but at the bolded from your explanation is the same where I'm pointing to. I asked if he read where it was stated that; the portion of land have State Approval even with the layout according to the report. Only that the approval has been revoked by this current administration. My point in essence is that; if anybody conducted a search for those exact portion of land before it was revoked, the search will definitely indicate such portion have State Approval and that's enough reason for people to buy. What people are actually searching for is to confirm if particular portion of land is committed or free from government acquisition. Though the step taken by the government currently is necessary due to the R-O-W and to sort some issues ( traffic) out. But if anybody conducted a search into those portion like I stated above, it will revealed State Approval. So, in situations like this Government have to bear the consequences by paying compensations to affected parties. |

INTEGRITYA1:Under the law of imminent domain, which exists in Lagos, there is no parcel of land the government cannot reclaim....whether previously planned and approved for development or not. All lands in Lagos are the properties of indigeneous families in Lagos. When you pay for land you enter into a lease contract and secure right to use the land for the lease term. Most leases expire at 99yrs. You do not own the land but if you put a structure on it you own the structure. You are a property owner, not a land owner. The land ownership remains with the family. At the expiration of 99yrs they can come forward and demand that you pay another lease and sign a new contract....or that they need their land back. Lagos State can never take over a land under the imminent domain law without compensation. Many citizens are ignorant of the law. Let's say I lease a land and put property on it but 5yrs later Lagos need the land. My property is not what they need....thr land is what they need. The land owner and the property owner are different interests but one party and can both ask for compensation separately or jointly. Many people are cheated and loose their property or land without just compensation due to ignorance. Many people lease land (which we wrongly call buy land) and put expensive property on it without understanding the law on land. Land laws differ in different communities, states, nations, there is no uniformity. Lagos has customary laws on land use. Lagos State government acts as a trustee of that law. Many battles have been fought between the indigeneous land owners and administrative rulers on rights of ownership and till date every battle has been won by the land owners. It will not change in future. |

Tyrone007:Very good point! It all comes down to full disclosure. Prior to a land purchase ( land lease) you must first get a land survey from a professional. Demand and get full disclosure on the land. It is the surveyor's responsibility to discover from govt records if that land is clear or not. |

jaxxy:^^^Lekki Town in Ibeju-Lekki LGA (which is an Ijebu-Yoruba Town, just like the 2 other parts of Ijebuland in Lagos State namely: Ikorodu and Epe) has been in existence for some centuries. NOTE: The entire landmass called Lekki Peninsula got its name from Lekki Town where a historical museum is dedicated to Chief Obafemi Awolowo, SAN, who incarcerated for alleged treason in Lekki in the 1960s. Lekki Phases 1/2... and Victoria Island Extension are 1980/90s (relatively recent) creations of urban renewal of the former Maroko and immediate environs through the sand-filling of crocodile-infested swampland. I noticed that SOME people mistakenly think Lekki Phases 1/2 are the original Lekki... but they are NOT. LEKKI TOWN is the ORIGINAL Lekki. Hope this helps you and everyone reading this. |
