Dear Visa Officer,
i was wondering if you can help me, i am british citizen travelled to us twice.Last time I've travelled with my wife she was 4 months pregnant and hold B1/B2 vis for 5 years, we meant to stay for 3 months because on vwp i was given 3 months and she was stamped in for 6 months. We decided to have our baby in us so I've emailed CBP and explain them that my wife is pregnant so i will have to travel back to Us is it any restrictions which is preventing me to travel back to US on VWP.I was given response i can travel on my vwp as long as its less than 90 days however final decision would be an discretion of an immigration officer at port. So i have travelled back to US and i was interrogated at the airport for hours and hours and sent back to U.K.CBP officer claimed its illegal to have baby in us.I have tried to convince him that under B2 provision its legal but he was kept on saying No.I spoke to his Supervisor who said ofcourse it is legal as long as i can afford to pay.I said i have 15000 USD in my account and 4000 dollars cash.Delivery only cost 5500 USD.I was honest with them and i was treated really badly at us airport for been honest with them, when I've shown him email response he laughed at my face and said it does not mean anything, he wouldn't even let me speak to his supervisor, i went an approach supervisor myself he was kept on interrupting while i was talking to his supervisor, he wrote on my passport 212 A I i can no longer use vwp and i have to get visa overtime i travel to US from now on.My wife didnt want have baby without me so she returned.I was wondering what can i do now.I was trying to do everything by the book. Can you kindly help.
Many thanks

Just to share my story, I have left usa on 16th of April and travelled back on 20th of April, I have informed CBP due to my wife's pregnancy she can't travel back and she has 6 months entry she can get medical treatment as long as I am paying for it.

They have sent me to a room officer called my name and started shouting at me saying I know f.....g game this and that I told him I have emailed you guys he didn't wanna hear noting they have held me at Houston airport for 27 hours. Been shouted and humiliated and I'm the end they have sent me back so be careful guys. the reason I am sharing my story because I am devastated, I was just honest with them and what I got for been honest.CBP officer said its illegal to have baby in USA he was obviously lying one after another I was treated like an criminal at Houston Airport and in the end sent back.May god bless you all.

Try Dr Jeanie Huynh at West Houston Medical Center. Her fee is 2000 whether vaginal or c section. Her email obgynh@yahoo.com. Be patient cuz they only reply emails on Tuesdays and Thursdays.

Thanks ever so much.I really appreciate your help.

I was wondering if someone can shed some light on this. I am on esta and I was given 90 days entry which is up on 22/04/2015 I would leaving USA on 16th, I have mailed them because my wife is 8 months pregnant she could not travel, because she has 6 months entry because she has b1/b2 visa. I have to travel back to take care of her, I have explained the situation, and asked them if I can travel straight back.thats the reply I had back from them.

o check the status of, print the status, update your application, update travel details, or make a payment, or receive a payment receipt, simply log back into the web site and submit the required information under the “Retrieve Application” section on the right hand side of the application. You will be asked to provide your application number, passport number, and date of birth. At this time, travel details, flight details, and the in transit field do not have to be updated. If you have an approved ESTA, you can travel to the US for less than 90 days - multiple trips. However, ESTA does not guarantee entry. You can be denied entry with an approved ESTA because it is up to the officer at the border to determine admissibility. According to U.S. Immigration Law, every alien shall be presumed to be an immigrant until they establish to the satisfaction of the CBP Officer, at the time of application for admission, that they are entitled to a nonimmigrant status. Therefore, the key is that the applicant always bears the burden of proof of admissibility that he/she is not trying to live in the U.S.
Any comment would be much appreciated, according to there email there is black and white rule which prevents me to travel back.
What do you guys think.
Regards
Rizwan

It's not high risk, I hope not, In sh Allah it would be straightforward delievery but I emailed them saying she is pregnant so she would give birth in usa which is legal. We came here on 22/01/2015 she is due anytime after mid May.

Please can anyone help me with doctor and hospital email and charges in houston within houston.

I am on vwp I have been granted 90 days but my wife has b1/b2 visa so she has been granted 6 months.i will be going back to UK for a week and come back after a week on vwp esta which is valid until 2016.anyone in similar situation travelled back and forth.i have emailed cbp explain them that due to wife's pregnancy I have to come back they have replied I am allowed multiple travel on my esta however it's officers discretion to determine purpose of my visit.i was thinking to carry my wife's pregnancy report and ultrasound report.any advise would be much appreciated.

Hi mate, I am british citizen your kid is british by decent regardless of where they born unless citizenship was earned decent, if british citizenship was acquired by decent yo can still apply to register your kids for british nationality if you have lived in UK for 3 years prior to your baby is born outside UK.If born in uk than no registration required.I am in the similar situation in terms of my wife will be giving birth in usa, because they are making it really strict for spouse visa so I thought since she has b1/b2 visa she can travel to usa and my kids will be dual national British American. As a british we don't need visa to come to usa as long as it's less than 90 days you can apply for visa waivier esta which only cost you 14 US dollars which is around 8 pounds.

It would be better once your wife gives birth register your child as british national through registration process, or instead you can apply for right of abode for your kid and apply for passport within UK, it would be easier that way.
Kind regards
Rizwan
British citizenship is not transferable to the 3rd generation if it was obtained from a parent who is a citizen.

However, the child doesn't have any benefit in terms of citizenship, the mother's bills are covered under NHS.
The child would have to remain in the UK for a minimum of 10 years or more to obtain his/her citizenship
