Chinese pharmaceutical exports are safe, a senior official said Tuesday, dismissing media reports that the country was a major exporter of fake or shoddy drugs as "sensational."

"I cannot agree with some foreign media allegations that China has become a major exporter of fake drugs," Bian Zhenjia, deputy commissioner of the State Food and Drug Administration, or SFDA, told reporters.

Bian was asked during a press briefing to comment on reports of Chinese-made counterfeit pharmaceutical products being exported overseas.

"If foreign manufacturers and distributors purchase drug substances and formulas from one of China's 4,708 pharmaceutical producers, there would not be any quality problem," he said.

"Their products are safe," he added.

In January, London-based newspaper The Observer reported that Chinese drug counterfeiters were producing copies of the world's best-selling pharmaceuticals.

The report said those drug pirates managed to sell an estimated eight million fake pills to the U.K. healthcare system in 2008.

But Bian denied the allegations, saying an investigation by U.K. authorities had proved the report was wrong.

"There should be no more sensational tactics or attacks," he said.

However, he conceded that some illegal Chinese companies could be involved in producing fake drugs but didn't elaborate.

Bian pledged China would work jointly with other countries to combat counterfeit drugs and called for overseas authorities to notify Beijing of any fake or substandard pharmaceuticals suspected to have been made in China.

"We will resolutely crack down on fake and substandard drugs made in China no matter whether they are found in the country or abroad," he said.

Bans and recalls of drug products are common in China due to widespread safety problems in the nation's chaotic, under-regulated and sometimes corrupt health industry.

The former head of the SFDA, Zheng Xiaoyu, was executed in 2007 for taking bribes in exchange for product safety licenses.

In another recent scandal, Chinese-made herbal remedies killed at least four people in October last year.

The Chinese Ambassador to Nigeria, Xu Jianguo has called on the Nigerian Customs Service, the Standard Organisation of Nigeria and other relevant authorities to work with China in its effort to curb the influx of fake products from China to Nigeria.

Jianguo also lamented that contrary to popular beliefs, it was easier for Nigerians to get Chinese visas than it is for Chinese to get visa to Nigeria. He however stated that his country was talking to relevant authorities on the issue as it could be an impediment to the development of business ties between both nations.

Speaking with THISDAY at the opening ceremony of the Photo Exhibition on achievements of follow-up actions of the Beijing Summit on the Forum on China-Africa Cooperation in Abuja yesterday, Xu reiterated that the influx of fake products was due to the activities of corrupt business men; both Nigerian and Chinese who produced sub-standard products to cut costs.
“China has a lot of standard products which are of high quality because we have a production standard. This is a very complicated problem and it involves illegal business men who produce and sell sub-standard products. We hope that Nigerian relevant agencies would work together with their counterparts in China to curb this problem” he said.

Xu also lamented that it was harder for Chinese to get visa into Nigeria; as according to him, the Chinese Consular in Lagos has issued over 40,000 visas in 2009 alone, while less than 10,000 have gotten Nigerian visas.

Although, he could not provide any reason for this development, he said his country was in talk with relevant Nigerian authorities to enhance business ties between both countries. But less 10,000 Chinese have gotten visa to come here but we have reached out to the relevant authorities. . We welcome the exchange of citizens between both countries especially with the business ties which exist between us. We ask citizens of both nations, when visiting each other to obey the law of the locales” he added.

Following cases of importation of unwholesome drugs into Nigeria by Chinese companies, China has formally apologised for flooding the country with such harmful products.
The development followed intensified efforts and whistle stop campaigns by the National Agency for Food and Drug Administration and Control (NAFDAC) in India, China and the United States among other countries to drum up support and seek strategic alliances for its campaign against unwholesome drugs.

Rendering his apology in Abuja, Chinese Ambassador to Nigeria, Mr. Rong Yansong, who noted that Nigeria was the country’s most important trade partner in Africa, regretted the importation of fake drugs into the country by some Chinese nationals.
Speaking at a meeting of global coalition partners against fake drugs manufacture, importation and exportation in Abuja, the envoy apologised for his country’s involvement in the illicit trade.
“I wish to use this opportunity to apologise to Nigeria for the importation of such products into the country by Chinese firms.

The Chinese government would ensure the punishment of fake drug exporters from China into Nigeria, just like those already in their custody would be dealt with according to the law”, he said. In June, the Dr Paul Orhii-led agency announced it had detected a large consignment of anti-malaria drugs from China, which had been labelled “Made in India”, being sold in the country.
The discovery had snowballed into a diplomatic row with the Indian government lodging a strong protest with the Chinese authorities.

“It was an unfortunate incident, but it has opened up a lot of opportunities in fight against counterfeits, with the Indian government involved as it has interests in the issue,” NAFDAC DG said.
Orhii had embarked on a five-day visit to hold talks with the Indian government and visit pharmaceutical factories in Delhi, Ahmedabad, Pune and Mumbai.

He said the suspect drugs were declared counterfeit only after laboratory tests.“The packaging was very sophisticated and on its physical scrutiny, it looked genuine. But after laboratory analysis we found there were no active ingredients. If it had remained undetected, it could have created resistant strains of malaria,” Ohri added.The Chinese government, he said, had reacted by asking for “more information” and “promised to conduct its own investigation”.“We have learnt that they have identified about 50 (Chinese) companies that are involved in this syndicate,” Orhii said.Orhii, however, maintained that there was still the need to conduct a public information campaign about Indian products coming to Nigeria.He also said his organisation had already taken steps to be more “vigilant” to detect counterfeit drugs at the ports of entry itself.Incidentally, China and India are the top exporters of drugs to Nigeria, where foreign-made pharmaceuticals account for 60 percent of drugs in the market.Going by a draft bill before the Indian parliament, exporters of unwholesome products risk life jail, should it be passed into law. Similarly, any Nigerian drug importer who connives with an Indian drug company to produce fake drugs would also be jailed for life upon conviction.NAFDAC on its own had also proposed stiffer penalties for fake drug exporters and manufacturers in Nigeria which would be presented to the National Assembly

The NAFDAC boss had said recently that the biggest problem facing the agency was the issue of counterfeiting which was reduced to 16 per cent during the reign of Professor Dora Akunyili as head of the agency.“One of our biggest problems is counterfeiting which was reduced to 16 per cent during the time of my predecessor. Even 16 per cent is not enough. We want to take it to international standard”, he said. The recently inaugurated Board of the National Agency for Food Drugs, Administration and Control also expressed its determination to reduce incidences of fake and substandard drugs within six months. Chairman of the board, Dr. Philip Emefo, said the agency was ready to partner with the National Assembly in strengthening the existing laws regulating the activities of the agency.

For years, HP could afford to ignore the problem. The worldwide ink market grew from $11 billion a decade ago to about $45 billion last year. And the profit margins on replacement ink ran as high as 60%. Counterfeits were an annoying problem, but HP spent more energy trying to thwart companies that made legal, low-cost alternative inks that were compatible with its printers. Counterfeit ink was so low a priority that earlier in the decade HP dropped out of the Imaging Supplies Coalition, the industry trade group that publicizes the issue and counts Canon, Xerox, and Toshiba as members.


CARTRIDGE SLEUTHS

Times have changed, however, and HP rejoined the group in March. As financial firms go bust and thousands of workers lose their jobs, people are printing fewer pages--and using less ink. IDC predicts the number of printed pages will decline for the first time this year, to 1. 47 trillion pages, from 1. 5 trillion in 2008. At the same time, counterfeiting has grown to the point that one in 20 ink cartridges sitting on store shelves globally is suspected of being fake. Now HP, Samsung, and others are hiring teams of private investigators and setting up forensic labs around the world to analyze suspect ink and packaging. They take their findings to law enforcement to help nab big distributors of counterfeit ink supplies. "Stemming the flow of counterfeits has become an absolute priority," says IDC analyst Jake Wang.

In the North Carolina case, HP's Anti-Counterfeiting Force swung into action. Peter Hunt, the group's Singapore-based director, dispatched one of his 12 investigators to examine pallets of ink in the reseller's warehouse. Then they worked with North Carolina authorities to set up a sting operation Noun 1. sting operation - a complicated confidence game planned and executed with great care (especially an operation implemented by undercover agents to apprehend criminals) . Within weeks, a local man was charged with selling counterfeit HP, Samsung, and Canon toner and ink cartridges via his Web site. Some $60,000 in fake goods was seized. HP scored its biggest antipiracy success in May 2007 in Foshan City, China. After tracking illicit supplies for more than six months, the company worked with Chinese police to raid 14 warehouses, seizing $88 million in equipment, supplies, and packaging materials from a variety of manufacturers. Two men were convicted this year and sent to jail.

Ink counterfeiters have developed techniques to throw off investigators. One approach: They sell supplies only slightly below the usual cost, unlike knockoffs of, say, Rolex watches. The North Carolina reseller says that's why she wasn't concerned. "Who would think they'd be selling ink for a 500% markup (text) markup - In computerised document preparation, a method of adding information to the text indicating the logical components of a document, or instructions for layout of the text on the page or other information which can be interpreted by some automatic system. ?" she asks.

The formation of the SCAP National Leadership Group is critical to building awareness, strengthening SCAP statements to the media, adding weight to interventions with inter-governmental organizations, amplifying the lobby effort with the three arms of government, and generating the core financial resources for the national SCAP initiative.
Participants:
CEO’s, senior corporate officers of companies and individuals lending their name (and participation as appropriate) and representatives from the local chambers of commerce as well as non-governmental organisations.
Responsibilities:
• Lend name in support of SCAP.
• As appropriate and convenient, CEO’s in the SCAP National Leadership Group would be invited/encouraged to accept high-level media interviews and prominent speaking engagements,
• Nominate a representative to the SCAP Steering Committee.
• Option to send senior representative to SCAP NLG meetings.
• Contribute toward financing core SCAP activities, including development and deployment of SCAP products and publicity, and outreach activities.

SCAP STEERING COMMITTEE
The Steering Committee brings expertise and a wide, cross-sector approach to the SCAP initiative. It establishes SCAP implementation priorities and strategy to deliver value to, and leverage the ongoing efforts of, companies and associations working nationwide against counterfeiting and piracy.
Participants:
Representatives appointed by members of the National Leadership Group; and select non-governmental organizations and representative of regulatory bodies.
Responsibilities:
• Provide policy and issue expertise and guidance on SCAP operations, including implementation priorities and strategy.
• Shape the SCAP message and program direction

As a SCAP member (Brand defender, consumer protector), you will enjoy the following benefits:
 One legal notice will be sent to the Opposite Party free of charge.
 Preparation of case papers at highly subsidized charges.
 Help and guidance to attend the hearings in court.
 Preparation of case papers like rejoinder, affidavit, written arguments, etc. to file during the proceedings at subsidized charges.
 Help and support to your consumer issues.
 Help to settle the matter out of court through peaceful means.
 Guidance to prepare and file complaint in other competent courts.
SCAP,  is a Private Public Partnership Initiative which is open to agents of government, corporate bodies, or anyone who is passionate about countering counterfeiters. We manage to give fearless and excellent services to our members as we are not under anyone's obligation. 
Identity cards are not issued to members. Identity cards are however issued to those members who prove their useful association with us, or who have proven track record of recent involvement in social services especially in the fight against counterfeiting and piracy.
Application for Membership:
Membership request may be sent by surface mail (copy by e-mail) providing the following details in a separate sheet of paper:
1) Your name and full address.
2) Your e-mail address, telephone number and date of birth.
3) Your profession, designation and name of office (if employed).
4) Your reason for wanting to join the SCAP initiative.
5) Propose at least two (2) measures that can improve IPR issues in Nigeria.
