How Does a Total Loss Insurance Claim Work?



Introduction

It's best to learn how a total loss insurance claim works before a total loss. Many individuals find out too late that their policy is inadequate for their needs. A little pre-planning can prevent a policyholder from having to reach into her pocket to makeup the difference between the insurance claim check and the cost to replace an improperly insured item.
Valuation Clause
Before an insurance company can pay for a total loss they must determine how they will come up with the value of the property or vehicle. The insurance company refers to the valuation clause for this determination.

The valuation clause describes how the property is valued in the event of a loss. The two most commonly used valuation clause definitions are actual cash value (ACV) and replacement cost.

A policy with an actual cash value valuation clause determines the amount of a total loss by calculating the amount it costs to repair or replace the item at the time of the loss and then subtracts the applicable depreciation. Therefore, when the insured receives the check for the total loss, they will be unable to replace the item unless they pay the depreciation expense out of pocket.

Replacement cost valuation on the other hand, pays the policyholder the amount it costs to repair or replace the item with one of similar kind or quality. The insured is made whole and will not have to reach into her pocket for the depreciation differential.
Total Loss and Deductible
Whether the policy has a replacement cost or actual cash value valuation, in the event of a total loss, the policy deductible applies. Therefore, if a person totaled a brand new car insured by an insurance policy on a replacement cost valuation, although the insurance company will pay for the full value of the car, they must deduct the amount indicated in the deductible portion of the policy. Thus, a policyholder insuring a car valued at $30,000 with a $1,000 deductible on a replacement cost valuation, would receive a check in the amount of $29,000 in the event of a total loss.
Title and Ownership
When an insurance company and policyholder agree upon a total loss, the title, or ownership of the damaged property is signed over to the insurance company. In essence, using the above example, the insurance company paid $29,000 to own the rights to the damaged vehicle.
Check Payee
It's important to ensure the correct payee information on an insurance policy. In the event of a total loss, the check is made out to the policyholder and the company or individual listed on the Loss Payee or Lien Holder endorsement. Therefore, if the outstanding loan for the insured vehicle is completely paid off, remove the lien holder from the policy immediately.

There are a few variations, but simply: If the cost of repairing the vehicle, plus its salvage value, plus rental reimbursment expense during repair equals or exceeds its actual cash value, it is not economically feasible to repair. This situation is commonly referred to as a "total loss."

A total loss is usually not a good situation even if you hate your car. If you don't agree with the "total loss" determination you typically can get an independent appraisal of the damage (at your expense).

Some companies consider a damaged vehicle a total loss when the total cost to repair it exceeds just 51 percent of the vehicle's actual cash value (because of added storage costs, rental car, etc.), while others don't consider it a total loss until it is at 80% of the ACV.

Add comments of your situation, as insurance companies and adjusters vary in their determination. For example, a new car may be closer to 50% of ACV while an older car may be 90% of ACV before distinguishing it as a total loss. We have also seen some situations that are the opposite.



PART B


Total Loss - Write Off


Unfortunately there are times when a car that has been involved in a shunt will be beyond economical repair. This is commonly referred to as a car being written off (or the car is a write-off) or a total loss (also known as an insurance total loss). Apparently over 1000 cars are written off every day.
Salvage Categories

Once a vehicle is written off it is classed as salvage. There are several categories of salvage. In summary the categories are as follows:

Category A - the entire vehicle must be crushed.

Category B - the vehicle may be broken for parts but it must never be returned to the road.

Category C - possible structural damage but the vehicle is repairable. The cost of the damage would have been more than the book value of the car if that repairs were carried out at garage prices and official manufacturers parts.

Category D - most likely to be nonstructural damage and should be relatively easily repairable. In this case the vehicle may have been economical to repair but for other reasons it was written off. For example where the insurer have to provide a courtesy car the time taken to repair the vehicle would mean that the courtesy car cost together with the repair cost would be excessive. In a category D scenario it is more likely that the insurer did not wish to repair.

Category X - this is minor damage and easily repairable.

What about "not recorded" accident damaged cars? These have usually not been through the insurance system and as such will most probably be where the owner was not able to claim for the loss due to their insurance cover (i.e. they have crashed it themselves or they suffered a hit-and-run and were only insured third-party or third party fire and theft).
Insurance Settlement

If you are faced with a total loss situation you will want to maximise the compensation you are paid. This will of course be at odds with what the insurance company would like, that being to minimise their loss. You will most probably find that the first offer you are made for your vehicle will not be to your satisfaction. This is an area where it gets complicated. For a start it is very likely that your opinion of your vehicle prior to the accident will be slightly different to what the insurers believe the condition was. It will be very difficult to prove that your vehicle was in a pristine condition in any case!

i thought that over and over and over again this issue of salvage had been discussed on this forum

please wwheelz define the term "Salvage Title","Total Loss"

cause it seems you just going round and round on one issue,when there is no issue!

LETS PUT THINGS STRAIGHT,IF A DEALER PROVIDES A VIN ON A CAR HE/SHE WANTS TO SELLER,THNE THAT ALONE IS HONESTY.

The rules on this forum is simple and does not need an explanation, ALL POSTS SHOULD COME WITH A VIN!

AND IF THAT IS DONE THEN WHATS THE NOISE FOR

Is there a case of "WAYO" if VIN is provided?

If a buyer needs a car the best he can do is to get quotes/vin reports from as many dealers as he wants,and then make his/her choice.

Even in the US salvage cars are not sold at the same price,even if it is rolled over!!!

For a buyer you have to be able to negotiate,haggle,price and get a good deal if you think the car is not worth up to the said amount.

How many dealers here import their own cars personally??most of the dealers here if not all sell from the "street" that is not wrong,but i agree with you a little Mr wwheelz,negligence is not an excuse,if you go to the pains of taking pictures and also the agony of uploading the pics,then try go through putting up a report just to show a difference.Be a proper SALESMAN! be innovative and provide full report for your clients that makes a Difference! But lets not castigate anyone or try to make a seller look dubious,lets be constructive and try to write our words out in a manner that does not look as if we are trying to make good look bad and bad look worse.

My proposition would be that when an advert is posted and the seller have included the vin# of the car,if on checking the vin report of the vehicle we notice a discrepancy on the vin report and the seller's advert,I think the first point of call should be to email the seller on the discrepancy and give him or her a chance to rectify it before bringing it to the open forum.
I believe it is a good thing to protect the buyer but at the same time we should not do it in a way to pull down the seller's business.Please let us be our brother's keeper and go about correcting each other in an atmosphere of love and mutual respect.
