A Lagos-based lawyer, Mr Olukoya Ogungbeje, on Tuesday filed a suit in a Federal High Court, Lagos, seeking an order to stop further inquest into the collapsed Synagogue Church building.

On September 12, a six-storey building within the premises of Synagogue Church of All Nations collapsed in Lagos.

The incident led to the death of over 100 people, most of whom were foreigners.

The Lagos State Government on September 26, constituted a Coroner’s Court to unravel the circumstances leading to the incident.

A magistrate, Mr Oyetade Komolafe, was appointed Coroner.

The coroner has already visited the scene of the incident and summoned the General Overseer of the Church, Prophet T.B Joshua, to appear before him on November 5.

Meanwhile, Ogungbeje, in the suit, is seeking an order stopping further inquest into the matter.

The defendants in the suit are Lagos State Government, Attorney-General of Lagos State, Mr Ade Ipaye, and Komolafe.

The lawyer said the composition of the Coroner’s Court was a negation of the principle of natural justice and Section 36 of the Constitution, and as such, unconstitutional and void.

He averred that the inquest was constituted by the Lagos State Government after the agencies of the state government had indicted the church of erecting additional structures on an already existing building without approval.

Ogungbeje argued that if allowed to continue, the proceedings of the Coroner would occasion a miscarriage of justice, as the same Coroner would base its decision on the testimonies of the same agencies of Lagos State.

The lawyer alleged that the Lagos State Emergency Agency (LASEMA), the Lagos State Building Control Agency and the Lagos State Fire Service, had made prejudicial reports that the building collapsed due to additional structures.

He averred that the contention of the church that the building collapsed as a result of an aircraft hovering round the building moments before it collapsed was ignored.

Ogungbeje averred that the Lagos State Building Control Agency went ahead to seal up the main building of the church.

The lawyer is therefore, seeking an order nullifying the composition of the Coroner and the proceedings so far, as well as an order of perpetual injunction, restraining the defendants jointly and severally from further proceedings.

He wants every sitting, investigation, fact finding or any action in any manner whatsoever on any facts connected to the case, to be put on hold until the suit was determined.

The suit which was filed on Tuesday has yet to be assigned.

The Federal Government of Nigeria is suing Coca-Cola and Nigerian Bottling Company (NBC), over alleged failure to comply with Consumer Protection Council (CPC) orders over two half-empty cans of Sprite.

The lawsuits follow a consumer complaint, which ended in investigation into the half-filled cans of Sprite bought at a supermarket in Abuja.

The case was brought to the Federal High Court in Abuja against Coca-Cola Nigeria and its chief executive as well as the Nigerian Bottling Company and its managing director for criminal breach of the Consumer Protection Act.

Both firms stand accused of “deliberately failing, refusing and/or neglecting to comply” with orders over the inspection of their manufacturing processes.

Individuals responsible could face up to five years in prison.

CPC added that during its investigation half-filled cans continued to evaporate. CPC concluded that the Sprite situation in Nigeria poses a threat to public health.

Back in February the CPC issued a statement to Coca-Cola, arguing that Nigeria was not a “dumping ground for substandard products,” adding that it has been overwhelmed with complaints against the company, including rusty cans, rusty bottle tops and foreign objects found in the soft drinks.

CPC also filed an additional charge against both companies for refusing to appear before the council “in relation to investigation of violation of product quality standard under the CPC Act after summons was duly issued and served.”

Seven people, including a pregnant woman and a baby were roasted to death at the weekend, after an accident, while five officials of Ogun State Traffic Compliance and Enforcement Agency (TRACE) and an unspecified number of traffic police were injured by hoodlums at Kara, along Lagos/Ibadan expressway, Vanguard reports.

The accident, which involved an 18-seater bus, occurred at about 3.30pm as the vehicle, which took off from Lagos reportedly went up in flames. The petrol tanker was said to have been leaky.

One of the passengers was said to have noticed a spark from the engine and raised the alarm which made the driver to stop abruptly in order to check the cause of the incident.

Eye witnesses account said all the passengers scampered for safety as soon as the vehicle stopped but this was too late as the fire had made the vehicle’s door to jam.

Vanguard reports that before help could come, seven of the passengers, including a pregnant woman and a baby, were burnt beyond recognition while eleven others sustained various degrees of injuries.

Some of the sympathisers were said to have put a call across to the fire fighters in Ogun State but none arrived the scene until the situation degenerated.

Meanwhile, some TRACE officials were said to have rushed to the scene but were prevented from rendering any assistance as hoodlums descended on them, venting their anger.

In the process, five officials, including the Akute Head of Operations, were assaulted.

An eye witness said the traffic police around the axis were not spared as many of them were injured by the hoodlums, although a distress call was later put across to both the Rapid Response Squad (RRS) in Lagos, and Quick Response Squad from Mowe axis, who eventually put the situation under control.

The bodies and the injured persons were said to have be taken to Ogun State University Teaching Hospital (OSUTH), Sagamu.

TRACE Public Relations Officer Babatunde Akinbiyi, who confirmed the development, said the officials arrived the scene as soon as they received a distress call but lamented that the miscreants threw caution to the wind, causing further damage on the ever-busy expressway.
