Dear VO,

I have a few questions that maybe you can help me with. My husband and stepson I 130 was sent to the Embassy for processing. We have already updated the d260 and was wondering would the embassy be contacting him for further instructions? Or is there a step we need to take to make psychical, police clearance and interview apointment? Also on May 21st, 2019 my husbands I-601 waiver was approved. However, I did receive an email of this approval, but I did not receive the NOA with instructions on what to do next. Can you please give me some advice on what to do next or how to obtain the NOA. I kindly thank you in advance for any assistance you can give us.

Hi, IV/Officer my Stepson's I-130 application was sent back to The Department of State. for review. They requested for evidence . The USCIS received the response for evidence from me on 2/22/18 which states they will begin working on our case again. I was told it would be 7-9 months before we will hear an answer of the outcome. As of today we have not heard anything. I also was told I could not submit a case inquiry until the case is outside normal processing time. We have a little longer to submit an inquiry. Now his case is soon to expire due to the time frame of the case being reviewed. Our failure to pursue his visa application was due to circumstances beyond our control and noting that we still wish to pursue this visa petition. I sent an email to LagosIV@state.gov is there anything else I need to do while waiting on the outcome of the case. Thanks for your time and consideration into this matter. Look forward to hearing from you soon.

I am USC and looking for clarification. Thanks for your help in advance! Yesterday my 10-year-old stepson had his visa interview and company with his father. I applied for my husband and my stepson on the same petition I was told after many months waiting for I-.130 approval that my stepson would need his own petition which I did.
In December 2015 I received a letter from NVC which stated “The Immigration and Nationality Act (INA) does not allow derivative status to family members of immediate relatives. Means that meant I had to file a petition for my stepson. Which I did.
Both my husband and my son I-130 was approved. However, my husband needs to have a waiver under which I submitted in June of 2016 and still waiting for the process. However, I was told that my husband case would not affect the outcome of my stepson case.
Today it seems that my stepson was not given a visa because of his father case. My stepson and I have a relationship for many years. I am his stepmother and I would like for my stepson to come without his father. Rather his father’s waiver is approved or denied he is my stepson and that is a part of The Immigration and Nationality Act (INA). Is there a law that states parent’s waiver need to be approved before children can be approved for a visa?
Or Was I given the wrong information and stepson should have been a derivative on his father petition?
On the letter, there is no Name or case# from the consulate that was given to my husband.

Hi I have 2 questions. I am a USC married to my husband who is Nigerian. In November we will celebrate 2 years of marriage. I filed a I-130 petition for my husband and my stepson who was added as a Derivative. During this process I was told that I could add my stepson to my husband I-130. Now that our case is in the NVC process and financial documents is reviewed. We are waiting on an interview date. I received a letter stating my Stepson does not qualify for Derivative Benefits. So now I filed a separate petition for my stepson and has been excepted to the USCI as of 10/14/2015. My question are as follow (1) Is there anyway my stepson petition can reach my husband petition. Waiting another 2 years or more is very sad to me. huh Also I have never did this process before and not knowing the in's and outs I reached out to the USCI service center and asked questions which I was told several times different answers but was a surged this was the correct way to file for my husband and stepson. (2) And if my stepson petition will not reach my husbands petition to travel together how long before a Visa expire . My husband and I agree my stepson will not be left behind we are a family and we will come together as one.

Good day! my husband and I are looking for guidance. My husband and are on the last step of waiting for the NVC to give us a date for an interview on a family base visa. Back in 2008 my husband was denied a visitor visa for misrepresentation which I believe we would need a wavier. My question is can we file a i-601 now or do we need to wait for instruction form the consulate? please advise us. Thank you and have a blessed day. Hugs smiley

I need your assistance. My husband and I have been trying to figure out how to fill out the DS-260 and how to make a payment Visa payment. I trying calling The NVC and Lagos Consulate office with no success. Can you please help us get pass step #3 huh

Hello long time I been on this thread. Hope everything is well. I have many questions. I have a very important question that I hope you can guild me in the right direction. I filed a I-130 for my husband and a I-129f for my husband and stepson. We received an approval on both petitions. Can the I-129f process before the I-130. My husband recevied letter . It is very hard to talk to someone to ask any questions answered at the NVC due to high call volume. Can please help me understand which petition this letter is for Case# LGS2015583015. Anything that you can guide us on is greatly appreciated. Thank You

Thank you for all you do here! I read your post and really appreciate your kindness. I am a USA citizen I got married in Nigeria November 2013 and filed the I-130 and a I-129F for my husband and stepson in April 2014 which is still in the Initial Review. undecided. As the New year approaches I have some concerns about my name change. When filing these forms I used my husband last name and then went to change my name . However when I went change my drivers license and social security card I was told I need the original marriage license to do so. My husband has the original in Nigeria awaiting for the approval and the interview. Would this cause a problem with my petitions? I called the service center but they only give me status to my case. undecided If I had knew it would be a lengthy wait time I could of had the original and sent back to my husband many times smiley. Not to mention I am afraid that it may get lost in the mail .I don't know how I can change name without this document do you any suggestions? It is also need for Work, medical and life insurance.

Hello I am glad to see you have returned. I am a US Citizen married to a Nigerian. My question is about Tax Documents from the quote above these documents is the bases of your decision. I have been working for the same employer for over 9 years. However all my income does not come from the employer. I have child support. I also have nontaxable income, and a second job that I started this year. My question is does the nontaxable income count and if I can use my second job income. Thanks in advance for your response.
