Hello everyone, I am back as promised. Its PPR but a drama filled one. I am happy I got PPR but also sad. Sequel to my last message on the legal guardianship tussle, I got an email from CIC requesting I either take out my daughter from the application or get full adoption documents which the court had denied us or they would process my application in 30 days if they don't get a response. I wept and groaned. It is still too painful and emotional for me. We took her off the application and today I have PPR. We live to fight another day. I want to thank I.O of LVO group. She also had a similar case of custody and gave me much needed strength. Thank you Ma. For the sake of my daughter and not having her stigmatized (A few people know me well here), I won't be posting my specific date AOR. AOR to PPR: 9 months (London I hail). IP2 was Feb 27th. Thank you so much. I will raise a CSE. I initially uploaded the proof of custody (Court Judgement), her biological father's death certificate, Her biological mother's voter's ID card attached to a notorised consent she signed. I will get evidence of school fees we have been paying, HMO id cards, family pictures and anything I can think of. This will be attached in the CSE. I was just worried that won't raising a CSE without been asked sound like I am been on the defensive even when they have not queried me. God help me. I tire. GlitteringStar: |

Good morning everyone. Had to create a new moniker for this question. Its a long one but i want to give full details so as to get as many advice as I can get In 2013 we adopted a child from a mutual friend. She gave us an affidavit to that effect which was signed in court. We were to apply for an adoption order but we didn't as at then. When we thought of migrating, we went to the court to apply for adoption. The Lagos state child law act on adoption didn't favour us. They said only family members were allowed to adopt or we should take her to an orphanage and arrange the adoption from there. I couldn't bear the thought of taking my child to the orphanage and leave her there, the trauma and psychological effect. We opted instead to apply for legal guardianship as our lawyer advised. The Magistrate asked if her biological parents were alive, we told her just one parent and they awarded us joint custody with her biological mum saying Section 76 and 77 of Lagos child right law states you can't award full custody of a child to another person if any of the biological parent is alive and sane. We applied for PPR with her and got her Biological mother to sign the consent form. She has no objections whatsoever. She was angry at the court's decision to award joint custody as she had long ago decided to bless us with the adoption. I ordered notes and saw they highlighted her papers as a course for potential concern. I have attached it here, what do you all think please? 1. Is joint legal guardianship an issue? 2. We have evidence of her being with us since 2013, school fees receipts, HMO documents, Pictures. Should I raise a CSE and send those? 3. What is your opinion please? Kindly ignore my ramblings and help me. I am so confused right now. Well, since joint legal guardianship means that decision making is shared by both parents (adopted and biological) and the mother provided her consent, then the equation is balanced.
