Sorry for the refusal. If you have the divorce certificate and other documents relating to divorce you can reapply immediately and enclosed a cover letter to point out the mistake made by ECO. You can also appeal the decision that the divorce certificate was submitted in spanish and translated. Sure you can make a note on certificate for the ECO to identify. Make sure that all submitted documents are scan by TLC, Do not allow them to tell you what to submit or not. It is well. Just a minor setback.

@Justwise, Ekpotek. I was just refused a family permit. Please find the attached. according to them, I did not submit my husband's divorce certificate. But I submitted it, the document was in Spanish so I submitted both the original and the translated, i also included a personal statement and listed all the documents that I was submitting. I don't understand how they missed that one. I want to reapply immediately. My question is, can I write something (eg divorce certificate) on the document? so they can easily see it.

If you have made payment, point out the mistake with its correction in a cover note and submit along with other documents during biometric. That particular question is directed to you and not the EEA national. At the beginning of the application form there are specific questions that ask about where you will stay in the UK and contact details of your Spouse

I went back to delete it but the delete option is no longer there. Should I leave that one and create a new account to fill another application?

Not having a job could be an issue. Never underestimate the UKVI people. Although your application will be considered under EU laws, the ECO may likely go outside EU laws to apply UK immigration law and lack of financial home tie. Anyway just be honest and be hopeful. So filled as folllows
1. Nill
2. Nill
3. Entered the amount that your husband will provide for the entire trip. This should include tickets for two/shoping allowance etc
4. Enter the cost of your own ticket
5. Nill since you will be staying with him
6. Enter nil. your husband is expected to take care of your living expenses
7. Enter amount as in #2

Ensure that he sent the entire money to you and is reflected in your bank account. Most important include a detail cover letter to explain your financial circumstances to ECO.

Timeline so far;

July 18... Biometrics @ TLS ikeja
July 29... Application received @ UK decision centre ( from Sheffield)
August 4... Application processing not straightforward ( from Sheffield)

Since then, i'v been playing the waiting game and praying fervently.
I'v gone through threads where a lot has been discussed about Escalating the process either by calling the H.O in Sheffield directly or via email.
Pls I need opinions and advices on what next to do. It's already 27 working days.

The permit is his passport data page of citizenship of EU country, National Insurance number; Proofs of residence eg utility bills, council tax. Proofs of work eg letter from employer, 6 months payslips, 6 months bank statements.

Okay. You do not need any consent letter. All that you need is a valid marriage certificate and proofs of relationship eg photos, calls and chat logs, evidences of his visit to Nigeria. His permit to reside in the UK and his address.

Pls I don't understand the permit part. He is currently working but I don't think he has any permit to reside in the UK. Does he need to apply for a permit?

I met my husband a (German citizen) 8 years ago and then he was married to a german lady. We did our traditional wedding 7 yrs ago and we were blessed with a child (he is a German citizen too) when I was joining the village meeting as a new bride, I was registered with my husband''s surname. Since then I have been usin my husband's surname. My husband and the german lady are now divorced since 2015. And he has relocated to the UK. We got married at the registry last december.
My questions are....
(1) Since I started using my husband's name before his divorce. Will it affect my application?

(2) Presently my husband rented a room in an apartment, that is, he is sharing a flat with other people. Does he need to rent a full flat before I can apply?

1. No it will not affect your application. What you need is just a valid marriage certificate and a copy of your husband German passport. Your husband is an EU citizen exercising his EU treaty right in the UK. Be ready to be interviewed by home office.

2. No, your application will be treated under EU laws. What your husband need is a valid U.K. address and evidence of working in the U.K. You must apply for EU family permit visa for spouse of EU/EEA Citizen. If you apply for ordinary UK family visit visa you will be refuse or require to shows documented proof of relationship other than just a marriage certificate.

It does not matter if you can speak English or not. I does not matter if you are working or not. Your application will be considered under European immigration laws. You only need to proof relationship with your husband. In fact a verified marriage certificate is sufficient. However your husband and you may be requests to attend an interview to establish this relationship.
