Most Senior Lawyer In Gombe Excluded From Chief Judge Nominees List For Being A Christian

The most senior judge in Gombe State, Justice Beatrice L. Iliya, has been excluded from the nominees to fill the vacant position of the Chief Judge of the state for being a Christian.

It was gathered that Iliya's name was removed from the list by Gombe State Commissioner for Justice and Attorney-General, Zubairu Mohammed Umar, simply for being a Christian, SaharaReporters has gathered.

Sources revealed that the Attorney-General refused to nominate Iliya for the position because the past Chief Justice was a Christian.

"Umar deliberately refused to nominate Iliya for the position because of her religion.

"He has the backing of the state government as they believed the CJ should come to the other religion.

"They deliberately refused to nominate her because they know that if her name is there, as the most senior and most qualified, the National Judicial Council will pick her over others," the source said.

In a petition to the National Judicial Council obtained by SaharaReporters, Iliya questioned the rationale behind the removal of her name despite being the most senior judge and having served as an Acting Chief Judge in the state.

She highlighted the faulty process, procedure and criteria used by the Judicial Service Commission in the assessment and selection of the shortlisted candidates.

She explained that the head of the JSC nominated himself and another junior colleague while excluding her name from the nominees without any reason.

The petition reads partly, "The HAG proceeded to preside over the meeting and to present his memorandum in which he proposed to the JSC that Hon Justice Mu’azu Abdulkadir Pindiga, Ag. CJ/ Chairman JSC and Hon. Justice Joseph A. Awak should be shortlisted as preferred and reserve candidates respectively for the purpose of appointment as Chief Judge of Gombe State.

"The HAG’s proposal in the memorandum, although he acknowledged my seniority over the shortlisted judges; my unblemished record; and my being eminently qualified for appointment as CJ; nevertheless, went further to justify my exclusion from the proposed shortlist by explaining that: “in view of comparative satisfactory performance and exemplary leadership qualities exhibited by Hon. Justice Mu’azu Abdulkadir Pindiga as Acting Chief Judge vis-à-vis Hon. Justice Beatrice L. Iliya, I deviate from the non-binding convention to propose to the Gombe State Judicial Commission to present to the National Judicial Council the name of Hon. Justice Mu’azu Abdulkadir Pindiga was the preferred candidate for the office of Chief Judge of Gombe State and Hon. Justice Joseph A. Awak as the two are most eminently qualified and suitable to be appointed as Chief Judge of Gombe State."

In defending the nominations, the Gombe Attorney General said, “Shortlisting of Hon. Justice Mu’azu A. Pindiga and Hon. Justice Joseph A. Awak as preferred and alternative candidates was influenced by the records of performance of Hon. Justice Mu’azu A. Pindiga as Ag. Chief Judge which was more impressive than that of Justice Beatrice."

Faulting the nominations, Iliya said the record of performance of the two judges as acting chief judges that influenced the Attorney-General’s view was not presented to the JSC at the meeting.

"The JSC therefore took its decision based solely on the personal, unverified opinion of the HAG and not on any objective evidence, acceptable or known, recognised criterion guiding the selection, shortlisting of candidates for appointment to the office of CJ," she added.

She argued that the office of the Attorney-General has no oversight powers over the judiciary or judicial officers generally adding that the attorney general "was not in a position to assess and competently grade the performance of judicial officers, more so that he had not yet assumed his office as HAG when I was appointed and acted as Chief Judge from 1st September, 2019 – 4th December, 2019. He only became HAG on 9th December, 2019."

She also noted that the state’s Attorney-General did not place before the JSC any material or evidence to support his opinion, nor did the JSC wait to receive the mandatory reports and comments of former head of court’s, NBA Chairman, DSS report, certificate of medicate fitness and CVs of the shortlisted candidates as require by the NJC rules.

She prayed that NJC not only reject the advice of the Gombe State JSC, the shortlisted names and set aside the whole exercise and process that led to the said advice but also direct that a fresh, transparent and objective exercise, consistent with the NJC and settled practice and procedure be carried out by JSC to determine suitable candidates for the appointment of Chief Judge of Gombe State.

"The NJC on the strength of the material before it should direct that the objective and transparent process of appointing a CJ for Gombe State, commenced by the erstwhile CJ of Gombe State Hon. Justice H. Y. Heman be completed," she added.

The governor of Cross River did something similar and got away with it. Another governor is doing it because there was no national outcry over the Cross River situation. If Ayade was not allowed to stop the most senior and NJC recommended judge from assuming the office of chief judge of Cross River, his Gombe counterpart won’t be trying the same nonsense.

Honestly, I have resolved to overlook the issues in Nigeria and focus on my family. The rate at which we bend the rules, break the law and kill any who dare to speak is appalling.

Gombe is doing it because when Cross-River did it, the NJC & its Chairman, Tanko Muhammed CJN did absolutely nothing.

We are saying the same thing. However, it’s not enough to blame only the CJN. The citizens, the press, the NGOs, NBA, CAN and lots of other stakeholders should also be blamed. We look away when the person perpetuating a bad behavior is from a particular party or region and start crying when someone else does the same.

NBA and CAN have literally turned themselves to opposition parties against El-Rufai in Kaduna state. Imagine the kind of outcry that NBA and CAN would have raised if it was El-Rufai that did what Ayade did. But no, they kept quiet when it happened in Cross River. I won’t be surprised if they suddenly found their voices now that it’s happening again in Gombe to a Christian. The double standard that we all apply is what allows politicians to get away with nonsense.

For the records, the NBA has been urging, complaining and has been against the CRS Govt from day one.

Usoro was against the CRS Govt and Akpata has gone public several times against the CRS Govt on this matter.

No matter who does it, it must be told off so that others won't repeat it.

The issue of CRS isn't an issue of religion but Politics. The Governor is more comfortable with someone from his Senatorial District that will do his biddings, than someone whom he doesn't trust AT ALL.

That does not make it right, either.

I am not talking politics, otherwise, many will concede as well that MURIC has been not just a political but a religious tool for destabilisation in the SW.

Aloma Mukhtar or Dahiru Musdapher didn't need an outcry to do what needed to be done. Aloma was a victim of same politics in the Kano Judiciary where she started.

If you know what's right, DO IT.

Just as some states in the southern part of the country and middle belt won't let a Muslim hold such position, same way some states in the North West and North East won't also allow a christain hold such position

The part in bold is a lie. The Supreme Court already settled the oil well ownership tussle a long time ago. The woman in question is already a judge in Cross River state. She has served in the state judiciary all her adult life without constituting any danger to the state. Now that it’s her turn to take over as CJ, you guys realised that she’s from Akwa Ibom and a danger to Cross River.

The hypocrisy of some of you guys stink to be honest. We all advocate for merit and campaign against nepotism once northerners are involved. When it’s on the home front, we throw away merit and support nepotism. We cannot make progress if people like you keep justifying nonsense because of petty sentiment.

From the article, the former CJ was even a Christian. Gombe state has in my opinion tried to balance the appointment.

Judge nominations should be removed from executive overreach to improve our justice system. In fact, politicians should have no say on who gets nominated. What we currently have are so-called chief judges who are nothing but puppets to various state governors.

That doesn't justify it either.
Her dad was a Perm Sec in old CRS.
She was born in CRS.
She went to School, from Primary to UNICAL in CRS.
She married a Cross-Riverian (from CR South)
She was employed into the CR Judiciary & have spent her working life there.

She was Ag. Chief Judge for 3 months, was the Security of the State Compromised?

Most cases that will arise from Oilwell, boundary, etc will be taken up at the Federal High Court and not the State.

It is simply politics. She is very close & a confidante to the former CJ, Edem who until his retirement had a fractious relationship with Ayade.

CRS has a Judge who was former CJN of The Gambia and later Swaziland and later Court of Appeal, Abuja and now in the Supreme Court..
Would it have been right for those Countries to have blocked him?

A Cross-Riverian is presently the Presiding Justice at the Court of Appeal in Ilorin, and is in comfortable hands there.

(How would it look if been a Muslim State they decide, they don't like Agube's face because his religion is a threat to their Security?)

When you know you don't want Ikpeme, you shouldn't have submitted her name in the first place. You did, and someone was recommended, and you say NO....

It is very bad.

How did you know the NBA said nothing. It is not true.

The NBA has been urging Ayade since the time the incident started.
The former NBA Chair, Usoro spoke and spoke.....the new man, Akpata has been vocal against the CRS Govt.

This is very bad. The way northern Christians are discriminated against is horrible. The same thing happened recently in Kebbi state where the highest ranking judge was denied the CJ position just because she was a christain. These northern muslims are very intolerant, but when they come to the christain south or the middle belt like Plateau, Benue and Taraba, they want to be accorded full rights. It is a shame. One north is just a hoax. Taqqiya is what they are doing them.
