Absolutely! Even if both are already nakid and half way through the sex and she says NO he should have stopped. Sometimes even after having consented sex she could still claim she was raped. Rape cases most time hardly makes it to court.. It is possible that the guy didn't believe or thought he could be convicted.

His offer to drive her home came from a normal person, not a rapist. Unless she's a psychic, rejecting his ride would have to come from a very good reason. She didn't let a rapist drive her home like you said, she let a normal person drive her home. And she didn't invite him to her house. He gave her a ride, raped her and discharged her at her home.

Besides like you said, they made acquaintance at the bar, which made her agree on the car ride and him taking whatever signal he thought she gave as consent and consequently acting up on it.
