I have a few questions about visiting the USA.

I have a friend in the US(married and a Nurse) who wish to invite me and my wife over (we have no kids yet). He wants us to come live & work in the US through INVITATION.

We've never met in person but got to know him through a friend I know from Childhood who now live in South Africa.

My questions:

In view of our circumstance, is it possible for both of us to be INVITED?

What category of Visa will work for us?

Can we stay back in the US? Is there any legal option for staying back in the US?

Note: the goal is to get PR

If your friend (that you have never met) is truly a US citizen then he should know he can’t invite you and your wife to live and work in US.

However, a US employer can temporarily employ you if you’re in a specialty occupation and support your application for the H-1B visa.

Please has any one been in this situation before, my parents came to visit me in March, they were supposed to leave in May but due to covid their flight was canceled. In August I applied for extension of stay base on the six months rule before Nigeria airspace resumed. Now the extension of stay I applied for is still pending, no biometric notification yet from USCIS, I don’t know whether if they leave now the days they stayed will count against them.

They should leave now.
No country (including USA) will count this against anyone that his or her departure was delayed by COVID-19.

Then follow up on the extension you applied for, or have your folks be on a flight back to Nigeria.
No need to be harsh on anyone here. We all don't work with USGovt.
This is all you can do with an extension request. Follow up with the Govt.
September 2nd/5th to November is another 60 days after. That's the time frame you need to be worried about or explain why your folks STILL DIDNT TRAVEL BACK

He should forget about the extension and let his parents leave now else it could count against them in future.

If you’re serious with the relationship invite her to Nigeria to me with you first, get to know your family etc. That’s the first step of the long journey.

I know I sent the extension package before the Nigeria airspace started operating. And a lawyer said they can’t leave else the extra days after their six months stay will count against them.

Are you sure a lawyer told you this? If your parents leave now, they won’t face any penalty. Any further delay is dangerous.

However, the earliest date that he booked is Mar 21 2020 but he would like to request an emergency date to visit his family on or before Christmas ideally. He has never done this before, what are good and proven emergency request reasons for the visiting visa?

Holiday cannot be emergency, his action is suggesting some desperation on his part.

Even those spousal application affected by the ban are still getting waivers and their visas issued.

Are you speaking from experience or you heard it from somebody? Because US embassy closed for routine visa services in March so how did people get K1 Visa approval during the lockdown. Please I want to know how they got it? Or you think filing for K1 is a 1 week thing?

Don’t waste your money and time, there’s a presidential proclamation banning Nigerians on immigrant visas. Maybe the incoming Biden govt would reverse it.

Go to the K1 session and ask your question, from my opinion there is still approval for K1. K1 does not fall under immigrant visa

No good travel history, Dubai hardly count.....
