Edo Governorship: APC Names Primary Election, Appeal Committees
Recognises Aguma as Rivers State APC Chairman
The National Working Committee (NWC) of the All Progressives Congress (APC) rose from a meeting at the Party’s National Secretariat on Wednesday affirming Sen. Abiola Ajimobi as the Party’s Acting National Chairman following the Appeal Court’s ruling affirming the suspension of Comrade Adams Oshiomhole as National Chairman and in line with Section 14.2 (iii) of the Party’s Constitution.

Due to Sen. Ajimobi’s unavoidable absence, NWC unanimously appointed the Party’s National Vice Chairman (South South), Prince Hilliard Etta to act on Sen. Ajimobi’s behalf, an action backed by the Party’s constitution which empowers the NWC to appoint one of its members in acting capacity and stipulates that the acting National chairman must be from the zone of the National Chairman.

Also, committees for the Party’s Edo State Governorship Primary Election scheduled for Monday 22nd June, 2020 and Election Appeal scheduled for Wednesday 24th June, 2020 were also named by the party.

Oshiomhole was suspended in Nov 2019 in line with Article 21 of the APC Constitution.
"Subject to the provisions of this ARTICLE and the right to fair hearing, the PARTY shall have power to discipline Party Members. The Power shall be exercised on behalf of the Party by the respective Executive Committee of the Party at all levels.".

Executive Committees here are:-
Ward--- Adjudicatory body of first instance
LGA
State
NEC

NB: (NWC isn't among)

Article 21. C(i-x) stipulates in he APC Constitution, methods on discipline of party members.

Permit me to paraphrase...
"If you are suspended or expelled by your party arising from where the case emanated (Ward for example), you have to appeal to the Ward Committee in a maximum 7 days, they have a maximum of 2 weeks to look into it and decide. If you feel you didn't get justice, you go above their heads, to the LG Committee, State & NEC. (NWC not among)."

After that, the Ward Committee will submit to the LG Committee their reports and appeal and all the way up to NEC (no NWC)

Article 21. B(iv)
The Executive Committee of the Party at the level where a complaint or allegation is made shall have original jurisdiction to hear and determine such complaint or allegation provided that the assumption of jurisdiction by such Executive Committee shall not breach the rules of fair hearing.

---After Oshiomhole was suspended, he didn't appeal. The next month he took the case to Court and erroneously withdrew it later, only to file another again 1 month later.----

Each organ of the Party shall have power to remove a Party officer or officers as the case may be from office at that level for failing to discharge his/her responsibilities neglect and dereliction of duty or misconduct during his tenure of office through a vote of no confidence passed against such officer/officers by a two-thirds majority of the members of the appropriate organ and voting subject to such officers right to fair hearing.

The FCT High Court delivered its judgement that Oshiomhole was suspended.

March 04, 2020.....He got a reprieve for Stay of Execution from the CoA.
Before that order came new national officers have been announced.

Oshiomole took things for granted on this matter.If he had appealed his suspension immediately within the time frame he would not have had this fiasco at all..He had to accept his fate until he presents his appeal to set yesterday judgement aside at the supreme court. Additionally the NWC is a tool of NEC .In order words the NWC is under NEC .The chairman of the NEC is also the NWC chairman.Any judgement affecting the NEC chairman also affects him as the NWC chairman. I agree with you that some NWC decisions have not been ratified by the NEC or National convention. I think this is done because they know they can be ratified later since there is no time frame for their ratification....The politics of APC will continue because of various interests in the party.

Giadom will also name his own committee. However, truth be told Oshiomole just destroyed APC, with court cases that will surely spiral out of control, the Ondo State primaries will also be affected. Giadom is acting chairman through court order, while ETA is acting on behalf of Former Governor Ajimobi who is not elected by APC convention and with vacating or varying the Court Order. Interesting times ahead of us.
