The law firm of Fein & DelValle PLLC has announced that it, “is drafting a criminal indictment against Nigeria’s President Muhammadu Buhari and Chief of Army Staff, Lieutenant General Tukur Yusfu Buratai, for genocide and crimes against humanity under the Rome Statute of the International Criminal Court.” The firm said in a statement issued at the weekend in Washington, D.C. USA, that it is pursuing the case, “on behalf of Biafrans who covet justice – the dead, the living, and those yet to be born”. According to the statement signed by renowned Attorney, Mr. Bruce Fein, and his Partner, Mr. W. Bruce DelValle, “Buhari and Buratai are criminally culpable because of their command responsibility over security forces operating under their direction or control and who are terrorising tens of millions of Biafrans specifically because of their Christianity and ethnicity.” “The crimes include extrajudicial killings, torture, and sister unspeakable horrors. They are the grisly signature of Buhari’s and Buratai’s ongoing military campaign in the South East region with the euphemistic moniker Operation Python Dance II. “The indictment being drafted by Fein & DelValle will be presented to Chief Prosecutor of the ICC, Fatou Bensouda. It will be modeled after the genocide or crimes against humanity indictments returned against Serbia’s Slobodan Milosevic, Sudan’s Omar Bashir, Libya’s Muammar Gaddafi, Chad’s Hissen Habre, and Cambodia’s Comrade Duch. “The overwhelming majority of Biafrans cannot speak for themselves without risking lethal retaliation by President Buhari or Lt. That fear explains the reason the United States District Court for the District of Columbia granted the motion of Fein & DelValle to reference their ten (10) Biafran plaintiffs anonymously in their Torture Victims Protection Act suit against sixteen (16) individual Nigerian defendants in Doe, et al. v. Bigger troubles await Dino Melaye, the senator representing Kogi West at the National Assembly following a revelation that he never graduated from the Ahmadu Bello University, Zaria as is being claimed. Melaye, who is known for his controversial stand on national issues as well as a lasting political battle with his former friend and governor of Kogi state, Yahaya Bello, recently alerted Nigerians that there were plans to carry fictitious allegations against him. Melaye thinks this move was being planned to get him to face the Economic and Financial Crimes Commission (EFCC) because he was a major factor that stood against the confirmation of Ibrahim Magu as chairman of the anti-corruption organisation. Sahara Reporters is confirming that Melaye never graduated from the department of geography from ABU. The report also claims that the DSS was alerted over this but that the security agency covered it up and allowed the man blossom. “At least three exam officers at ABU, Zaria insists that @dino_melaye never graduated from geography department, DG DSS alerted but covered it up,” the report said. They said Dino's name was not on graduation list and further accused him of bribing his head of department. Wikipedia reports that Dino Melaye graduated with a Bsc in geography from Ahmadu Bello University Zaria adding that about 30 undergraduates are currently enjoying scholarship under his education empowerment fund. Many Nigerians who reacted claimed Melaye was being tackled by the government for opposing the Buhari administration on certain issues. Certificates obtained outside Nigeria will continue to be more valued and considered over those obtained in the country due to some factors, the United Kingdom-based Metropolitan School of Business and Management, has said. Among the reasons adduced for the value placed on foreign certificates by the institution include “use of dynamic and relevant practice-based approaches” and the combination of corporate experience with “interactive teaching methodology with live case studies”. The Assistant Country Director of MSBM (Nigeria), Mosisiye Kayode, stated this in Abuja during the Enterprise 101 workshop organised for business managers, young professionals and aspiring entrepreneurs. She said, “We have affiliations with schools in the UK but anyone participating in our school in Abuja has worked, studied and lived in the UK at a particular time because you cannot give what you do not have. So anyone who is going to teach in our class is someone who has studied, worked and lived in the UK . “If you have a certificate from the UK, it is more appreciated because they know that we don’t just give you the teaching, we give you the real life scenario. “Enterprise 101 has always been a vision of ours; we have actually been looking forward to bringing in people and entrepreneurs in Abuja to come around because most of them have things they will want to share with other young people just for young aspiring entrepreneurs to actually gain from.” A civil servant and one of the participants, Chukwugozim Melekwe, said that regardless of his exposure to business from an early age and a successful job, the workshop was a platform to further learn and network to broaden his scope in business. He said, “Even though I have some sort of safety net by working right now, it has always been a part of me to make things happen. We need knowledge to be successful. President Muhammadu Buhari is sick, but not terminally ill, The PUNCH gathered on Sunday. A top government official, who spoke to one of our correspondents on condition of anonymity, said this shortly after the Presidency announced Buhari’s decision to extend his two-week vacation. Before now, the Presidency had insisted that the President was not sick, saying he would only use the opportunity of his short vacation to undergo check-ups. But the government official admitted on Sunday that Buhari was sick. He, however, insisted that the President was not ill. “The President is sick. But it will not be correct to say he is terminally ill. Illness has more to do with terminal disease. The President is only under the weather; he is not terminally ill,” he explained. Before the announcement, however, arrangements were on to receive Buhari in Abuja, on Sunday, in preparation for his resumption on Monday. Officials were put on the alert pending the confirmation from the Protocol Unit on the time the President would arrive. The National Youth Council of Nigeria had also said it had mobilised 15,000 youths across the country to join in receiving Buhari at the Presidential Wing of the Nnamdi Azikiwe International Airport, Abuja. As of the time the statement on the extension was released, State House correspondents were on standby to join the delegation that would receive the President. The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, had, penultimate week, in an interview with CNBC Africa, monitored in Abuja insisted that Buhari was not ill. Adesina had insisted that Buhari was only in London for vacation and was not in any hospital. He had said, “The President is in London on vacation. He is not in any hospital and he is not ill. “When he was travelling last week, the statement we put out was that he was going on vacation and during the vacation, he would do routine medical check-up and nothing has changed from what we pushed out last week.” Earlier on Sunday, the Presidency had announced that Buhari’s 10-day vacation to the UK had been extended. The extension was contained in a three-paragraph statement made available to journalists by Adesina. Adesina said the extension was necessary to allow the President complete a series of tests recommended by his doctors and get the results. Although he said Buhari had already dispatched a letter to the National Assembly on the extension, he did not specify the duration of the extension. The statement read, “President Muhammadu Buhari has written to the National Assembly, today, February 5, 2017, informing it of his desire to extend his leave in order to complete and receive the results of a series of tests recommended by his doctors. “The President had planned to return to Abuja this (Sunday) evening, but was advised to complete the test cycle before returning. The notice has since been dispatched to the Senate President, and Speaker, House of Representatives. “Mr. President expresses his sincere gratitude to Nigerians for their concern, prayers and kind wishes.” Shortly after Buhari left Nigeria penultimate Thursday for London, there were reports that he had passed on in a London hospital. The Presidency had since denied the reports. ‘Senate has received Buhari’s letter’ When contacted, the Special Adviser to the Senate President on Media and Publicity, Mr. Yusuph Olaniyonu, confirmed the transmission of the letter from the Presidency to the leadership of the National Assembly. He however declined to disclose the content of the letter. “I can confirm to you that a letter has been transmitted from the Presidency to the Senate,” he said. However, a source at the Office of the President of the Senate, who spoke on condition of anonymity as the letter was meant to be announced to lawmakers on the floor of the Senate during plenary, said Saraki had yet to receive the letter in person. He said, “I’ve been able to confirm that the letter had been transmitted to the Senate. Saraki has been informed about it but he has not collected it, maybe because he is currently out of town.” The Chairman, Senate Committee on Media and Public Affairs, Senator Sabi Abdullahi, when asked if the lawmakers would suspend their current recess to consider Buhari’s letter, said he was somewhere in his constituency (Niger North Senatorial District) and would not speak on the matter without having all the details. Also, the Leader of the House of Representatives, Mr. Femi Gbajabiamila, told The PUNCH, on Sunday, that there was no need to reconvene the House for the purpose of considering Buhari’s letter. Gbajabiamila, a lawyer, explained that the President had already done the most important thing by triggering off the constitutional process to avoid a vacuum and to ensure that there was no crisis. He advised Nigerians to stop spreading rumours as Buhari clearly gave the reason he would not return to the country for now. Part of an electronic mail he sent to The PUNCH, read, “I do not believe there is a need to reconvene for purposes of considering the letter. As you know, a President can go on leave and also extend same if there is a need to. “The important thing is there is no power vacuum for as long as a President or Governor is absent. “The constitutional safeguard has been triggered off and there is no constitutional crisis. “The President did give the reason for the extension. The reason is not unusual and we should not give in to speculation and unfounded rumours.” I didn’t speak on Buhari’s return –Mohammed Meanwhile, the Minister of Information and Culture, Alhaji Lai Mohammed, has denied speaking on the return of Buhari. While the nation awaits Buhari’s return, Mohammed said in a statement, on Sunday, that the reports attributed to him, claiming that the President wouldn’t return because of faulty aircraft, was false. The minister, in a statement by his aide, Mr. Segun Adeyemi, said he did not speak with anyone. The statement added, “The minister has not spoken to anyone on the issue of the President’s return, hence this report is another from the stable of the purveyors of fake news and should be disregarded.” PDP, APC clash over President’s health status Meanwhile, the National Caretaker Committee of the Peoples Democratic Party called on Buhari to tell Nigerians the true state of his health. The main opposition party was reacting to the inability of the President to return to Nigeria from the UK, where he had been on holiday for more than 10 days. The PDP said it was wrong for the President to also send letter to the National Assembly, extending his leave, without telling Nigerians when he would resume. Spokesperson for the Senator Ahmed Makarfi-led Caretaker Committee, Mr. Dayo Adeyeye, stated this in a telephone interview with one of our correspondents. But the ruling All Progressives Congress berated the PDP, saying the opposition party should pray for the President instead of spreading rumours. The PDP spokesman, who was a former Minister of State for Works, however, said it was wrong for the President and his handlers to be trivialising the health of the President. He said the President had chosen a wrong approach to address the issue of his health since he assumed office. He said, “The President should know he is not a private citizen. “He should know that Nigerians are the ones paying his health bills and therefore, he should tell them the true state of his health. “He should not treat Nigerians with levity and he should also know what is obtainable in civilised countries. Nigeria is not a jungle. “Imagine the President talking about a leave extension but not saying when he would resume?” Adeyeye stated that there was no way the President could claim to be awaiting the outcome of medical tests without definite dates. “Medical tests have dates of collection of results. It can’t be open-ended without dates,” he said. But the APC urged the PDP to join other well-meaning Nigerians to pray for the President instead of sensing an opportunity to get even. The National Publicity Secretary of the APC, Mallam Bolaji Abdullahi, said this in a telephone interview with one of our correspondents on Sunday. Abdullahi stated, “This is the President of the country. The elections are over; he is our President, he is the President of Nigeria not that of the APC or the PDP. If the President has told us that he needs to stay back to do some other medical things, it behoves us, as responsible citizens, to pray for him and stop sensing an opportunity to retaliate. “Does the PDP know more than what we have been told? What we know is what we have been told. “We believe that the President has demonstrated an acute sense of responsibility. We are all living witnesses to our recent history where a President travelled and did not even communicate to the National Assembly the appropriate document to make the then Vice-President act in his stead. “But this is a President that, on every occasion that he has to travel, he not only communicate to the National Assembly, but creates the enabling environment and the space for the Vice-President to act as President in his absence. “I don’t know why people will start going green in the eyes as if we are actually hoping that tragedy befalls this country. “The PDP should not behave in a way that will make Nigerians begin to think that it is actually spreading the rumour that the President is dead.” Also, the Catholic Bishop of Awka Diocese in Anambra State, Most Rev. Paulinus Ezeokafor, on Sunday, asked Buhari to show himself to Nigerians to douse the tension in the land. Ezeokafor, who spoke to journalists at the annual meeting with the Religious Council in the diocese at St. Patrick’s Cathedral, Awka, said it was normal that people asked questions about the health of their President as he was not a private citizen. The General Overseer of the Redeemed Christian Church of God, Worldwide, Pastor Enoch Adeboye, has said there is dearth of good leadership in the country, adding that the church is the worst hit. Adeboye explained that the problem of corruption in Nigeria was traceable to lack of contentment and greed. The cleric spoke on Wednesday in Ikeja, Lagos, during the Third Annual Birthday Public Lecture organised by the church to commemorate his 75th birthday. Adeboye, who was represented by his wife, Folu, expressed sadness at the lack of true leadership in the society, calling for a return to cultural values. He said, “Leadership is at the core of our problem in this nation. Some people sit in their room and comment on newspaper articles, but have you removed the log in your eyes? “If there is anywhere leadership should be recommended, it should be from the church. But it is unfortunate that the worst leadership is from the church. We should go and check ourselves. Are we in true leadership or we are in falsehood? Because this has been the groaning of my heart for many years and I pray about it fervently. “I challenge the leaders in this church that what the Bible says about elders, I have not seen it. But things are changing and I want us to be part of that change. “The problem of corruption which we have in this nation would not have been there if everybody is contented with what he or she has. But people love to do more than they have. They want to show off to their children, and the children also when they get to school or are with their colleagues, are not satisfied because they were not brought up to be satisfied.” Adeboye appealed to elders in the society to live in a way befitting of their status, adding that women should also train their children to positively influence their future. The guest speaker, Pastor Femi Atoyebi, who spoke on the theme, ‘Excellent Leadership in Pluralistic and Ethno-religious Society like Nigeria,’ lamented the decline in societal values and loss of respect for leadership and the constitution. Atoyebi, a Senior Advocate of Nigeria, called for a separation between the office of the Attorney General of the Federation and Minister of Justice in order to ensure that no one is above the law. He said, “As long as there is no procedure in place to enforce the law against whoever breaches it, there will continue to be impunity. Even if it is the President, if we have people that can stand up to him, then we will move forward. “I have always advocated a system where we have an independent attorney general. We can have an attorney general that stands for an election and canvasses for votes, promising to defend the constitution and enforce the law. If a president or governor makes a law that is not right, he goes to court to challenge it. “But as long as the President fills the office of the attorney general and that of minister of justice, things cannot move forward. The Federal Executive Council on Wednesday approved the revised National Tax Policy. The policy will see the Value Added Tax on luxury items, like champagne, increasing from the current five per cent, among other changes. The Minister of Finance, Mrs. Kemi Adeosun, disclosed this to State House correspondents at the end of a meeting of the council presided over by Acting President Yemi Osinbajo. She was joined at the press conference by the Minister of Information and Culture, Alhaji Lai Mohammed; and the Minister of State, Aviation, Hadi Sirika. The administration of former President Goodluck Jonathan had in 2014, while unveiling its austerity measures, identified some items that were to be taxed as luxury goods to include champagne, alcoholic beverages, private jets, luxury cars based on engine capacity, and yachts. It had estimated to generate about N480bn from taxes on luxury items in the 2015 fiscal period. Adeosun said while the implementation of the revised policy would take immediate effect, some aspects that required changes in law would be referred to the National Assembly for action. She said Nigeria was one of the countries with the lowest Gross Domestic Product tax ratio in the world, adding that non-payment of tax was one of the biggest factors that contributed to the nation’s current economic situation, hence the need for the revised policy. In implementing the new policy, the minister said the government would attempt to reduce the number of taxes with emphasis on indirect taxes, as well as centralising tax administration where possible. Adeosun said, “What the committee has shown is that we should look at actually increasing VAT on some luxury items. With VAT of five per cent, we have the lowest VAT. While we don’t think VAT should be increased on basic items, if you are going to drink champagne in the United Kingdom, the VAT is 20 per cent; so, why should it be five per cent in Nigeria? “So, they have made recommendations that we should pull out some luxury items and increase VAT on those items immediately. And I think that is a very valid and sensible suggestion, which we are going to talk to the National Assembly about to see how we can implement it. “But as far as basic goods are concerned, no. I believe it is only fair that when you consume luxury goods, you should pay a little bit more. The National Assembly will decide the percentage.” The minister said the objectives of the revised policy included to guide the operation and review of the tax system; provide the basis for future tax legislation and administration; provide clarity on the roles and responsibilities of stakeholders; and standard benchmark on which they would be held accountable. In implementing the policy, Adeosun stated that an office of tax simplification would be established; a tax policy implementation committee would be set up; only one revenue agency per level of government would be allowed; the Independent National Electoral Commission to mandate political parties to articulate their tax agenda during election campaigns; and the establishment of administrative framework for amnesty and whistle-blowing, among others. Others are to develop Key Performance Indicators for Nigeria to attain a top 50 on ease of paying taxes by 2020; creation of a dedicated tax policy website; setting aside a uniform day in the year as a National Tax Day; as well as the promulgation of an Act to establish the Joint Tax Board’s mandate beyond its current advisory role. The Anambra State Governor, Chief Willie Obiano on Wednesday described the Imo State Governor Owelle Rochas Okorocha as a shameless son who is spitting on his father’s grave. Obiano who spoke through his Senior Special Assistant on Media, Strategic Communication and Legislative Matters, Prince Oliver Okpala, called Okorocha “a Motor park governor.” He said the Imo governor had moral problem in fighting the All Progressives Grand Alliances that made him governor after several failed attempts in the past to be one. Obiano said ordinarily he would not have wasted his time in replying Okorocha’s tantrums but for the purpose of guiding the public aright. The statement read in part, “The attention of the Media Directorate of the Anambra State Governor, Chief Willie Obiano has been drawn to the gratuitous diatribe by a fellow South Eastern Governor, Rochas Okorocha of Imo State against his person and the government of Anambra State. “It is not in our tradition to respond to such issues but since silence in the face of such grave claims often amounts to guilt, we are therefore duty bound to make our position known to properly guide the public.” Okorocha had in a statement on Tuesday signed by his Chief Press Secretary, Sam Onwuemeodo described Obiano as “a clueless and aggressive governor who should have done better as a militant than as a governor”. Replying Obiano wondered what cluelessness meant to Okorocha if his ( Obiano’s) administration which “has dazzled Nigerians with superlative achievements would be referred to as clueless”. He said, “If a governor that has constructed countless number of roads and bridges, embarked on several rural electrification programmes, constructed uncountable number of schools, and health facilities as well as rid the entire Anambra State of crime and criminalities, is being termed clueless by Okorocha then there must be another meaning for cluelessness. “Okorocha is widely known for his questionable past which has continued to trail him despite his hogwash attempts to cover it up with a facade of his bogus but empty philanthropic activities. Many people have over time seen through his tricks. “Indeed Okorocha is an example of what a leader should not be. He talks of ideas when he cannot pay workers salaries and now tries to intimidate Imo retirees to forfeit 60 percent of their arrears of their sweat. “Are those the kind of ideas we need at this critical time? Those are destructive ideas, and a destructive idea cannot bring about constructive ends. “This is a Governor who has failed woefully to pay workers salaries. He is also heavily indebted to even pensioners who have spent their youth and strength to labour for the state, in their old age. “As Nigerians ruminate on this matter, the question should be asked: What was Okorocha before he became governor? The wife of a Lagos State socialite, identified only as Josephine, has been killed after sex romps with her boyfriend in a guesthouse in the Isheri Olofin area of the state. PUNCH Metro gathered that the victim had gone to the guesthouse with her boyfriend, Augustine Dunkwu last Tuesday around 2.30pm. He said, “They both had drinks in the guesthouse before going into the room where they had sex. It is possible that the man used drug or the woman was not strong enough to withstand the sex. She passed on during the romp.” The source said the police from the Idimu division took the corpse to a mortuary. Our correspondent gathered that the matter had been transferred to the State Criminal Investigation and Intelligence Department, Yaba. The state Police Public Relations Officer, SP Dolapo Badmos, said investigations were ongoing into the incident. She said, “We were told that on January 24, 2017, the suspect and the deceased lodged in a guesthouse. “The suspect later attempted to check out without his guest, prompting the receptionist to run after him. “He was taken back to his room where the lifeless body of his girlfriend was discovered without any sign of violence. “The corpse was removed and deposited in the Mainland General Hospital Mortuary, Yaba. A former Minister of State for Defence, Senator Musiliu Obanikoro, has returned a fresh sum of N30m to the Economic and Financial Crimes Commission, with a promise to pay a balance of N417m, The PUNCH can confirm. Calculations by our correspondent showed that the former minister has now returned N167m to the Federal Government. A reliable source told our correspondent that the former minister paid the money from his Diamond Bank account to the EFCC Recovered Funds Account. The source stated, “I can confirm that Senator Obanikoro has been meeting up his part of the agreement. You will recall that last year, he promised to return a certain amount of money every quarter. “He has made a payment of N30m, his first instalment in 2017. He is also reporting at the EFCC as he should.” The ex-minister, who returned to Nigeria in October 2016, after spending about 15 months in the United States, was accused of receiving N4.7bn from the Office of the National Security Adviser under the leadership of Col. Sambo Dasuki (retd.). Obanikoro had said in his statement of oath at the EFCC that after receiving the money in 2014, he gave N1.219bn to the then governorship candidate of the Peoples Democratic Party in Ekiti State, Mr. Ayodele Fayose, while N1.3bn was given to the PDP governorship candidate in Osun State, Senator Iyiola Omisore. He also confessed to giving Fayose a separate $5.377m at Spotless Hotel in Ekiti State in the presence of party stalwarts, including the then PDP state secretary, Mr. Tope Aluko. Obanikoro was said to have kept about N785m for himself, which he allegedly spent while campaigning ahead of the PDP governorship primary in Lagos State, which Mr. Jimi Agbaje won. However, the EFCC asked him to return about N584m, out of which he has returned N167m. At the Federal High Court in Abuja, presided over by Justice Nnamdi Dimgba, Mr. Alade Sunday, a manager at Zenith Bank, narrated how Obanikoro delivered about N1.219bn to Fayose’s aide, Abiodun Agbele, for onward transmission to Fayose. He had added that it took the cashiers about 10 days to count all the money. Sunday had said Obanikoro flew the cash to Akure airport and the money was loaded onto bullion vans. “When we got to the airport, we waited for some minutes before the aircraft arrived. When the aircraft offloaded its passengers, one of them appeared to me to be Senator Musiliu Obanikoro and the other one appeared to be his ADC, Adewale. “Agbele walked up to them and had a discussion with them. Thereafter, he signaled to me to bring the van. Bags loaded with cash were loaded into the van and Obanikoro’s ADC, I and Agbele drove back to the bank,” he had stated. 30-year-old club owner, Mike Eze-Nwalie Nwogu popularly known as ‘Pretty Mike’, has been arrested for dehumanizing young girls by turning them into human puppies with chains round their necks.
