The case is pending in the High Court of Benin.....it is alleged he used it to gain entry as a House of Assembly member in 2006 or so.

Immunity made them push the case sine die.

However, it must be proven.

1. This case is statute-barred and is a pre-election matter. The recent cases as decided by the Appeal Court on Bayelsa has decided that.
I also don't see precedences to their case.

2. The screening has no bearing whatsoever and APC/Ize-Iyamu have no business been respondents here.

The ANDP didn't withdraw the case. They had wanted to but resolved and stayed on till the end.

The Court agreed with ANDP that the declaration of Diri was Feb 14 and were in line.

The case will be tried on its merits based on grounds of appeal but one of it will be that the tribunal has no jurisdiction. This is the exact case of ANDP, that is not to say they won't defend themselves whether there was Ojoro or not.

Their inclusion is an abuse of Court process. One will give way, either APC/Ize-Iyamu is struck out or the case is dismissed.

You cannot file a case in Court...the same suit wherein you were the appellant and here in the tribunal, you are the respondent.

In saner climes,obaseki will be removed.it is clear that he lied on oath and him not filling the form for primary school simply means that he did not attend any...
But the court will again contradict itself and find a way to save him by claiming that lying on oath is not a ground for disq according to the constitution and that as far as he has ssce,he is qualified whether he attended primary school or not....so no point bothering ourselves with this case

No.in bauchi and even in okigwe south,the primaries of apc was challenged by pdp and it was upheld.the supreme court upheld this decision sometime last year,can't recall....

It depends on the cause of action.

If the cause of action is from the PDP Primaries, no chance.

If the cause of action were from forms submitted to INEC on CF001, yes they can file.

These cases are pre-election but the forgery aspect will not be over-looked.

I believe you are not getting the argument of the ADP candidate. If VC of a school signed certificate some years back and that same VC is dead before 2020, then he can not be in a position to sign the same certificate after his death.

i understand very well. My school certificate was auto generated and auto signed. All you need do is print it out. I'd not know which format UI used. The court should invite UI on the issues. I don't see this as obaseki's wahala
