Ade Adesomoju, Abuja A Federal High Court in Abuja on Wednesday dismissed an application by a former Minister of Aviation, Stella Oduah, asking for an order to stop the Economic and Financial Crimes Commission and the police from arresting her with respect to the ongoing investigation into corruption allegation against her. Oduah had filed the fundamental rights enforcement suit, asking the court to prohibit the Attorney-General of the Federation’s office, the EFCC, and the police from “inviting, arresting, investigating or prosecuting” her over the purchase of two armoured BMW vehicles at the cost of N255m by the Nigerian Civil Aviation Authority under her watch as the aviation minister in 2013. Justice Abdu Kafarati in his judgment on Wednesday upheld the objection raised by the respondents, to the effect that the court lacked the requisite jurisdiction to hear the case. He held that that no court had the power to stop security agencies from carrying out their duty of investigation. He said, “It is not grantable by this court because the court cannot stop security agencies from carrying out their duties. There is no way a person can be investigated without being invited by the body charged with the responsibility of investigation. “In most cases, the invitation is even in the interest of the invitee because he or she will have the opportunity of giving his or her side of the story. “I therefore hold that the application seeking to stop security agencies from inviting, investigating, arresting and/or prosecuting any person suspected to have committed an offence does not constitute a fundamental right action.” Oduah had in the suit urged the court to declare illegal the alleged plot by the respondents to arrest, investigate and prosecute her in relation to her activities while in office, particularly the controversial two armoured vehicles purchased. The purchase of the armoured vehicles by the Nigerian Civil Aviation Authority while Oduah was in office attracted public criticism over allegation that the prices were inflated. Oduah had argued that the criminal allegations leveled against her as minister had been investigated by the EFCC and the House of Representatives’ Committee on Aviation, which both absolved her of any wrong doing. She had maintained that the investigation was going to be used as tool for political persecution against her. She had urged the court to declare that, having earlier been exonerated, any further investigation, arrest, harassment and prosecution of her person in relation to the same issue, amounted to the invasion of her fundamental right to personal liberty, freedom of movement and to be presumed innocent until proved guilty. http://punchng.com/n255m-armoured-cars-court-refuses-stop-stella-oduahs-arrest/

Friday Olokor, Abuja An election observer group, under the aegis of Alliance for Credible Elections, has alleged that the just-concluded governorship election in Edo State “was scientifically rigged.” The organisation warned that rigging must not be allowed to take place in the forthcoming governorship election in Ondo State. Speaking at a press conference in Abuja, the Acting General Secretary of ACE, Mma Odi, alleged that the election was rigged scientifically by Independent National Electoral Commission at the point of collation of results. But when contacted, the Chief Press Secretary to the INEC chairman, Rotimi Oyekanmi, told The Punch that every single vote cast on September 28 was jealously protected. He said, “INEC wishes to reiterate that the just-concluded Edo State governorship election was conducted within the ambit of the Electoral Law and the commission’s guidelines. The commission can confidently affirm that every single vote cast on September 28 was jealously safeguarded. “While the entire process may not have been perfect, no part of the collation process was compromised. The commission has an e-tracking mechanism specifically designed to track results.” But Odi described the Edo election as replica of the elections conducted in 2003 and 2007 under the administration of ex-President Olusegun Obasanjo. She alleged that the election saw a new innovation in rigging, saying it had taken the country to the dark days of the military era. She advised INEC against playing partisan role in its responsibilities, especially in subsequent elections. While advising the commission to put its house in order, ACE said the election, which saw two major participating political parties openly canvassing for votes at the polling units and aiding voters to cast their votes while inducing them, fell short of reasonable standard. “INEC must take proactive steps to ensure that these activities do not take place at the polling units. The secrecy of voting must be protected,” she said. http://punchng.com/rigging-allegation-group-inec-disagree-edo-election/

Afeez Hanafi A National Diploma holder of a polytechnic in Delta State, Anene Odikose, has been arrested by the Ogun State Police Command for impersonation. A police uniform, an identity card bearing his name and a Honda car were said to have been recovered from him by operatives attached to the Anti-Robbery Squad of the Agbado division. PUNCH Metro learnt that the team apprehended 31-year-old Odikose on Monday during a stop-and-search at a checkpoint on Matogun Road, Oke-Aro, in the Ifo Local Government Area of the state, where he lives. The suspect, who hails from Aniocha North, Delta State, had reportedly hid under the Force to defraud and harass unsuspecting members of the public before luck ran out on him. In a chat with our correspondent, Odikose said he was dismissed in 2011 while undergoing training at the police college in Rivers State. He said the shame of returning home made him to approach a police friend, who assisted him in obtaining the uniform and the ID card after he paid N500. He said, “I am an ND holder in Business Administration. I was enlisted in the police in October 2011. During the 15-month training at the police college in Rivers State, some officers came from Abuja to screen us. Unfortunately, I was dismissed on the grounds of physical fitness. “When I left the college, I was shy to go back to the village and tell my people that I had been disqualified. I went to live with a brother in Asaba (Delta State). “When my friends completed the training, I met with one of them, Henry, who was posted to Calabar, Cross River State. He collected N500 from me and helped me process a police ID card. He also gave me a police uniform.” Odikose, however, denied using the ID card and the uniform to commit crime, saying he only tendered the ID card at checkpoints to evade police interrogation whenever he drove out his car, whose documents were incomplete. “I came to Lagos in 2014. I was working as a security guard and a driver around Isolo (Lagos State). I got the ID card to avoid being intimidated on the road when I am driving. I have never used it to commit crime. I am a focused person. It was very unfortunate that I find myself in this kind of situation. “I had never shown the ID card to policemen until that day. All I want is mercy. I have two children and a wife to fend for,” he added. The Ogun State Police Public Relations Officer, ASP Abimbola Oyeyemi, said the case would be charged to court after investigation. He said, “At about 10.50am, a team of anti-robbery policemen on routine patrol around Oke-Aro, Matogun area, intercepted a Honda Civic with number plate, BW891LSR, driven by the suspect. He identified himself as a serving policeman and presented a Nigeria Police Force constable warrant ID card. On interrogation, it was discovered that he was a fake policeman. “Operatives conducted a search in his apartment, which led to the recovery of a police uniform, three police belts, one police headdress with crest and a police training manual. He will be charged to court after investigation.” http://punchng.com/bought-police-uniform-id-card-n500-suspect/

Femi Makinde, Osogbo The police on Tuesday arraigned a 40-year-old woman, Mrs. Regina Philip, and seven others before a magistrate’s court sitting in Osogbo, Osun State, for allegedly stealing 1,600 fowls valued at N1.5m. ’Femi Asu Global oil benchmark, Brent crude, extended its rally on Sunday to hit the $50 per barrel mark, the third time this year. This comes as the expected return of the Forcados export terminal has helped to boost Nigeria’s planned crude oil exports this month to about 1.98 million barrels per day, the most since January. Forcados, whose export has been suspended since February after militant attack on the export line, is one of Nigeria’s largest crude grades with an average output of about 200,000 bpd last year. No tankers have loaded from the terminal so far, according to Bloomberg ship-tracking data. Eight cargoes are scheduled to load this month with another six planned for November. The recent upsurge in militant attacks in the Niger Delta pushed oil shipments, the nation’s biggest export, to as low as 1.38 million bpd in August from a high of 2.1 million bpd in January. The Minister of State for Petroleum Resources, Dr. Ibe Kachikwu, last week, noted that the country had lost an average of 500,000 to 700,000 bpd over the last six to eight months. Commenting on the militancy in an interview with Bloomberg, the minister said the government was doing all it could to address the problem, adding that oil production had risen to 1.7 million bpd, up from a low of 1.2 million bpd about two months ago. Kachikwu said, “We think that if we can finalise the dialogues in the month of October, which is my anticipation, we should be able to get ourselves to end the year at about an average of two million barrels.” Oil prices have been on an uptrend since the Organisation of Petroleum Exporting Countries decided to cut output for the first time in eight years. Brent, against which half of the world’s oil is priced, had risen to around $48 per barrel last Wednesday after OPEC agreed to reduce production, compared to $45 earlier in the day. It stood at $50.19 per barrel as of 4.53pm Nigerian time on Sunday, up from around $49.66 per barrel on Thursday. OPEC agreed to cut production to a range of 32.5 million barrels per day to 33 million bpd from around 33.5 million bpd. http://punchng.com/oil-price-hits-50-nigerias-exports-rise/

Kamarudeen Ogundele, Ado Ekiti The Ekiti State Governor, Ayodele Fayose, and his from Osun State counterpart, Mr. Rauf Aregbesola have disagreed over the need to sell national assets to finance the 2016 budget. While Aregbesola urged the Federal Government to sell ‘idle’ national assets and spare the functional ones, Fayose opposed the idea, arguing that selling them would amount to auctioning Nigeria. The duo spoke in Ado Ekiti during an interactive forum which was part of the activities lined up to mark the 20th anniversary of the creation of Ekiti State. They, however, canvassed regional integration and cooperation as well as the revival of agriculture as some of the steps to revive national economy. Aregbesola, who delivered a lecture entitled, “The imperative of unity,” said the biting economic problem was such that in the whole of the South-West region, only Lagos State could stand on its own. He stressed the need to intensify efforts to revive agriculture, end oil pipeline vandalism and promote regional integration for meaningful development. He said, “We should revive agriculture, especially food production. Agriculture gives us raw materials for industries and aids in no small measure in economic development. If we can improve on our productivity in food production through agriculture, we will eliminate hunger in our land. “I want to urge Nigerians to end the ongoing vandalism of oil pipelines as the militants’ activities have been reducing the nation’s daily oil productivity level to between 700,000 and one million per barrel. “The current vandalism of oil pipeline by the Niger Delta militants is robbing the nation of oil production of 700,000 to one million per barrel on a daily basis. This amounts to a huge loss of oil revenue to the country and has further led to the current recession in the country. An urgent concerted effort is therefore needed to stop the vandalism so that the country could get out of the recession.” Aregbesola added, “It is high time the Yoruba nation and indeed the South-West united in terms of integrating our development strategies in education, commerce, economy, agriculture and tourism among others. There is no reason we should not unite for the best. “The truth is that no Yoruba state, with the exception of Lagos State, can survive alone without collaborating with sister states. Therefore, we have to come together, pull together our abundant human and material resources.” The governor described Ekiti people as men of integrity and courage and urged them to continue to support their governor for the development of the country. “I congratulate all Ekiti people on the 20th anniversary of the creation of your state, my state, our state. You fought the Ekiti Parapo War which is an indication of unity of purpose. There is strength in unity.” But Fayose, in his remarks, said selling the national assets was like selling Nigeria at a give-away price. “Selling our national assets simply amounts to auctioning Nigeria. If we sell the assets because the country is in recession, what would be left of Nigeria? “What would we call our own? Selling of assets is like moving the country backward. If we sell the assets to finance this year’s budget what would we sell next year? The Federal Government should look beyond its party and assemble economists and financial experts that would assist the President in his drive to bring the nation out of the present economic quagmire.” Urging the Federal Government to uphold the principles of justice and equity, which he said were germane to building democracy, the governor said, “Justice is very important and without it, democracy is already endangered. If people are now beginning to contest against the Independent National Electoral Commission and security agencies for manipulation of elections, then democracy is endangered. It is political parties that are supposed to contest elections and not people contesting against inadequacies of the electoral umpire.” http://punchng.com/fayose-aregbesola-disagree-sale-national-assets/
