Busola Dakolo, Biodun Fatoyinbo Eniola Akinkuotu, Abuja A Federal Capital Territory High Court sitting in Bwari has dismissed a suit filed by photographer, Busola Dakolo, against the Senior Pastor of the Commonwealth of Zion Assembly, Pastor Biodun Fatoyinbo. The court also ordered Busola to pay N1m for wasting the court’s time. In a suit, filed by Busola, wife of Musician, Timi Dakolo, in September, she had accused Fatoyinbo of rape, adding that the alleged action of the pastor, as well as his denial in a statement adversely, affected her marital sex life. She, therefore, demanded “a personal letter of apology” from the cleric to show honest remorse for his misdeeds. Fatoyinbo’s lawyer, Alex Iziyon (SAN), however, argued that the prayer could not be granted, describing it as a frivolous suit. In his ruling, Justice Oathman Musa held that the matter amounts to injustice and an abuse of judicial process adding that the case is empty and purely sentimental. Justice Musa said that the case was aimed more at cruelty than obtaining justice. The court also awarded costs of N1m against Busola Dakolo and held that the fine should have been 10 times more because the court’s time was wasted. In her suit, which was filed on her behalf by her lawyer, Pelumi Olajengbesi and Co of Law corridor, Mrs Dakolo asked the court to declare that Fatoyinbo’s denial of his alleged acts contained jointly and/or severally through a press statement he released on June 28, 2019, had caused her continuous emotional distress and amounted to intentional infliction of emotional distress on her. Olajengbesi said, “The claimant avers that she was immediately terrified and in shock while the defendant pinned her down on the couch following which he caressed her body, fondled her breasts, pulled her pants, quickly half-pulled his trousers and ordered her to allow him to have his way with her. “The claimant avers that the defendant in the process used his hand to cover her mouth, thereby muffling her screams. The claimant avers that the defendant made efforts to penetrate her vagina, whilst she struggled to fight him off; however, the defendant overpowered her and penetrated her vagina and had sexual intercourse with her. “The claimant avers that while she was in shock of the incident which had rendered her befuddled and mortified, the defendant rushed out of the living room area of her family home and briefly returned with a bottle of soda (Krest) which he forced down her throat thereby making her breathing difficult.” Meanwhile, the Nigeria Police Force says the probe into the allegation of rape against Fatoyinbo is slow because the alleged crime took place 20 years ago. The Force Public Relations Officer, Frank Mba, said this during an interview with PUNCH. Mba said the matter was being investigated but the police would not be pushed into filing charges for the fun of it. Refineries’ loss The heavy losses were as a result of the lacklustre financial performance of majority of the NNPC subsidiaries in the eight-month period, especially the refineries and retail subsidiaries. Particularly, Kaduna, Port Harcourt and Warri refineries companies posted a combined loss of N48.92 billion, while NNPC Retail and PPMC recorded a combined loss of N275.16 billion. Further analysis of the operation of strategic business units showed that Kaduna Refinery and Petrochemical Company Limited posted a loss of N21.90 billion; Port Harcourt Refining Company recorded a loss of N15.1 billion, while Warri Refinery and Petrochemical Company lost N12.62 billion. NNPC Retail posted a loss of N3.679 billion, while the PPMC recorded N278.837 billion loss. On the other hand, Nigerian Petroleum Development Company, NPDC; Integrated Data Services Limited, IDSL; Nigeria Engineering and Technical Company Limited, NETCO and Nigerian Gas Company, NGC, posted profits of N50.995 billion, N2.934 billion, N544 million and N19.239 billion, respectively. In its explanations, NNPC stated that 73 percent year-to-date NNPC deficit of N378 billion was accounted for by the PPMC deficit of N278 billion. It disclosed that PPMC deficit mainly comprised claimable subsidy of N231 billion, which represented 82 percent of the subsidiaries’ deficit and its claimable pipeline repairs/management cost of N69 billion and also crude product losses of N45 billion due to vandalized pipelines. NNPC further stated that N723.82 billion for domestic crude oil and gas sales proceeds was paid to the Federation Account from January to August. The report said: “Total US dollar payment to the Federation from sales of export crude oil, gas and NLNG feedstock for the month of August was $225.7 million. “Crude oil export sales contributed $108.9 million, that is 48 percent of the dollar payment, compared with 76 percent contribution in previous month of July, while export gas sales and NLNG feedstock accounted for $99.65 million, that is 44 percent contribution compared with 23.7 percent contribution in the prior month of July. “The remaining $16.8 million was attributable to other dollar denominated receipts by the corporation. US Vows To Force Nigeria To Legalize Same -Sex Marriage By GODWIN OTABONO The US Assistant Secretary of State for African Affairs, Linda Thomas-Greenfield, has stated that they would continue to pressurize Nigeria until it legalizes same sex marriage. Thomas-Greenfield made this know during a live-web chat with journalists in Washington. The God’s Own country recently legalized gay marriage, a development, which sparked global condemnations. According to her, America was not bothered that Chinese companies were fast taking over the African market from their US counterparts. President Muhammadu Buhari is expected to visit the country in few weeks time. Thomas-Greenfield, who said the US had adopted the protection of the rights of same-sex people as part of its foreign policies, vowed that Washington would continue to mount and sustain pressure on Nigeria and other countries to reverse their laws against the Lesbian, Gay, Bisexual, and Transgender community. She said, “As a government, it is one of the highest priorities and strongest values that discrimination against anyone based on their sexual orientation and gender identity is wrong. We believe human rights should be available to everybody. “As a policy, we will continue to press the government of Nigeria as well as other governments who have provided legislation that discriminate against the LGBT community.” Thomas-Greenfiled, who did not agree that pressuring Nigeria to reverse the anti-gay law amounted to interference, said the country and Uganda had the hardest legislation on the gay community. She said, “This is very much a work in progress, but I think you will agree with me that the law in Nigeria really went far in discriminating against this community but also people who associate with them. “So we will continue to press the government, to press the legislature to change these laws and provide human rights for all Nigerian people regardless of their sexual orientation.” Thomas-Greenfield was optimistic that the U.S would win the fight to protect the LGBT community. She said, “With what is happening in the US, you can determine how far we are willing to go. We strongly believe human rights for all people and we are particularly opposed to legislation that actually targets the gay community for discrimination. So we are prepared to push this as a policy not just in Africa but across the world,” she added. |
